THE CITY OF CARMEL, INDIANA AND SPRINGMILL PROPERTIES
This Agreement entered between the City of Carmel, Indiana
(hereinafter "Carmel") and Springmill Properties, an Indiana
partnership (hereinafter "Springmill") witness:
· WHEREAS, Carmel ~has duly adopted and enacted Ordinance S-41
(January 4, 1982) that provides~ in part for the reimbursement
f~om the "interceptor fund" by Car~el of private funds expended
to extend ,the trunk sewerage ~ystem and such ordinance further
provides the method of reimbursement (Section 7.02) and,
WHEREAS, Springmill desires to extend a portion of the trunk
sewerage system as follows:
Beginning a,t the sewage pump station which is·
located at the intersection of Meridian Street
and the proposed extension of 126th Street, the 6
inch force main follows the West side of Meridian
Street (approximately 35 feet West of ~he center-
line of Old U.S. 31 within its 50 foot half Right
of Way) Northeasterly for a distance of 2165 feet
to a manhole which is the Southerly terminus of a
12 inch diameter gravity sewer. The said gravity
sewer continues Northeasterly along the West side
of Meridian Street, under 131st'Street and con-
tinuing along the West side of Meridian Street
(about 24 feet West of the centerline of Old U.S.
31 within its 50 foot Half Right of Way) fora
distance of.2800 feet to the Southerly terminus
of the St. Vincent sewer, said point being
opposite the South property line .of the St.
Vincent property extended to Meridian Street.
WHEREAS, Springmill desires to receive refunding of
reimbursable monies expended pursuant to ordinance S-41
(January 4, 1982).
Now therefore, the parties agree as follows:

1. This written agreement entered prior to the commencement
of construction is entere~ by the parties pur'suant~ to Ordinance
S-41, Section 7~.02 (Januar~ 4', 1982).
2. Spr~ngmill shall advance thee sum ~o~ $179,709.24 ~o or on
to pay for the construction of the extension of

Vincent property extended to Mer~dia~ Street.
3. Carmel determines such ex~enditure to be necessary to
provide sewerage to adjacent real estate and to meet the require-
ments of Carmel.
4. Carmel and Springmill agree that springmill shall be
entitled to reimbursement of the sum of $179,709.24 from the
"interceptor fund" established by a~reage availability charges
assessed by the Ordinance (the present amount of $700.00 per
acre).
5. Carmel's obligation shall be to repay funds from those
deposited in the "interceptor fund" 9nly and Carmel does not
incur any liability for repayment other than to pay from funds
deposited in the "interceptor fund".
6. 'Payment from the "interceptor fund" Go Spri~gmill shall
be~in the amount agreed by the parties to this Agreement and
shall occur' quarterly. Payments'to .Springmill shall be prior to
any payments from the "interceptor fund" made to any 'other
persons ent~ing similar agreements subsequent to the date of
this Agreement (referenced in the Ordinance as payment on the
basis of first in, first out).

Mayor Reiman,
I have reviewed the documentation'submitted by Cripe
Engineering for reimbursement. I found everything to
be in order. I feel the proposal price on the actual
sewer is a very good one. Our office ran a cost estimate
on the sewer and lift and Central Engineering's proposal
is nine thousand dollars less than our estimate.

Gentlemen:
We are pleased to make the following quotation for the construction
of the offsite sanitary sewer to serve Spring Mill Properties.
1) We will install the gravity portion of the sewers.

All work is to be done in accordance with the plans prepared bY
Paul I. Cripe, Inc. entitled "Construction Plans for Off-site

clusive; dated 11-7-83, 11-25-83, 11-28-83 and revised 11-23-83.
This quotation includes the cost of the necessary insurance and bonds.
This quotation does not include the cost of moving any utilities
that may be encountered.

DFF-SITE SANITARY SEWER
1. Excavate, furnish and install approx. 2765'-12" vit. pipe and
backfill for the off-site sanitary sewer. Granular back~ill under
all pavement..

fill for future sanitary sewer connection.
FDRCE MAIN
1. Excavate, furnish and install abprox. 21~D'-6" DI class II pipe
and backfill for the sanitary force main. Granular backfill under
all paved areas.
2. Furnish end install required fittings end concrete thrust blocks.
