CHAMBERs / CITY I-/ALL / ONE CIV/C SQUARE ]VIEMBERS PRESENT: Council President Luci Snyder; Council Members Kevin Kirby, John Koven, Norm Rundle, Run Carter and Wayne Wilson; Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Carrie Gallagher were also present. Mayor James Brainard and Councilor Bob Battreall were absent. Council President Snyder called the meeting to order at 7:01 p.m. Dr. Marcus Warner, Pastor of River Oaks Community Church pronounced the Invocation. __Council President Snyder led the P/edge of Allegiance. ;~ECOGNITION OF CITY EMPLOYEEs AND OUTSTANDING CITIZENS: Council President Snydcr recognized Clerk-Treasurer Diana Cordray for her third consecutive appointment to the Executive Committee of thc Indiana Association of Cities and Towns. APPROVAL OF MINUTES: Councilor Rundle moved to approve the Minutes of the October 20, 2003 Regular Meeting. Councilor Wilson seconded. The Minutes were approved 5-0. Councilor Carter abstained since he was not present at that meeting. RECOGNITION OF PERSONS WHO WISH To ADDRESS TI~E COUNCIL: Major Robert Scott of 3420 East 106th Street, addressed Council and the community on behalf of The Salvation Army regarding the approaching holidays. Major Scott advised that donations and volunteers are needed and inquiries may be made at (317) 937-7000. Bruce Knott with the Carmel Fire Department, addressed Council and the community regarding the Christmas Assistance Program (CAP). Mr. Knott advised that volunteers are needed to wrap gifts on December 7th as well as to deliver food and gifts to local families on December 20th Mr. Knott may be con~tacted directly at (317) 571-2662. · ~ Sherrill of 149 Lantern Lane, requested Council to authorize the City Engineer to conduct a study for s ~d humps in Johnson Addition. Mary Eckard of 136 Lantern Lane, addressed Council on behalf of the Clay Township Board in a request to join the City of Carmel's Reverse 911 System. COUNCIL MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: Councilor Kirby responded to the join the City's Reverse 911 System and recommended that this referred to the Public Safety Committee for further review and consideration, matter be Council President Snyder referred discussion of the Reverse 911 System as well as the request for speed humps in Johnson Addition to the Public Safety Committee. ACTION ON MAYORAL VETOES: There were none. _CLAIMS: Councilor Rundle moved to approve a claim in the amount of $2,501,148.46. Councilor Wilson seconded. The Claim was approved 6-0. ~CoMMITTEE REPORTS: Councilor Carter stated that the Administration Committee has not met. Future meetings of the Committee ~vill be scheduled only as needed~ Councilor Koven stated that the Annexation and Land Use Committee has not met. The next regular meeting of the Committee is scheduled for November 13, 2003, at 7:00 p.m. in the Caucus Room. Council President Snyder stated that the Economic Development Committee has not met. Future meetings of the Committee will be scheduled only as needed. Council President Snyder reported that the Finance Committee met on October 23, 2003, at which time the Committee discussed Ordinance Nos. D-1654-03 and D-1655-03, both of which the Committee provided a 3-0 favorable recommendation to Council. The next regular meeting of the Committee is scheduled for November 13, 2003, at 9:00 a.m. in the Caucus Room. Councilor Carter stated that the parks and Recreation Committee has not met. Future meetings of the Committee will be scheduled only as needed. Councilor Wilson stated that the Public Safety Committee has not met. The next meeting of the Committee is scheduled for November 17, 2003, at 10:00 a.m. in the Caucus Room. Councilor Koven reported that the Rules Committe___~e met on October 24, 2003, at which time the Committee discussed Ordinance No. D-1653-03. The next regular meeting of the Committee is scheduled for November 28, 2003, at 8:00 a.m. in the Caucus Room. C~ouncilor Kirby stated that the Utilities and Transportation Committee has not met. Future meetings of the ~mmittee will be scheduled only as needed. 2 OLD BUSINESS: Council President Snyder announced the S.~econd Reading of Ordinance No. D-1654-0_3; An Ordinance of the Common Council of the City of Carmel, Indiana, Providing for an Additional Appropriation of Funds From the General Fund Operating Balance ($201,500.00 - Street Maintenance Facility/S481,500.00 _ Parks Joinder Payment). Councilor Wilson presented this matter to Council. Council President Snyder advised that the Finance Committee provided a unanimous, favorable recommendation of this item to Council for its passage. There was no Council discussion. ~Ordinance No. D-1654-03 was approved by a vote of 6-0. Council President Snyder announced the Second Reading of Ordinance No. D-1655-03; An Ordinance of the Common Council of the City of Carn~el, Indiana, Providing for an Additional Appropriation of Funds From the Rainy. PUBLIC HEARINGS: Council President Snyder introduced items to be considered by Council to add to this evening's Agenda. Councilor Koven moved to add Resolution Nos. CC-11-03-03-03 and CC-11-03-03-04 to the Agenda at the __end of New Business. Councilor Rundle seconded The motion to add-on was approved 6-0. Councilor Wilson moved to introduce this item into business. Councilor Koven seconded. Councilor Koven presented this matter to Council and asked that the Public Hearing, once opened, be held open until the next meeting of Council as the voluntary petition paperwork is still being compiled from Lowe's. Council President Snyder opened the matter for Public Hearing at 7:37 p.m. There was no one who wished to speak at this time. The Public Heating will remain open through the next Council meeting on November 17, 2003. Council President Snyder announced the First Reading of Ordinance No. D-1656-03; An Ordinance of the Common Council of the City of Cannel, Indiana, Providing for an Additional Appropriation of Funds From the Parks Capital Fund Operating Balance ($172,261.70). Councilor Carter moved to introduce this item into business. Councilor Wilson seconded. Councilor Carter presented this matter to Council. Jim Engledow, Parks Board Treasurer, provided additional details concerning this request. There was Council discussion. Council President Snyder opened the matter for Public Hearing at 7:44 p.m. Seeing no one who wished to speak, the Public Heating was closed at 7:44:30. Councilor Kirby moved to suspend the rules sending this matter to Committee. Councilor Koven seconded. The vote was 5-1 with Councilor Rundle voting in the opposition. Council President Snyder announced the First Reading of Ordinance No. Z-420-03; An Ordinance of the Common Council of the City of Carmel, Indiana, Establishing the Morion Patio Homes Planned Unit Development District. Councilor Wilson moved to introduce this item into business. Councilor Carter seconded. Joseph Scimia of Baker and Daniels, Attorney for Hearthview Residential, LLC, presented this matter to Council. There was Council discussion. Mr. Scimia responded to Council questions and concerns. Council President Snyder opened the matter for Public Hearing at 8:25 p.m. The following persons addressed Council concerning this matter: Bruce Barker of! 1575 Freeport Drive, expressed his opposition to the proposed Ordinance; Bill Fry of 1329 Donnybrook Drive, stated his favor of the proposed Ordinance; Mike Giock of 1228 Donnybrook Drive, expressed he is not in support of the proposed Ordinance, but chose not to fight it; Scott Unger of 11618 Rosemead, stated his opposition to the proposed Ordinance; Bill ~Viggam ofl1704 Gableson Drive, expressed his opposition to the proposed Ordinance. ~%eing no one else who wished to speak, Council President Snyder closed the Public Hearing at 8:37 p.m. .nd referred Ordinance No. Z-420-03 to the Annexation and Land Use Committee for further review and ~onsideration. Councilor Kirby moved to introduce this item into business. Councilor Wilson seconded. Diana Cordray, Clerk-Treasurer, presented this matter to Council and proposed that Council consider suspending the rules sending this matter to Committee. There was extensive Council discussion and disagreement with the recommendation to suspend the rules. Therefore, Council President Snydcr referred Ordinance No. D-1658- 0~3 to the Finance Committee for further review and consideration. - Council President Snyder announced Resolution No. CC-11-03-03-01; A Resolution of the Common Council of the City of Carmel, Indiana,'Adopting a Fiscal Plan for the Annexation of Property Contiguous to the City of Carmel, Indiana (C-261). Resolution No. CC-I 1-03-03-07 was approved by a vote of 6-0. ADD-ONS: Council President Snyder announced Resolution No. CC-11~03~03~03; A Resolution of the Common Council of the City of Carmel, Indiana, Concerning Planning and Zoning Jurisdiction. Councilor Rundle moved to introduce this item into business. Councilor Wilson seconded. Council President Snyder presented this matter to Council. There was no discussion. Resolution No. CC-11-03-03-03 was approved by a vote of 6-0. Council President Snyder announced Resolution No. CC-11-03-03~04; A Resolution of the Common Council of the City of Cannel, Indiana, Approving a Transfer of Funds to the Budget of the Street Department ($142,000.00). Councilor Rundle moved to introduce this item into business. Councilor Wilson seconded. David Kiingensmith, Street Commissioner, presented this matter to Council. There was no discussion. Resolution No. CC-11-03-03-04 was approved by a vote of 6-0. OI'HER BUSINESS: Council President Snyder encouraged the public to vote. -~ouncilor Kirby requested that Council President Snyder review the Council's budget for consideration of a :w computer in Council's office. C~or~a~,h_AMC 11/03/03 CC Minutes 6 Mary Eekard, 136 Lantern Lane, Carmel, IN 46032 Phone(317) 843-1217 Fax(317) 843-0332 November 3, 2003 To: Members of the Carmel City Council From: Mary Eckard representing the Clay Township Board Subject: Reverse 911 I am here tonight representing the Clay Township Board to talk with you about Reverse 911. As you probably already know, Reverse 911 is an interactive community notification system. The system is designed to call all th6 citizens of a community when notification of an emergency is necessary. The people inside the city limits of Carmel have such a notification system but the people living in the Township outside the city limits do not. The Clay Township Board represents all the citizens within Clay Township, which includes the City of Carmel, and feel that having such a system is a public safety issue. We l~el that all people within the Township should have access to it and that in these uncertain times, we feel it is necessary to offer the citizens outside the city of Carmel the same protection that is offered inside the city limits. If thc Township outside the city limits of Carmel had to install this system, it would cost the taxpayers of the whole Township $25,000 and would have to be connected through Hamilton County. The Township outside the city limits of Carmel could handle the cost more efficiently by adding to Carmel's system, which would on/}, cost approximately $2,000 to add a new map and the names of the people living in the Township outside the city to the existing database. The Hamilton County Council has indicated th~at they have not yet addressed Reverse 911. The Clay Township Board has budgeted money for this system because the Board feels that this is a public safety issue for all people in Clay Township. What is needed to go forward is an agreement with the Carmel City Council and the City of Carmel to allow the Township to add on to the system already in place. Tomorrow is an election day. I know the citizens in the Township would like the outgoing Council and the incoming Council to work together with the Township Board in keeping taxes down and to have services provided in the most economical way. I ask you to consider the taxpayers in Clay Township by spending only $2,000 rather than $25,000.
