W I - N E S S.E I ~ WHEREAS, ~nrough tne cooperation of the CITY, tne STATE ano the Federal Hi'gnway Administration, ~ne following oroject in Carmel has been a3provedby the Federal Highway Administraeion, namely P~roject No: MG-O00C(96), 3noviding for ~ne improvemen~ of traffic signalization at various intersections in tne City of Carmel, ano WHEREAS, tne CITY de~ires to ~artici~ate in the orelim~nary engineering on this o~oject using Federal-aid funos allocated an~ made available ~o the STAT~, and WHERE~S, the STATE,is willing for the,CITY to participate in the~reliminary engineering on this ~roject, subject ~o aoDroval of ~ne Federal Highway Administration. qOW THEREFORE, in consideration of the mutual covenants, n~rein contained,' the ~arties heretomutually covenan~ ahd agree as fo'llows~ 1. The CITY'will co~31y, with ~ne applicable conditions set forth in (1). Title 23, U.S. Cod6, Highways, (2) ~ne regulations issued oursuan~ thereto, an~ (3) the policies ano procedures promulgated by tne STATE and Federal Hignway Administration relative to the ~roject. 2. The CITY at its discretion engage a competent ano oua.lified consultant to perform tne preliminary engineering for the CITY.
