MONDAY, DECEMBER 16, 2002 -- 7:00 P.M.

MEMBERS PRESENT'-
Mayor James Brainard; Council President Wayne Wilson; Council Members Kevin Kirby, John Koven, Bob
Battreall, Norm Rundle, Luci Snyder and Ron Carter; Clerk-Treasurer Diana Cordray and Deputy Clerk-
Treasurer Carrie Gallagher were also present.
Mayor Brainard called the meeting to order at 7:04 p.m.
Council President Wilson pronounced the Invocation.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Rundle moved to approve the Minutes of the December 2, 2002 Regular Meeting. Councilor
Koven seconded. The Minutes were approved 6-0. Councilor Battreall abstained since he was not present
at that meeting.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
The following persons addressed Council:
Brace Cordingle¥ of 8888 Keystone Crossing, on behalf of Pedcor Companies, expressed
appreciation to the City for the opportunity to relocate their business in Carmel;
Kasev Kauffman of 10525 Power Drive, Council Appointment to the Carmel/Clay Library Board,
provided a Quarterly Library Report to Council.
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
There were none.
ACTION ON MAYORAL VETOES:
There was none.
CLAIMS:
Councilor Snyder moved to approve a claim in the amount of $1,243,428.28. Councilor Rundle seconded.
Claims were approved 7-0.
COMMITTEE REPORTS:
Councilor Rundle stated that the Administration Committee has not met.
Councilor Wilson stated that the Annexation and Land Use Committee canceled its regular meeting
scheduled for December 12, 2002. A Special meeting of the Committee will be scheduled before the end of
the year.
Councilor Snyder stated that the Economic Development Committee has not met.
Council President Wilson stated that the Finance Committee has not met.
Councilor Carter reported that the Parks and Recreation Committee met in a Special meeting on December
16, 2002, to discuss the proposed office leases with Pedcor Companies. The Committee provided a 2-1,
-- favorable recommendation in support of the Resolutions for such leases.
Councilor Battreall reported that the Public Safety Committee met on December 16, 2002, at which time
general discussion was held due to lack of an agenda.
Councilor Koven stated that the Rules Committee has not met and will cancel its next regular meeting
scheduled for December 27, 2002, due to lack of an agenda.
Councilor Kirby reported that the Utilities and Transportation Committee met in a Special meeting on
December 13, 2002, to discuss the water and sewer budgets. The Committee provided a unanimous,
favorable recommendation for the passage of both budgets.
Council President Wilson announced two Add-On Items for Council's consideration this evening and asked
for a motion to add these items to the Agenda. Councilor Carter moved to add Resolution No. CC-12-16-
02-06 to the Agenda. Councilor Snyder seconded. The Resolution was added to the Agenda by a vote of 7-0.
Councilor Rundle moved to add Ordinance No. D-1614-02 to the Agenda. Councilor Battreall seconded.
The Ordinance was added to the Agenda by a vote of 7-0.
OLD BUSINESS:
Council President Wilson announced the Second Reading of Ordinance No. A-88-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, to Budget Expenditures for the Operation and
-- Depreciation Funds for the Water Utility. Councilor Kirby presented this matter to Council. There was no
discussion. Ordinance No. A-88-02 was approved by a vote of 7-0.
Council President Wilson announced the Second Reading of Ordinance No. S-69-02; An Ordinance of the
Common Council of the City of Carmel, Indiana, to Budget Expenditures for the Operation and
Depreciation Funds for the Wastewater Utility. Councilor Kirby presented this matter to Council. There
was no discussion. Ordinance No. S-69-02 was approved by a vote of 7-0.
Council President Wilson announced the Second Reading of Annexation Ordinance No. C-217, As
Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain
Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and
Making the Same a Part of the City of Cannel (Huse). Councilor Koven read aloud the address/legal
description of the annexation area. There was no Council discussion. Ordinance No. C-217, As Amended,
was approved by a vote of 7-0.

Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Annexing Certain
Territory to the City of Carmel, Indiana, Placing the Same Within the Corporation Boundaries Thereof and
Making the Same a Part of the City of Carmel (North Keystone Avenue). Councilor Koven read aloud the
address/legal description of the annexation area. There was no Council discussion. Ordinance No. C-218,
As Amended, was approved by a vote of 7-0.

Council President Wilson announced the Second Reading of Ordinance No. D-1598-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 4, Section 2-101 of the
Carmel City Code (Police and Fire Pension Funds). Council President Wilson asked for a motion to remove
this item from the table. Councilor Snyder so moved. Councilor Koven seconded. Councilor Snyder
presented this matter to Council and moved to amend item (f) as read aloud. Councilor Battreall seconded
the motion to amend. The motion to amend was approved by a vote of 7-0. Ordinance No. D-1598-02 was
approved, as amended, by a vote of 7-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1605-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Approving an Interlocal Agreement Between the City
of Carmel, Indiana, and Hamilton County, Indiana, Concerning Primrose Development, LLC. Council
President Wilson presented this matter to Council and acknowledged the petitioner's request to withdraw
this matter for Council consideration. Therefore, Councilor Carter moved to withdraw. Councilor Snyder
seconded. Ordinance No. D-1605-02 was withdrawn from the Agenda by a vote of 7-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1611-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Adding Chapter 2, Article 4, Section 2-121 to the
Carmel City Code (Parks and Recreation Non-reverting Operating Fund). Councilor Carter presented this
matter to Council and moved to amend item (4) as read aloud. Councilor Battreall seconded the motion to
amend. The amendment was approved by a vote of 7-0. Ordinance No. D-1611-02 was approved, as
amended, by a vote of 7-0.
Council President Wilson announced the Second Reading of Ordinance No. D-1613-02; An Ordinance of
the Common Council of the City of Carmel, Indiana, Adding Chapter 2, Article 4, Section 2-122 to the
Cannel City Code (Parks and Recreation Non-reverting Capital Fund). Councilor Carter presented this
matter to Council and moved to amend item (4) as read aloud. Councilor Battreall seconded the motion to
amend. The amendment was approved by a vote of 7-0. Ordinance No. D-1613-02 was approved, as
amended, by a vote of 7-0.

NEW BUSINESS:
Council President Wilson announced Add-On Item, Ordinance No. D-1614-02: An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Ordinance No. D-1587-02, the Fixed Salaries
of Appointed Officers and Employees of the Carmel City Court, Carmel, Indiana, for the Year 2003 (Bailiff
Hourly Rate). Councilor Kirby moved to introduce this item into business. Councilor Battreall seconded.
Councilor Carter presented this matter to Council. Clerk-Treasurer Diana Cordray stated that the need for
an amendment to the original salary Ordinance was simply a scrivener's error. There was brief Council
discussion. Councilor Rundle moved to suspend the rules sending this matter to Committee. Councilor
Carter seconded. The motion to suspend the rules was approved 7-0. Councilor Rundle then moved to
suspend the rules to act on this matter tonight. Councilor Carter seconded. The motion to suspend the
rules to act on this matter tonight was also approved 7-0. Ordinance No. D-1614-02 was approved by a
vote of 7-0.
Council President Wilson announced Resolution No. CC-12-16-02-01; A Resolution of the Common
Council of the City of Carmel, Indiana, to Authorize a Transfer of Funds by the Carmel Fire Department
($5,000.00). Councilor Battreall moved to introduce this item into business. Councilor Rundle seconded.
Councilor Battreall presented this matter to Council. There was no discussion. Resolution No. CC-12-16-
-- 02-01 was approved by a vote of 7-0.
Council President Wilson announced Resolution No. CC-12-16-02-02; A Resolution of the Common
Council of the City of Carmel, Indiana, Acknowledging and Supporting an AdditiunaFSpecial
Appropriation of Funds ($360,000.00 - Parks Property). Councilor Carter moved to introduce this item into
business. Councilor Rundle seconded. Councilor Carter presented this matter to Council. There was brief
discussion. Resolution No. CC-12-16-02-02 was approved by a vote of 7-0.
Council President Wilson announced Resolution No. CC-12-16-02-03; A Resolution of the Common
Council of the City of Carmel, Indiana, to Authorize a Transfer of Funds by the Department of Community
Services ($153,000.00). Councilor Snyder moved to introduce this item into business. Councilor Battreall
seconded. Councilor Snyder presented this matter to Council. Michael Hollibaugh, Director of the
Department of Community Services, provided additional information on this matter and responded to
Council questions and concerns. There was extensive Council discussion. Councilor Snyder moved to
amend the amount of the transfer from $153.000.00 to $80,520.00. Councilor Carter seconded the motion
to amend. Council discussion continued. The motion to amend was approved by a vote of 7-0. Resolution
No. CC-12-16-02-03 was approved, as amended, by a vote of 7-0.
Council President Wilson announced Resolution No. CC-12-16-02-04; A Resolution of the Common
Council of the City of Carmel, Indiana, Regarding an Office Lease for the Carmel/Clay Park and Recreation
Department. Councilor Battreall moved to introduce this item into business. Councilor Carter seconded
and presented this matter to Council. There was extensive Council discussion. Deb Grisham, Attorney for
the Parks Board, provided additional details concerning this matter. Discussion continued. Phil Bennett,
Director of the Carmel/Clay Parks Department, addressed Council regarding current and anticipated needs
-- for space, both administratively and recreationally. Council discussion continued. Council President
Wilson called for the question. Resolution No. CC-12-16-02-04 was approved by a vote of 7-0.
Council President Wilson announced Resolution No. CC-12-16-02-05; A Resolution of the Common
Council of the City of Carmel, Indiana, Regarding an Office Lease for the Carmel Utilities Department.
Councilor Battreall moved to introduce this itmu into business. Councilor Carter seconded and presented
this matter to Council. John Duffy, Director of the Department of Utilities, addressed Council regarding
this issue and advised of his department's current leasing status. Mr. Duffy stated that based on the
proposed IWC purchase, he could anticipate the need for additional office space, especially considering that
the Engineering department is currently experiencing a need for more space. He stated that this proposed
office lease for the Utilities Department could fulfill that necessity, allowing all departments to be more
efficient. There was extensive Council discussion. Mr. Duffy responded to Council questions. Council
President Wilson called for the question. Resolution No. CC-12-16-02-05 was approved by a vote of 7-0.
Council President Wilson announced Resolution No. CC-12-16-02-06 (previously referred to as CC-12-16-
02-04 incorrectly); A Resolution of the Common Council of the City of Carmel, Indiana, to Authorize a
Transfer of Funds by the Department of Law ($305.00). Councilor Kirby moved to introduce this item into
business. Councilor Snyder seconded. Council President Wilson presented this matter to Council. There
was no discussion. Resolution No. CC-12-16-02-06 was approved by a vote of 7-0.

ANNOUNCEMENTS:
Councilor Carter advised of another accident at Keystone and U.S. 31 and asked Council to consider the
possibility of encouraging INDOT to place additional signage at light to prepare vehicles to stop if light is
flashing.

Mayor Brainard moved to adjourn pending the execution of documents. The meeting was adjourned at 8:47
p.m.
