■ CUSTOM LIVING ■ design - plan - build ■ Shrewsbury [New Build] 401 Emerson Rd Carmel, IN 46032 Saving Your Memories, Remodeling Your Future. CUSTOM JVING: design-plan-build■ Project Introduction: Custom Living proposes to build a two story, residential, owner-occupied home for Ronda Shrewsbury in the Johnson Addition neighborhood. The architecture and exterior finishes of the home are designed to visually tie the neighborhood to the adjacent Downtown Carmel district. Statement of Variance Request: Custom Living is requesting two separate variances for a new 2-story residence. One, for a 51 lot coverage, driven mainly by a paver patio and pool. Second, to allow setbacks less than the UDO required 35'. Statement of Support The proposed house will be set 36' from the north curb, 33.5' from the east curb, 31' from the south property line, and 25' from the west curb, allowing good sightlines around the house for walkers and motorists. Our original design had the 3 car garage facing west and conformed to the original plat build line setbacks of 25' off the property line of the Johnson Addition. With using the current UDO required standards from property lines, the existing structure would not conform. At the recommendation of the Historical Preservation Committee we changed the garage facing to the north for the benefit of the neighors views. This change was supported by Ronda (Property Owner), for the support of the commission. It does reduce the setback on that side to be 25' from the curb vs. the property line; however, it does provide a better aesthetic to the neighbors on the west and south sides of the home. The additional pool and paver patio is the main reason we are requiring a permeability variance of 51%. We have worked with Carmel Engineering Department, which is in support of our project when approved and when we contribute to the retention fund. The structure itself would conform to the standards, but the landscaping elements will bring an added elegance to the home as well as benefit of family and neighborhood friends. The improvement will positively affect the overall architectural aesthetic of 4th Street as well as within the neighborhood as a whole. In October I purchased 401 Emerson Rd. and am planning to begin construction on a new home there this spring. As a long-time admirer of Carmel (and former resident and downtown Carmel business owner), I fell in love with this neighborhood's charm and warm feel. I also love the proximity to downtown Carmel, and look forward to many years of walking to the farmers market, locally owned restaurants, and shops. My new house has been designed to bridge the gap between the old-Carmel charm of the Johnson Addition neighborhood and the modern feel of the Downtown Carmel Design District. Through the use of windows, porches, and low landscape walls in the new house, I want to incorporate the transparency, approachability, and neighborhood friendliness that I believe makes this part of Carmel such a wonderful place to live. As we move through the permit process, I am asking Carmel for two variances. The first is to build my house with less than the required 35' setback, which is a new standard for home setbacks in the neighborhood. The original plat for the neighborhood included a 25' setback. My house will be at least 25' from the curb on all sides. The second variance relates to the percentage of permeable/non-permeable surfaces on the site. The house is designed to conform to Carmel's permeability requirements. I would like to add a pool on the south side of the home with a paver patio and to do so I am required to submit for a variance. Mark will process the payment of $5,000 in the near future. 8. Old Business a. Willdnson-Hull House update: Mark reported that negotiations were ongoing regarding donation of the house from Epcon Communities to Indiana Landmarks. Wording regarding landscaping maintenance on the W-H House property as improvements begin on the Courtyards of Carmel project was still being ironed out. Mark sent the signed donation agreement back to Epcon on January 10 but had not yet heard back. 9. New Business a. Demolition Delay Review-401 Emerson —Tom Lazzara of Custom Living presented on behalf of the owner, for the request to demolish the existing structure at 401 Emerson Road, in the eligible Johnson Addition district. Lazzara and his design team presented their proposal for a new house on the site, which at 2 stories is larger than most single -story homes in the neighborhood. Commissioners expressed some concerns related to height, massing and materials. Mark provided a Staff Report, which recommended approval of the demolition request, but asked for a further meeting for input to design changes, particularly regarding orientation on the site. Bill Sanders made the motion to approve the staff recommendation; Rosemary Dunkle seconded. The motion passed 4-0. 10. Other Business None. 11. Announcements None. 12. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The proposed house is set back 25' or more from the curb on all sides, providing ample sight lines, which is greater than the setbacks of the properties east of 4th Street and north of Emerson on 4th Street. The east setback compliments the setbacks of existing houses on the north on 4th Street. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: In the proposed new structure we are adding sidewalks around street perimeter for neighborhood use. We are positioning the structure 8' farther north than the existing to provide more privacy for the south neighbor. The proposed new home will provide clearer site lines than the neighbors east of 4th street. The proposed also will mirror similar setbacks on the east elevation to the homes north of Emerson on 4th street. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: The UDO requirement of 35' setback is intended to be for a front yard. As this site is classified as having three front yards, the use of a 35' setback on all three sides from the property line makes for an unreasonably small building site. The existing home would not conform to this standard.
