COUNCIL CHAMBERS / CITY HALL / ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard, Board Member Lori Watson; Deputy Clerk-Treasurer, Sandra Johnson Mayor James Brainard called the meeting to order at 10:06 a.m. MINUTES Minutes for the July 21, 2004 Regular Meeting were tabled until the next meeting. BID OPENINGS/AWARDS Bid Opening for 2004-2004 Salt Program; Mayor James Brainard opened and read the bid aloud. Company Bid Cargill De-iceing $ 237,105.00 The bids were given to David Klingensmith, Director of the Street Department. Mr. Klingensmith requested that the Board Award the project to Cargill, provided all necessary documents were included in bid. Mayor Brainard moved to approve, Board Member Watson seconded. Mr. McBride requested that the Board Award the project to Calumet Asphalt, provided all necessary documents were included in bid. Mayor Brainard moved to approve, Board Member Watson seconded. Request approved 2-0. Appeal Hearing for Code violations of Property located at 40 Woodland Drive; Assistant City Attorney, Tom Perkins presented the evidence to the Board. Two exhibits were presented. Home Owner Robert Glasser addressed the Board. There was brief discussion. The Board agreed to modify the order with several conditions (these conditions will be provided by the Legal Department) and the order will come back at the August 18, 2004 meeting. Our btfilding commissioner, Jeff Kendall, has been talking with Mr. Glasser, the property owner, in regard to his tarps. The last 1 have heard, the work for the roof should begin this weekend and completed in a matter of days. In regard to the grass/weeds, after the last time we spoke I initiated an enforcement file for the weeds and the Violation Notice went out this past xveek and the owner has until May 17th to resolve the violation at ~vhich rime if he is not in compliance, the City xvill have the property mowed. I assure you the City is in the process of bringing this property into compliance and xve share the same concerns as the neighborhood. Please let me know if there other issues xvhich you are concerned about or if in the next fcxv xveeks you do not see any progress. Jesse M. The gutters have fallen off or hanging ready to fall off, the roof is in terrible shape, a blue tarp has blown apart and is hanging, the front yard grass is a foot tall and has not yet been mowed this year, and most amazing of all the back yard has not been mowed since last summer (July, I think), and there is a rested out kids swing set that hasn't been used in years.. Since I am the president of the Property Owners Association, several neighbors including the Woodland Country Club, has asked me to contact you two to see if there is if this situation can be corrected. I am told that the Country Club is negatively impacted because potential memberships are turned off because of the property. Property values, in general, are negatively impacted also. The grass in the back yard is a breeding place and cover for rabbits, snakes and other varmints. 5/12/2004 Page 2 of 2 Perhaps you are currently trying to deal with the matter. On July 9, 2004, as provided by Indiana Code 36-7-9-5(b)(6), Mr. Glasser requested a public hearing relative to the Unsafe Building Order dated July 1, 2004. The hearing will be held at 10:00 am on August 4, 2004 in Council Chambers, City Hall, One Civic Square, Second Floor, Carmel, Indiana The hearing shall be held before the Carmel Board of Public Works and Safety. You, having interest in the above property, are entitled to appear at the hearing with or without legal counsel, present evidence, cross-examine opposing witnesses, and present arguments. At the conclusion of this hearing, the Board may affirm, modify, or rescind the Order (enclosed) of the Department of Community Services. If the Board determines that this Order is appropriate and that, without just cause, there has been a willful failure to comply with this Order, a fine in an amount not to exceed $5,000 may be assessed. If you or your representative do not appear, the matter will be determined in your absence and a fine could be imposed.
