MEMBERS PRESENT:
Mayor James Brainard; Council President Wayne Wilson; Council Members Kevin Kirby, John Koven, Bob
Battreall, Norm Rundle and Ron Carter; Deputy Clerk-Treasurer Carrie Gallagher. Councilor Luci Snyder
and Clerk-Treasurer Diana Cordray were absent.
Mayor Brainard called the meeting to order at 7:01 p.m.
Council President Wilson pronounced the Invocation.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Carter moved to approve the Minutes of the September 3, 2002 Special Meeting.
Koven seconded. The Minutes were approved by a vote of 6-0.

COUNCIL~ MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Battreall announced Public Safety Day at Carmel Civic Square on October 5, 2002.
ACTION ON MAYORAL VETOES:
There was none.
CLAIMS:
Councilor Rundle moved to approve claims in the amounts of $8,000.00, $286,061.57 and $1,501,214.09.
Councilor Carter seconded. Claims were approved 6-0.
COMMITTEE REPORTS:
Councilor Rundle stated that the Administration Con'anittee meeting was canceled due to lack of an agenda.
The next regular meeting of the Administration Committee is scheduled for October 11, 2002, at 8:00 a.m.
in the Caucus Room.
Councilor Wilson reported that the Annexation and Land Use Committee met on September 12, 2002, at
which time discussions continued regarding the annexation process. The Committee also considered the
underground utility lines Ordinance and recommended that it remain in Committee for further review. The
next regular meeting of the Committee is scheduled for October 10, 2002, at 7:00 p.m. in the Caucus Room.
Council President Wilson stated on behalf of absent Councilor Snyder that the Economic Development
Committee has not met. Future meetings of the Committee will be scheduled only as needed.
Council President Wilson reported that the Finance Committee met on September 9, 2002 to consider Bond
Ordinance Nos. D-1594-02 and D-1595-02. The Committee provided a 2-1 favorable recommendation of
these matters to Council. The Committee also considered the Clerk-Treasurer's Promotion Fund Ordinance
and provided a unanimous, favorable recommendation to Council. The next regular meeting of the Finance
Committee is scheduled for October 7, 2002, at 4:00 p.m. in the Clerk-Treasurer's Office.
Councilor Carter stated that the Parks and Recreation Committee has not met. The next regular meeting of
the Committee is scheduled for October 7, 2002, at 6:00 p.m. in the Caucus Room.
Councilor Battreall stated that the Public Safety Committee has not met and will not meet for the entire
month of October. Therefore, the next meeting of the Committee is scheduled for November 4, 2002, at
10:00 a.m. in the Caucus Room.
Councilor Koven reported that the Rules Committee has met on several occasions to discuss the re-
districting map. The next regular meeting of the Committee is scheduled for September 27, 2002, at 8:00
a.m. in the Council's office.
Councilor Kirby stated that the Utilities and Transportation Committee has not met. The next regular
meeting of the Committee is scheduled for October 11, 2002, at 8:00 a.m. in the Caucus Room.

Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain
Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and
Making the Same a Part of the City of Carmel (King). Councilor Koven read aloud the address/description
of the annexation area. There was no Council discussion. Ordinance No. C-220, As Amended, was
approved by a vote of 6-0.
Council President announced the Second Reading of Annexation Ordinance No. C-224, As Amended; An
Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of
Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part
of the City of Carmel (Russell). Councilor Koven read aloud the address/descri >tion of the annexation area.

Council President Wilson announced the Second Reading of Annexation Ordinance No. C-242, As
Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain
Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and
Making the Same a Part of the City of Carmel (Woodland Country Club). Councilor Koven read aloud the
address/description of the armexation area. There was no Council discussion. Ordinance No. C-242, As
Amended, was approved by a vote of 6-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1593-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 3, Division II, Section 2-

summary of this matter to Council. There was no discussion. Ordinance No. D-1593-02 was approved by a

There was extensive discussion. Councilor Kirby moved to adopt the proposed amended language as
written. Councilor Rundle seconded the motion. The motion to amend Ordinance No. D-1594-02, as
written, was approved by a vote of 6-0. Brief discussion continued. Ordinance No. D-1594-02 was
approved, as amended, by a vote of 5-1. Councilor Battreall voted in the opposition.

Council President Wilson announced the Second Reading of Ordinance No. Z-391-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Rezoning District Classifications (Dixie Highway
Addition). There was no Council discussion. Ordinance No. Z-391-02 was approved by a vote of 6-0.
PUBLIC HEARINGS:
The following Public Hearing Agenda Item No. l la, Ordinance No. D-1597-02~ was placed on the Agenda
inadvertently and will return to the Council Agenda on October 7, 2002, under Public Hearings and as
appropriately published according to I.C. 5-3-1-2. Therefore, the following noted business on this matter
will not be considered for permanent record.
Council President Wilson announced the First Reading of Ordinance No. D-1597-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional Appropriation
of Funds to the Depmmnent of Administration's Budget from the General Fund Operating Balance
($80,000.00 - Web Site). Councilor Kirby moved to introduce this item into business. Councilor Rundle
seconded. Council President Wilson opened the matter for Public Heating at 7:47 p.m. and asked for
anyone wishing to address Council regarding this matter to speak at this time. Garrett Bradley of the Boy
Scouts provided a web site vendor recommendation to Council members for consideration. Seeing no one
else who wished to speak, Council President Wilson closed the Public Heating at 7:50 p.m. Council
President Wilson provided a brief summary of the purpose for Public Hearings to the public. There was
brief Council discussion. Council President Wilson referred Ordinance No. D-1597-02 to the Finance
Committee for review and consideration.
NEW BUSINESS:
Council President Wilson announced the First Reading of Ordinance No. D-1596-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, Adopting and Adding Chapter 8, Article 2, Section 8-11 to
the Carmel City Code (Non-Conforming Traffic Control Devices). Councilor Rundle moved to introduce
this item into business. Councilor Battreall seconded. Councilor Rundle presented this matter to Council
and advised that this matter has had considerable consideration at the Committee level already. He
conveyed the Committee's favorable recommendation to Council and moved to suspend the roles sending
this matter to Committee prior to Council vote. Councilor Battreall seconded the motion to suspend. The
motion to suspend the rules was approved by a vote of 6-0. Ordinance No. D-1596-02 will return to
Council on October 7, 2002.
Council President Wilson announced Resolution No. CC-09-16-02-01; A Resolution of the Common
Council of the City of Cannel, Indiana, Designating 13000 North Meridian Street as an Economic
Development Area. Councilor Koven moved to introduce this item into business. Councilor Kirby
seconded. Councilor Koven presented this matter to Council. Larry Gigerich, Managing Director for
Ginovus and representing ITT Educational Services, Inc., provided additional comments concerning this
matter to Council. Jeff Burt, President of the Hamilton County Alliance, stated his pleasure in presenting
this business prospect to Council. There was extensive Council discussion. Mr. Gigerich responded to
Council questions and concerns. There was no further discussion. Resolution No. CC-09-16-02-01 was
approved by a vote of 6-0.
Council President Wilson announced Resolution No. CC-09-16-02-02 (formerly Resolution No. CC-09-03-
02-03); A Resolution of the Conm~on Council of the City of Carmel, Indiana, Establishing Its Intent to
Reimburse Certain Preliminary Costs From the Proceeds of Bonds. Council President Wilson provided a
brief summary of this matter to Council. There was no discussion. Resolution No. CC-09-16-02-02
(formerly Resolution No. CC-09-03-02-03), was approved by a vote of 5-1. Councilor Battreall voted in the
opposition.
OTHER BUSINESS:
Council President Wilson advised Council of an Interlocal Agreement Concerning E911 Frequencies
received from Hamilton County requesting Carmel City Council approval Upon £urther discussion of this
issue, Council President Wilson stated that he will advise the County that Council needs more time to
consider this matter.
