ADJOURNMENT CITY OF CARMEL COMMON COUNCIL MEETING MINUTES MONDAY, JUNE 7, 2004 -- 7:00 P.M. COUNCIL CHAMBERS / CITY HALL / ONE CMC SQUARE MEMBERS PRESENT: Council President Ron Carter; Council Members Rick Sharp, Kevin Kirby, Brian Mayo, Joe Griffiths, Fred Glaser and Mark Rattermann; Clerk-Treasurer Diana Corclray and Deputy Clerk-Treasurer Carrie Gallagher were also present. Mayor James Brainard was absent. Council President Carter called the meeting to order at 7:07 p.m. Pastor Wardwell pronounced the Invocation. Council President Carter led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: There were none. APPROVAL OF MINUTES: Councilor Sharp moved to approve the Minutes of the May 17, 2004 Regular Meeting. Councilor IGrby seconded. Councilor Griffiths pointed out a scrivener's error on page two. The Minutes were approved 6-0. Councilor Mayo was not yet present at the meeting. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL: There were none. COUNCIL, 1VIAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: Clerk-Treasurer Diana Cordray and Councilor Kirby welcomed the opening of the Farmer's Market. ACTION ON 1VIAYORAL VETOES: There were none. CLAIMS: Councilor Sharp moved to approve claims in the amount of $2,216,285.89 and $760,993.97. Rattermann seconded. CLaims were approved 6-0. Councilor Councilor Mqo entered the meeting at 7: ! 6p.m. COMMITTEE REPORTS: Council President Carter reported that the Finance, Administration and Rules Committee met on June 3, 2004 and provided a unanimous, favorable recommendation to Council for the passage of Ordinance Nos. D-1664- 04 and D-1701-04. The next regular meeting of the Finance. Administration and Rules Committee is scheduled for June 21, 2004 at 5:00 p.m. in the Caucus Room but may be cancelled for lack of an agenda. Councilor Rattermann reported that the Land Use, Annexation and Economic Development Committee met on May 27, 2004, at which time the Committee continued discussion on the mining issue. The Committee also provided a unanimous, favorable recommendation to Council for the passage of Ordinance No. Z-448-04. The next regular meeting of the Committee is scheduled for June 10, 2004 at 5:30 p.m. in Council Chambers. Councilor Sharp stated that the Parks, Recreation and Arts Committee has not met. The next regular meeting of the Committee is scheduled for June 8, 2004, at 5:00p. m. in the Caucus Room. The Committee will continue to meet at its regular time of 3:00 p.m. at all future meetings. Councilor IGrby stated that the Utilities, Transportation and Public Safety. Committee has not met. The next regular meeting of the Committee is scheduled for June 14, 2004 at 5:00 p.m. in the Caucus Room. OLD BUSINESS: Council President Carter announced the Third Reading of Ordinance No. D-1664-04; An Ordinance of the Common Council of the City of Carmel, Indiana, Adopting and Adding Chapter 1, Section 1-16 of the Carmel City Code (Second Class City Status). Council President Carter presented this matter to Council. There was extensive Council discussion. Clerk-Treasurer Diana Cordray commented regarding Council concerns as to the effects of the potential Second Class City adoption, as well as the position of Clerk-Treasurer. Discussion continued by Councilors Griffiths, Kirby and Sharp. Council President Carter then passed the gavel to Councilor Mayo and asked that Council table this matter based on the serious concerns that remained. Councilor Glaser called for the question. Councilor IGrby stated that the motion to table died for lack of a second. Ordinance No. D-1664-04 was DEFEATED by a vote of 2-5. Councilors Sharp, IGrby, Mayo, Griffiths and Glaser voted in opposition. Council President Carter announced the Second Reading of Ordinance No. D-1701-04; An Ordinance of the Common Council of the City of Carmel, Indiana, Approving Application for Community Revitalization Enhancement District. Councilor Sharp requested that this matter be withdrawn as it is no longer viable due to the defeat of Ordinance No. D-1664-04. Therefore, Ordinance No. D-1701-04 was WITHDRAWN. ~X~,ouncil President Carter announced the First Reading of Ordinance No. Z-448-04; An Ordinance of the ;ommon Council of the City of Carmel, Indiana, Establishing the Brownstone Homes at Guilford Reserve 'lanned Unit Development District. Councilor Sharp presented this matter to Council, reiterating the unanimous recommendation for its approval by the Land Use Committee. Ordinance No. Z-448-04 was APPROVED 7-0.* PUBLIC HEARINGS: Council President Carter announced the First Reading of Ordinance No. Z-445-04; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending the Requirement that Residences on Lots Abutting Thoroughfares Derive Vehicular Access By Means of Alleys or Frontage Places. Councilor Mayo moved to introduce this item into business. Councilor Rattermann seconded. Michael Hollibaugh, Director of the Department of Community Services, presented this matter to Council. Council President Carter opened the matter for Public Hearing at 7:44:00 p.m. Seeing no one who wished to speak, Council President Carter closed the Public Hearing at 7:44:30 p.m. There was Council discussion. Council President Carter referred Ordinance .No. Z-445-04 to the Land Use, Annexation and Economic Development Committee for further review and consideration. Council President Carter announced the First Reading of Ordinance No. Z-449-04; An Ordinance of the Common Council of the City of Carmel, Indiana, Rezoning District Classification (Multiple Properties Along Main Street from the OM/MF: Old Meridian/Multi Family, OM/SFA: Old Meridian/Single Family Attached, OM/O: Old Meridian/Office and OM/SU: Old Meridian/Special Use District Classifications to the OM/MU: Old Meridian/M/xed Use District Classification). Councilor Mayo moved to introduce this item into business. Councilor Kirby seconded. Councilor Rattermann presented this matter to Council. There was Council discussion. Council President Carter then opened the matter for Public Hearing at 7:52:00 p.m. Seeing no one who wished to speak, Council President Carter closed the Public Hearing at 7:53:00 p.m. Brief Council discussion continued. Council President Carter referred Ordinance No. Z-449-04 to the Land Use, Annexation and Economic Development Cormmttee for further review and consideration. NEW BUSINESS: There was none. *Coundl returned to Ordinance No. Z448-04 at the conclusion of all other business mith Coundlor Kt?by moving, to reconsider Ordinance No. Z448-04. Coundlor Sharp seconded the motion to reconsider. The motion mas approved 7-0. Coundlor Shasv then moved to amend as read aloud. Coundlor Kz'rby seconded the moxion to amend, ~vhich mas approved by a vote of 7-0. Ordinance No. Z448-04 ,'tS ~ENDED, [VMS ~IPPROVED 7-0. OTHER BUSINESS: There was none.
