HomeMy WebLinkAboutImprovement/Cost Sharing 96th/Keystone/LakeshoreAGREEMENT FOR TRANSPORTATION P~°ROVF~I~NTS AND COST SHARING PROJECT: URBAN ROUTE B-209 - 96th Street (M&rion - Hamilton~ Couaty Line) from approximately 600 feet West of Keystone Avenue (S.R. 431) to Lakeshore [~rive, (2800 feet East of Keystgne Ave.) hereinafter re£erred to as PROJECT. ~PROV~Yf: , Spe¢i£icslly described as Land Acquisition Phase for the PROJECT, including I~nd Acquisition Services and the acquisition of Land and' Improvements for the pROJECT, hereinafter referred to as IMPROV~HNTS. THIS AGP~E~MENT, entered into this ~ ~" day of .~4~~- , 19~ . between the City of Indianapolis, Marion County, Indiana, acting by and through the Department of. Transportation (hereinafter referred to aa "I-DOT"); The City of Carmel, acting by and through the Board of Public Works (hereinafter referred to as "CARMEL"); and Hamilton County, acting by and through the Hamilton County Commissioners (hereinafter r~eferred to as "HAMILTON COUNTI"'), WITNESSETH THAT WHEREAS, 96th Street, running East and West, is the' Marion-Hamilton County Line and passes through the City o£ Carmel, Indiana, and is included in the Indianapolis Urban Area as an Urban Route ~B-209 and is a part of the O£ficisl Thoroughfare Plan for Marion County,. Indiana, and, as such, there is an interest by I-DOT, CARMEL and HAMILTON COUNTY to improve 96t~ Street and WH~EAS, I-DOT and CARMEL are interested in assisting HAMILTON COUNTY in initiating and carrying out IMPROVES for 9~th Street. NOW, TH~EFOP~E, IT IS AGRJ~ED BETWEEN THE PARTIES, to undertake and carry out the IMPROV~ENTS in consideration of the mutual covenants hereinafter con- t alned. page 1 of 5 pages HAMILTON COUNTY agrees: 1.1 Initiate and Administer Program Documents for Federal Funding Prepare Right-of-Way ?lsns Prepare Land Acquisitior~ Documents Provide Right-of-Way Services Acquire all necesss~y Land and Improvements All 5_n accordance with co, rent Federal Highway Administration (FHWA) requirements necessary for. receiving Federal Funds and subject to I-DOT, CARMEL, HAMILTON COUNTY, IDOH and FHWA approval. 1.2 Secure ~kll right-of-way required for construction of the PROJECT within the PROJECT Limits. 1.3 Provide the local share of funds required to match Federal Funds for the PROJECT as outlined on the attached "Responsibility and ~unding Table." Includes only that part of the IMPROV~qTS located in HAMILTON COUNTY, outside of CARMEL. Administer the su~muttal of claims for reimbursement of Land and Improvement costs to IDOH on behalf of I-DOT and Carmel. Includes the payment to I-IXTr and Carmel upon receipt of reimbursement from IDOH. CARMEL agrees: 2.1 Review and approve all Documents included in 1.1 above and .assist in securing IDOH and FHWA approvals necessary for se~curing Federal Funds for the PROJECT. 2.2 Assist in securing all right-of-way required for construction of the PROJECT within the City of CARMEL. 2.3 Provide the local share of funds required to match Federal Funds for the PROJECT as outlined on the attached '~esponsibility and Funding Table." Includes only that part of the IMPROV]~ENTS located in CARMEL. page 2 o£ 5 pages 3. I-DOT agrees: 3.1 Review and approve all Documents included in 1.1 above and assist in securing IDOH and FHWA approvals necessary for securing Federal Funds for the PROJECT. 5.2 Assist in securing right-of-way required for construction of the PROJECT within the City of Indianapolis, Marion County. 3.3 Provide the local share of funds required to match Federal Funds for the PROJECT as outlined on the attached '~esponsibility and Funding Table."
