COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard; Council President Wayne Wilson; Council Members Kevin Kirby, John Koven, Norm Rundle, Luci Snyder and Ron Carter; Clerk-Treasurer Diana Cordray and Deputy Clerk-Treastucer Carrie Gallagher were also present. Councilor Bob Battreall was absent. Mayor Brainard called the meeting to order at 7:04 p.m. Council President Wilson pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: There were none. APPROVAL OF MINUTES: Councilor Rundle moved to approve the Minutes of the September 12, 2002 Special Meeting. Councilor Snyder seconded. The Minutes were approved by a vote of 6-0. Councilor Rundle moved to approve the Minutes of the September 16, 2002 Regular Meeting. Councilor Snyder seconded. The Minutes were approved 6-0. RECOGNITION OF PERSONS WHO WISH TO ADDRESS TF~E COUNCIL: The following persons addressed Council with concerns regarding the proposed mining ordinance to be presented at a later date: Jeff Joliet of 11158 Bradbur¥ Place; Phil Kincaid of 5000 Huntington Drive; Marcus Freihofer of 11136 Bradbur¥ Place; David Ezell of 5068 Huntington Drive; Bill McEvo¥ of 5120 Williams Circle. COUNCIL~ MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: Clerk-Treasurer Cordray expressed condolences to the family of Martha Ferrin, Clerk-Treasurer for the City of Carmel from 1956 to 1963. Mayor Brainard and Councilors Carter, Snyder and Koven responded to the concerns expressed to Council regarding the proposed mining ordinance. ACTION ON MAYORAL VETOES: There was none. CLAIMS: Councilor Snyder moved to approve claims in the amounts of $277,759.43, $286,666.63 and $1,937,947.10. Councilor Rundle seconded. Claims were approved 6-0. COMMITTEE REPORTS: Councilor Rundle stated that the Administration Committee has not met. The next regular meeting of the Administration Committee is scheduled for October 11, 2002, at 8:00 a.m. in the Caucus Room. Councilor Wilson reported that the Annexation and Land Use Committee has not met. The next regular meeting of the Committee is scheduled for October 10, 2002, at 7:00 p.m. in the Caucus Room. Councilor Snyder stated that the Economic Development Committee has not met. Future meetings of the Committee will be scheduled only as needed. Council President Wilson reported that the Finance Committee met on October 7, 2002 to discuss the proposed additional appropriation for the City web site. The Committee provided a unanimous, favorable recommendation of that Ordinance. The next regular meeting of the Finance Committee is scheduled for November 4, 2002, at 4:00 p.m. in the Caucus Room. Councilor Carter stated that the Parks and Recreation Committee met on October 7, 2002, at which time the Committee discussed the lease arrangement with the Parks Department and their interest in the purchase of new property. The next regular meeting of the Committee is scheduled for November 4, 2002, at 6:00 p.m. in the Caucus Room. Council President Wilson stated on behalf of Councilor Battreall that the Public Safety Committee has not met and will not meet for the month of October. Therefore, the next meeting of the Committee is scheduled for November 4, 2002, at 10:00 a.m. in the Caucus Room. Councilor Koven reported that the Rules Committee has met on several occasions to discuss the re- districting map. The next regular meeting of the Committee is scheduled for October 25, 2002, at 8:00 a.m. in the Council's office. Councilor Kirby stated that the Utilities and Transportation Committee has not met. The next regular meeting of the Committee is scheduled for October 11, 2002, at 8:00 a.m. in the Caucus Room. 2 OLD BUSINESS: Council President Wilson announced the Second Reading of Ordinance No. D-1596-02; An Ordinance of the Common Council of the City of CanneI, Indiana, Adopting and Adding Chapter 8, Article 2, Section 8- 11 to the Carmel City Code (Non-Conforming Traffic Control Devices). Councilor Rundle presented this matter to Council. There was extensive Council discussion concerning the necessity of certain signs once a specific need has passed. Ordinance No. D-1596-02 was approved by a vote of 5-1. Councilor Koven voted in the opposition. PUBLIC HEARINGS: Council President Wilson announced the First Reading of Annexation Ordinance No. C-238; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and Making the Same a Part of the City of Carmel (Martin). Councilor Koven moved to amend Ordinance No. C-238 by accepting the revised Exhibit B, as written. Councilor Snyder seconded. The amendment was approved by a vote of 6-0. Councilor Koven provided a description of the proposed mmexed area(s) to Council. Council President Wilson then opened the matter for Public Hearing at 8:08 p.m. Seeing no one who wished to speak, he closed the Public Hearing at 8:09 p.m. Ordinance No. C-238, As Amended, will return to Council upon the expiration of 30 days. Councilor Koven moved to amend Ordinance No. C-240 by accepting the revised Exhibit B, as written. Councilor Snyder seconded. The amendment was approved by a vote of 6-0. Councilor Koven provided a description of the proposed annexed area(s) to Council. Council President Wilson then opened the matter for Public Hearing at 8:11 p.m. The following person addressed Council concerning the proposed annexation: Rick Sanders of 11033 Harverstick Road, expressed concerns regarding any possibly zoning changes upon the annexation of this property; Seeing no one else who wished to speak, Council President Wilson closed the Public Hearing at 8:18 p.m. Ordinance No. C-240, As Amended, will return to Council upon the expiration of 30 days. Council President Wilson announced the First Reading of Ordinance No. D-1597-02 (Placed Inadvertently on the 9/16/02 Agenda); An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional Appropriation of Funds to the Department of Administration's Budget from the General Fund Operating Balance ($80,000.00 - Web Site). Councilor Rundle moved to introduce this item into business. Councilor Snyder seconded. Council President Wilson stated that this matter was previously discussed, although inadvertently, and will now commence with the official Public Hearing. He provided a brief summary of this matter to Council and opened the Public Hearing at 8:30 p.m. Seeing no one who wished to speak, Council President Wilson closed the Public Hearing at 8:30 p.m. There was extensive Council discussion regarding the guarantee that all funds appropriated would be used only for the development of the new web site. Council President Wilson passed the gavel to Councilor Rundle to further summarize this issue to the public. Discussion continued. Councilor Carter expressed concern regarding the amount of the appropriation and recommended updating the current web site allowing the remaining funds to be applied to other projects. Brief discussion continued. Councilor Kirby then moved to suspend the roles sending this matter to Committee since it has already been discussed in Finance Committee and also moved to vote on this matter tonight. Councilor Koven seconded the full motion. The motion to suspend the roles was approved by a vote of 5-1. Councilor Carter voted in the opposition. Ordinance No. D-1597-02 was approved by a vote of 5-1. Councilor Carter again voted in the opposition. Council President Wilson aunounced the First Reading of Ordinance No. Z-395-02; An Ordinance of the Common Council of the City of Carmel, Indiana, Rezoning District Classification (Twin Lakes Golf Club from the R-I/Residence District Classification to the P-I/Parks & Recreation District Classification). Councilor Rundle moved to introduce this item into business. Councilor Snyder seconded. Council President Wilson presented this matter to Council and opened the Public Hearing at 8:45 p.m. Seeing no -- one who wished to speak, he closed the Public Hearing at 8:45 p.m. There was brief Council discussion. Council President Wilson armounced the First Reading of Ordinance No. D-1602-02; An Ordinance of the Common Council of the City of Carmel, Indiana, Concerning Council District Boundaries. Councilor Kirby moved to introduce this item into business. Councilor Koven seconded and presented this matter to Council. There was extensive discussion. Councilor Koven scheduled a Special Rules Meeting for October 11, 2002 at 8:00 a.m. to further consider this matter. Therefore, Council President Wilson referred -- Ordinance No. D-1602-02 to the Rules Committee for consideration. Council President Wilson announced Resolution No. CC-10-07-02-01; A Resolution of the Common Council of the City of Carmel, Indiana, Regarding Sale of Property By the Carmel Housing Authority. Councilor Carter moved to introduce this item into business. Councilor Snyder seconded. Councilor Carter presented this matter to Council. There was extensive Council discussion and concerns expressed regarding the proposed property. Mayor Brainard responded to Council. Discussion continued. Council President Wilson then referred Resolution No. CC-10-07-02-01 to the Annexation and Land Use Committee for further review and consideration. Council President Wilson announced Resolution No. CC-10-07-02-02; A Resolution of the Common Council of the City of Carmel, Indiana, Establishing a Cellular Telephone Policy for City Council Members. Councilor Koven moved to introduce this item into business. Councilor Snyder seconded. Councilor Koven presented this matter to Council. Clerk-Treasurer Cordray questioned the possibility of advising the Council of excess charges on a "quarterly" basis rather than the "monthly" basis as indicated in the document. There was no objection. Councilor Kirby then moved to amend the last sentence of Section IV to reflect" ..... quarterly" instead of" ..... monthly". Councilor Carter seconded. The motion to amend was approved by a vote of 6-0. Resolution No. CC-10-07-02-02 was approved, as amended, by a vote of 6-0. Council President Wilson announced Resolution No. CC-10-07-02-03; A Resolution of the Common Council of the City of Carmel, Indiana, Approving a Five-Year Personal Property Tax Abatement for ITT Educational Services, Inc. Located at 13000 North Meridian Street in the Hamilton Crossing Development. Councilor Kirby moved to introduce this item into business. Councilor Koven seconded. Councilor Snyder presented this matter to Council. There was no discussion. Resolution No. CC-10-07-02-03 was approved by a vote of 6-0. Council President Wilson announced Resolution No. CC-10-07-02-04; A Resolution of the Common Council of the City of Carmel, Indiana, Regarding Purchase of Property By the Carmel/Clay Parks and Recreation Board. Councilor Carter moved to introduce this item into business. Councilor Rundle seconded. Council President Wilson recommended that the date referenced in the first paragraph be changed to reflect the document most recently adopted by Council. The Clerk-Treasurer advised that the date will be changed accordingly. There was no further discussion. Resolution No. CC-10-07-02-04 was approved by a vote of 6-0. OTHER BUSINESS: Council President Wilson announced the Withdrawal of Ordinance No. D-1561-02; An Ordinance of the Common Council of the City of Carmel, Indiana, Creating the Depamnent of Parks and Recreation. Councilor Kirby moved to officially withdraw this matter from Council business. Councilor Koven seconded and briefly summarized the original intent of this Ordinance. There was no further discussion. Ordinance No. D-1561-02 was withdrawn by a vote of 6-0. Council President Wilson announced the Withdrawal of Resolution No. CC-05-06-02-01; A Resolution of the Common Council of the City of Carmel, Indiana, for the Consideration and Approval by the Common Council of the City of Carmel, Indiana, of an Interlocal Cooperation Agreement Between the City of Carmel and Clay Township for the Provision of Park and Recreational Services to the Residents of the City of Carmel and Clay Township. Councilor Kirby moved to officially withdraw this matter from Council business. Councilor Koven seconded. There was no discussion. Resolution No. CC-05-06-02-01 was withdrawn by a vote of 6-0.
