I am requesting that proposed Ordinances D-1762-05, D-1763-05,D-1764-05 and D-1765-05 be added to the
council agenda for our meeting of the 18th,
These items are very important to the health, safety and welfare c~f the residents of the city. Holding these
items uat!l our June meeting will create an unnecessary delay and a potential hardship. I kno~v your office
has copies of these ordinances and I appreciate you assistance.

MINUTES
MONDAY, JULY 18, 2005 - 6:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEMBERS PRESENT:
Council President Kevin Kirby, Council Members Rick Sharp, Brian Mayo, Joe Griffiths, Fred Glaser,
Ron Carter, Mark Rattermann, Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Lois Fine.
Mayor James Brainard was absent.
Pastor Bert Kite, St. Marks Uflited Methodist Church, pronounced the Invocation. '
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Mayo made a motion to approve the Minutes of the June 20, 2005 Regular Meeting. Councilor
Glaser seconded. Council Presiden£ Kirby called for the question. The Minutes were approved 7-0.
Councilor Mayo made a motion to approve the Minutes of the June 28, 2005 Special Meeting. Councilor
Carter seconded. Council President Kirby called for the question. The Minutes were approved 7-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
Luci Snyder, 6 Hensel Court, Carmel, 1N 46032, Secretary/Treasurer for the Carmel Economic
Development Commission. Mrs. Snyder delivered to Council the results from their meeting on July 14,
2005. By an unanimous decision the Economic Development Commission approved the $30 million
bond issue for the building of the parking structure in City Center. She also informed Council that the
bonds will be purchased by Pedcor and the citizens of Carmel will not be responsible for the pay back of
the bonds.
COUNCIL~ MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Clerk-Treasurer, Diana Cordray, made available to Council a financial summary of two major road
projects.
Council President Kirby addressed Council regarding the procedure that needs to be followed for
add-on's. Council President Kirby stated that it is the consensus that any item placed on the agenda for a
first reading be then placed back on each agenda as second, third, fourth, fifth, whatever it may be. Once
an item is introduced on the agenda, it stays on the agenda. Councilor Sharp read the correct procedure
from section 3-17 (Council Committees) 2(f)(g) from the City Code.
Councilor Rattermann reported on the City's cash balances.
Council President Kirby discussed the budget hearings and requested that a special budget meeting be
held to review revenues. Council President Kirby will check with the Mayor on a schedule.
ACTION ON MAYORAL VETOES:
There were none.
CLAIMS:
Councilor Mayo made a motion to approve the claims in the amount of $2,217,953.00. Councilor
Griffiths seconded. Council President Kirby called for the question. Claims were approved 7-0.
COMMITTEE REPORTS:
Councilor Glaser reported that the Finance, Administration and Rules Committee had not met.
Councilor Sharp reported that the Land Use, Annexation and Economic Development Committee met on
Thursday, July 14, 2005. The comanittee discussed several items that will be presented to Council
tonight. A presentation was made by Jeff Burt, Hamilton County Alliance, who updated the committee
on the Alliance's efforts on the first half of the year.
Councilor Carter reported that the Parks, Recreation and Arts Committee met on Friday, July 1, 2005 and
discussed the Parks budget. Councilor Carter requested that the next meeting (August 9, 2005) be
cancelled.
Councilor Mayo reported that the Utilities, Transportation and Public Safety Committee met on Tuesday,
July 12, 2005 and discussed the sewer ordinances that will be discussed tonight.

Second Reading of Ordinance D-1754-05; An Ordinance of the Common Council of the City of Carmel,
Indiana, Concerning the Construction of Additions and Improvements to the Sewage Works of the City of
Carmel, Indiana; Authorizing the Issuance of Revenue Bonds for Such Purpose; Addressing Other
Matters Connected Therewith, and Repealing Ordinances Inconsistent Herewith ($11,000,000.00 Bond).
Councilor Mayo informed Council that this ordinance was sent to the full Council from the Utilities,
T~ansportation and Public Safety committee with a favorable recommendation vote of 3-0. There was
brief Council discussion. Council President Kirby called for the question. Ordinance D-1754-05 was
adopted 7-0.

PUBLIC HEARINGS
Second Reading of Ordinance D-1755-05; An Ordinance of the Common Council of the City of Carmel,
Indiana Amending Chapter 9, Article 3, Division V, Section 9-171 of the Carmel City Code (Sewer
Rate). Council President Kirby opened the Public Hearing at 6:17 p.m. Seeing no one who wished to
speak, Council President Kirby closed the Public Hearing at 6:17:30 p.m. There was brief C~uncil
discussion. Council President Kirby called for the question. Ordinance D-1755-05 was adopted 7-0.
NEW BUSINESS
Council President Kirby announced the First Reading of Ordinance D-1761-05; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Carmel City Code Chapter 8, Article 6,
Section 8-58(a) Regarding Vehicle Weight Limitations (Carey Road). Councilor Griffiths moved to
introduce this item into business. Councilor Mayo seconded. Councilor Griffiths presented this item to
Council. There was brief Council discussion. Council President Kirby referred Ordinance D-1761-05 to
the Utilities, Transportation and Public Safety Committee for further review and consideration.
Council President Kirby announced Resolution CC-07-18-05-01.; A Resolution of the Common Council

President Kirby called for the question. Resolution CC-07-18-05-01 was adopted 7-0.
Councilor Sharp made a motion to add-on Ordinance D-1762-05, Ordinance D-1763-05, Ordinance
D-1764-05, Ordinance D-1765-05, Ordinance D-1759-05, Ordinance Z-478-05 and Ordinance Z-479-05.
Councilor Carter seconded. Council President Kirby called for the question. The motion to add-on
Ordinance D-1762-05, Ordinance D-1763-05, Ordinance D-1764-05, Ordinm~ce D-1765-05, Ordinance
D-1759-05, Ordinance Z-478-05 and Ordinance Z-479-05 was approved 7-0.

Ordinance D-1759-05 was adopted 6-1 (Councilor Rattermann opposed).
Second Reading of Ordinance Z-478-05; An Ordinance of the Common Council of the City of Carmel,

Council President Kirby called for the question. Ordinance Z-479-05 Failed 2-5 (Councilors Glaser and
Rattermann voted AYE), (Councilors Sharp, Mayo, Griffiths, Kirby and Carter voted NAY).
