MINUTES
MONDAY, NOVEMBER 15, 2004 - 7:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James grainard, Council Members Rick Sharp, Kevin Kirby, Brian Mayo, Ron Carter, Joe
Griffiths, Fred Glaser, Mark Rattermann, Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer
Lois Fine.
Mayor Brainard called the meeting to order at 7:02 p.m.
Pastor Greg Garvey from Carmel United Methodist Church pronounced the Invocation.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
Councilor Rattermann made a motion to move item 10. a. to the beginning of the agenda. Councilor
IZdrby seconded. Council President Carter called for the question. The motion to move item 10. a. to
the beginning of the agenda was approved 7-0. Councilor Kirby made a motion to table item 10. a.
for an undetermined amount of time. Councilor Glaser seconded. Council President Carter called
for the question. Councilor Sharp objected to Council President Carter's call for the question. Mayor
Brainard re-entered the Chamber. Mayor Brainard addressed Council to explain his rationale to table
Ordinance No. C-263. Council President Carter called for the question. The motion to table
Ordinance No. C-263 was approved 7-0. Council President Carter announced that a date will be set
later this evening for Ordinance C-263 to come back to Council.
APPROVAL OF MINUTES
Councilor Griffiths made a motion to approve the Minutes of the October 24, 2004 Executive
Session meeting. Councilor Mayo seconded. The Minutes were approved 7-0.

meeting. Councilor Mayo seconded. The Minutes were approved 7-0.

COUNCIL, MAYORAL AND CI.ERK-TREASURER COMMENTS/OBSERVATIONS:
Mayor Brainard and Councilor Kirby addressed issues regarding the current annexations. Council
President Carter passed the gavel to Councilor Kirby at 8:00 p.m. to discuss the current annexations.
Council President Carter reclaimed the gavel at 8:09 p.m.
CLAIMS:
Councilor Mayo moved to approve the claims in the amount of $1,020,662.41. Councilor Griffiths
seconded. Council President Carter called for the question. Claims were approved 7-0.
COMMITTEE REPORTS:
Council President Carter reported that the Finance, Administration and Rules Comrmttee met this
evening and discussed Ordinance No. D-1724-04 with a no favorable recommendation to Council. A
request was made that the City Attorney be present at all Regular, Special and Executive Council
meetings. The corrLtmttee also requested that a representative from the City Attorney's office
be present at cormmttee meetings when their presence is requested in writing in advance.
Councilor Rattermann reported that the Land Use, Annexation and Econotmc Development
Committee has not met. The next meeting will be November 18, 2004 at 5:30 p.m. to discuss
Ordinance No. Z-444-04.
Councilor Kirby reported that the Utilities, Transportation and Public Safety. comrmttee met on
Monday, November 8, 2004 and discussed Ordinance No. D-1731-04. This will remain in committee
for further reviexv. The comn~ttee also discussed a Merit System Ordinance that will be presented to
Council at a later date.
Councilor Sharp reported that the Parks, Recreation and Arts Comrmtree has not met. They are
scheduled to meet on December 14, 2004 to discuss the Park Impact Fees.

Council President Carter announced the Third Reading of Ordinance No. C-264; An Ordinance of
the Common Council of the City of Carmel, Indiana, Annexing Certain Territory to the City of
Carmel, Indiana, Placing the Same Within the Corporate Boundaries Thereof and Making the Same A
Part of the City of Carmel (Home Place). There was brief Council discussion. Council President
Carter called for the question. Ordinance No. C-264 was approved 7-0.
Council President Carter called for a recess at 8:20 p.m. and reconvened the meeting at 8:24 p.m.
PUBLIC HEARINGS
Council President Carter announced the First Reading of Ordinance No. Z-462-04; An Ordinance
of the Common Council of the City of Carmel, Indiana, Establishing the Monon& Main Planned
Unit Development District. Councilor Rattermann moved to introduce this item into business.
Councilor Glaser seconded. Council President Carter referred to Jim Shinaver, Attorney with Nelson
& Frankenberger, 3105 East 98th Street/Suite 170, Indianapolis, Indiana 46280, for a presentation to
Council. Mr. Shinaver referred to David Leazenby of Bucldngham Companies, 333 N. Pennsylvania
Street/l0th Floor, Indianapolis, Indiana 46204, for a more in depth presentation. Also in attendance
was Tadd Miller, Kosene and Kosene, 4495 Saguaro Trail, Indianapolis, Indiana 46268, and Gary
Murray, Mid-States Engineering, LLC, 9615 E. 146th Street/Suite 6, Noblesville, Indiana 46060.
Council President Carter opened the Public Hearing at 8:35 p.m. Seeing no one who wished to speak,
Council President Carter closed the Public HearMg at 8:37 p.m. There was brief Council discussion.
Councilor Kirby made a motion to suspend the rules and vote this evening. Councilor Mayo
seconded. There was brief Council discussion. Councilors Kirby and Mayo withdrew their motions
to suspend the rules and vote this evening. Council President Carter referred Ordinance No.
Z-462-04 to the Land Use, Annexation and Economic Development Comrmttee for further review
and consideration.
NEW BUSINESS
Council President Carter announced the First Roadin? of Ordinance No. D-1729-04: An
Ordinance of the Common Council of the City of Carmel, Indiana, Fixing Salaries of Elected Officials
of the City of Carmel, Indiana for the Year 2005. Councilor Kirby moved to introduce this item into
business. Councilor Griffiths seconded. There was no Council discussion. Council President Carter
referred Ordinance No. D-1729-04 to the Finance, Administration and Rules Committee for further
review and consideration.

Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 6, Article 4,

and referred to Brace Breeden, President of the Carmel School Board. Also in attendance was Joe
Miller, and Steve Dillon, Director of Student Services. There was brief Council discussion. Councilor
Sharp made a motion to suspend the roles and vote this evening. Councilor Rattermann seconded.
The motion to suspend the rules and vote this evening passed 7-0. Council President Carter called for
the question. Ordinance No. D-1732-04 was approved 6-1 (Councilor Sharp opposed).
Council President Carter announced the First Reading of Ordinance No. D-1733-04; An
Ordinance of the Common Council of the City of Carmel, Indiana, Approving and Adopting
Interlocal Agreement (Maintenance of streets affected by Ordinance C-260). Councilor Rattermann
moved to introduce this item into business. Councilor Mayo seconded. Councilor Kirby presented
this item to Council. Councilor Kirby made a motion to suspend the rules and vote this evening.
Councilor Sharp seconded. The motion to suspend the rules and vote this evening passed 7-0.
Council President Carter called for the question. Ordinance No. D-1733-04was approved 7-0.
ADD-ON
Councilor IGrby moved to suspend the rules and add-on to tonight's agenda, Resolution No. CC-ll-
15-04-01; A Resolution of the Common Council of the City of Carmel, Indiana, Regarding Blanket
Consent to Town of Zionsville, Indiana, For Annexation of Property Within Three Miles of Carmel's
Corporate Boundaries; Sponsor: Councilor Carter. Councilor Glaser seconded. The motion to
suspend the roles and add-on Resolution No. CC-11-15-04-04 passed 7-0. Councilor Kirby moved to
introduce this item into business. Councilor Glaser seconded. There was brief Council discussion.
Council President Carter called for the question. Resolution No. CC-11-15~04-01 was approved 7-0.
OTHER BUSINESS
Council President Carter asked the Clerk-Treasurer's office to Notice a Special Meeting of the
Common Council for Monday, November 29, 2004 at 5:30 p.m. to discuss Ordinance No. C-263.
Clerk-Treasurer Diana Cordray asked for Council's thoughts on the first meeting in January to be held
on January 10, 2005 at 7:30 p.m. Council members were all in agreement. Mrs. Curdray also asked
Council to consider holding the vote on the 2005 Council President and to discuss the cornrmttee
schedules at the last Council meeting December 20, 2004. Council President Carter asked the Clerk-
Treasurer to add the election of Council President to the December 20, 2004 agenda. Council
members were all in agreement.
