Although platting of the real estate, at this time is not required, we expended a significant amount of time and money in order to present our plans for future development of the property. In doing so, we were complying with the requests of your staff to have a plan on file, and hopefully improving the approval process as we move forward. By way of background, early into our presentation, an issue was raised about existing access to the site previously occupied by Altum Gardens. I was surprised, since this issue was addressed during a previous petition we made to extend Mayflower Park Drive. I explained as I had in the past, that it was premature for us to address this matter without the benefit of knowing exactly what type of development will occur at this site. With little discussion to follow on the issue at hand, our petition was sent to the subdivision review committee. As your meeting was about to conclude, Rick Sharp voiced his concern, again, that our company had not complied with the request of the Plan Commission regarding access to the Altum property. Not having the opportunity to respond at the time, I feel it is important to clarify this matter before my next submission. I have attached a copy of the meeting minutes from August 19, 1997. Highlighted are the relevant points which state our agreement with regard to access to the Altum site. In ;hort, as a matter of compromise, we agreed to create an easement over 99th Street for access to the Altum site. This would ensure access to the Altum site from an alternative location other than Michigan Road. In fact, this easement will be created as part of the Primary Plat. Furthermore, it was stated that access to the Altum parcel would be better addressed during our petition for ADLS approval. In any event, I want to be clear that our company has acted in accordance with our agreement with the Plan Commission. The current entry will be moved to the south; the boulevard effect will be eliminated. The landscaping will match existing, except that curbing will be installed along the eastern boundary of the parking lot. The boulevard entry way will also be curbed. The lighting standards remain the same, however, the greenery in the parking area exceeds the ordinance requirement of 5% of the total parking space. Members of the public were invited to speak in favor or opposition to the proposed project; none appeared and the public hearing was closed. Mark Monroe reported that the Department is recommending approval as submitted. All Technical Advisory Committee concerns have been addressed. Paul Spranger asked for assurance from the petitioner that he would be receptive to working with a landscaping plan as it pertains to his property. The petitioner expressed a willingness to comply. The rules were suspended by unanimous vote. Rick Sharp moved for the approval of Docket No. 35-97 D.P. for Matthews, Click, Revel and Henry,MOTION APPROVED 14-0. 3h. Commission to consider Docket No. 57-97 D.P., a Development Plan application for Browning Investments. The petitioner seeks approval to construct 99th Street within the former Mayflower Complex. The site is located on the northwest corner of 96`s Street and Michigan Road. The site is zoned I- 1/Industrial and is located within the U.S. 421 Overlay Zone. Filed by Jim Nelson of Nelson and Frankenberger. Jim Nelson, 3663 Brumley Way, Carmel appeared before the Commission representing the applicant, Browning Investments, Inc. Also present was Jaime Browning. The subject parcel lies west of U.S. 421 between 96th Street on the south and 106th Street on the north, and is the site of the former Mayflower corporate headquarters. Negotiations are under way with Browning Investments for the acquisition of the building and Iand by RCI. Approval is being sought to construct a roadway, 400 feet of which are within the U.S. 421 Overlay Zone. The Hamilton County Highway Department has jurisdiction over roadways in this area. The design and specifications for the private roadway were presented to the County Commissioners and approved on August 11th. The petitioner's ability to proceed with the approval and construction of the roadway is most important in the on-going negotiations with RCI, and the petitioner is requesting suspension of the rules in order for a vote. Pc1997aug k OCT-28-1997 15: 12 FROM CARMEL CLAY DOCD IU 4 It has been suggested that a curb cut immediately north of the Mayflower Corporate Headquarters be closed. The curb cut does currently exist, and the petitioner believes that he cannot raise this as an issue at this point in the negotiations with RCI. To the south of the corporate headquarters is an 8 acre parcel of real estate owned by Browning today and currently leased out for another two years. Another suggestion is that access to the 8 acre parcel be gained from the new roadway and not by way of the two curb cuts which now serve the property from U.S. 421. The Altura parcel will have a different type of use in the future and it may or may not be consistent with RCI's use of the corporate headquarters. It is felt that a better time to address access to the Altura parcel from U.S. 421 is at the time the petitioner returns to the Commission for development plan approval and ADLS approval. Members of the public were invited to speak in favor or opposition to the proposed project; none appeared and the public hearing was closed. Mark Monroe reported that the Department is recommending approval; however complete closure of the northern most curb cut for the Mayflower Park is also recommended. The Department believes that the new road, 99th Street, would facilitate traffic within the complex without the need for the additional curb cut. In addition, the Department is recommending that when the property to the south develops, it will gain access from the new street, 99th Street, rather than gaining access from Michigan Road. There was further discussion and comments by members of the Commission regarding current curb cuts and proposed roadway improvements by INDOT. Jaime Browning appeared before the Commission and commented that for them to continue with this project, they needed to build "99`h Street" At the moment,there is no good answer for future development plans on this parcel—even within the next 30 days. Tim Nelson offered to have the petitioner commit in writing to create an easement over 99th Street or"Mayflower Park Drive." The easement would be used or capable of being used for access to the Altum piece, so that in the future,when the petitioner returns to the Plan Commission with the Altum development plan, you would know that one of the options for access to that parcel of land is from 99`h Street. The following comments are based on our findings pursuant to our review of the existing site plans and secondary plat covenants. Pursuant to our discussion at the Cannel TAC meeting,Steve Baitz, Drainage Specialist and I inspected the condition of the storm sewers at the Mayflower site on 9/18/97. The purpose of this inspection was to assess the current condition of the storm sewers. Generally,the storm sewers,inlets and manhole structures appeared to be in fair to good condition. Some of the structures are in need of some repair. The primary repair proposed would be to seal the structures to prevent soil from infiltrating around the brick. Some of the bricks around the top rings arc broken. During our inspection,it was also verified that one of the storm lines runs under the large building. The plans show a junction of three pipes under the building, however, a manhole was not found. This same 27" storm line also runs under extensive landscaping after passing out from under the building. Future maintenance of this main truck line at these locations would be very difficult. The County Surveyor and I reviewed the proposed covenants regarding the maintenance of the drainage system. Based upon this review,it appears that future owners will have an adequate method in which to address any drainage concerns, The wording of the covenants also specify'that the capacity of the drainage system(i.e., storm sewers, detention areas etc.)will be maintained in the future. It might also be noted that as new projects are proposed within Mayflower Park,this office will review the plans in conjunction with the Outlet Request Permits(for the northern portion)and TAC reviews. Per your letter dated September 9, 1997 and our TAC meeting today, we have addressed your comments regarding the plats for the subject project as follows: Applications: 1. The list of adjoining landowners will be submitted for public notice by Jim Nelson. Primary Plat: 1. The roads within the park will be private streets. 2. It is the developers plan to extended 99th Street at approximately a 90 degree angle across the pipeline easements as required by Panhandle Eastern Pipeline to the west property line through Boone County to 106th Street. 3. The existing decell lane and taper appear to meet the Subdivision Regulations. However, additional survey information will need to be obtained for the accell taper and passing blister lane to determine whether they are in conformance with the Regulations. Should improvements be necessary, the entrance will be brought to the standards set forth in the Regulations. 4. Block 4 has been revised to meet the 3-acre minimum lot size. 5. A traffic impact study has been completed for the development. A copy of the study will be sent to you by the developer. 7. Per Section 8.9 of the Subdivision Regulations, sidewalks are to be installed on both sides of the street in front of houses. Since the nature of this subdivision is commercial/industrial, we are not proposing sidewalks along the streets 8. The setbacks have been revised per your letter. 9. The Overlay Zone has been identified on both the Primary and Secondary Plats. 10. Mr. Meyerrose's address and telephone number are now shown on both the Primary and Secondary Plats. Secondary Conditional Plat: 1. A reference to the deeds indicating the source of title for the property has been added to the Secondary Plat. 2. The location and materials of monuments and markers has been added. 3. The Certificate of Approval has been corrected per your letter. 4. No additional construction is proposed at this time. Construction plans will be generated as part of the Secondary Plat submittal for development of individual parcels within the Blocks as shown on the Secondary Conditional Plat. 5. The Carmel Fire Department has reviewed the plats and has no requirements to be met at this time. A copy of their Letter of Approval is enclosed. 6. Copies of proposed signage and entrance landscaping plans are enclosed. 7. Copies of correspondence from the Technical Advisory Committee received to date are enclosed.
