RANSBURG and the TOWN OF CARMEL, Indiana: WHEREAS, Edwin M. Ransburg has constructed on property situ- ated in the Town of Carmel certain sewer and water utility improve- ments, and WHEREAS, these certain improvements constructed by Edwin M. Ransburg are connected to the system of sewer and water utilities of the Town of Carmel, and WHEREAS, the improvements constructed by Edwin M. Ransburg benefit the health, welfare and safety of residents of the Town of · Carmel, and WHEREAS, the Town of Carmel has departments charged specifi- cally with the responsibility of maintaining, for the health, wel- fare and safety of the residents of the Town of Carmel, the sewer and water utilities serving its residents; NOW, THEREFORE, and in consideration of all of the above, Edwin M. Ransburg grants to the Town of Carmel, Indiana, the right to enter that property commonly known as Twin Lakes Apartments Phase I and more specifically described as: Part of the Southwest Quarter of the Southwest Quarter of Section 25, Township 18 North, Range 3 East in Hamilton County, Indiana, more particularly described as follows: Beginning at a point South 90 degrees 00 minutes 00 seconds West (assumed bearing) 290.00 feet of the Southeast. corner of the Southwest Quarter of the Southwest Quarter of Section 25, Township 18 North, Range 3 East and on the South line thereof; thence North 01 degrees 06 minutes 00 seconds East parallel with the East line of said Quarter Quarter 653.99 feet; thence South 89 degrees 59 minutes 55 seconds West 638.50 feet; thence South 00 degrees 00 minutes 00 seconds 653.86 feet to the South line of said Quarter Quarter; thence South 90 degrees 00 minutes 00 seconds East on and along said South line 625.95 feet to the place of beginning, containing 9.49 acres, more or less. Subject to all legal easements and rights-of-way, including a strip of ground 40 feet wide along the South end of the above described ground to be reserved for dedication as 126th Street, for the purpose of maintaining, improving and repairing sewer and water lines and equipment. Said maintenance shall not include ,'building sewers" or water service lines running from the distribution mains to individual buildings and/or units. JUNEM.
