RIDER TO WARRANTY DEED FROM MERCHANTS
NATIONAL BANK & TRUST COMPANY, AS TRUSTEE, TO
PUBLIC SERVICE COMPANY OF INDIANA, INC.
This warranty deed is executed and delivered on the express
condition that anything herein to the contrary notwithstanding,
each and all of the representations and warranties herein made
on the part of Grantor ("Representations") , while in form pur-
porting to be the Representations of Merchants National Bank &
Trust Company of Indianapolis ("Merchants" ) , are nevertheless
each and every one of them, made and intended not as personal
Representations by Merchants or for the purpose or with the
intention of binding Merchants personally, but are made and in-
tended for the purpose of binding only the trust property, and
this deed is executed and delivered by Merchants not in its own
right, but solely in the exercise of the powers conferred upon
it as Trustee; and no personal liability or personal responsibility
is assumed by nor shall at any time be asserted or enforceable
against Merchants in its individual capacity, or any of the
beneficiaries under the agreement establishing the trust of which
Merchants is Trustee, on account of this deed or on account of any
Representations of Grantor in this deed contained, either express
or implied, all such personal liability, if any, being expressly
waived and released.
