HomeMy WebLinkAboutDepartment Report 02-28-221 of 9 CARMEL BOARD OF ZONING APPEALS | HEARING OFFICER MEETING DEPARTMENT REPORT MONDAY, FEBRUARY 28, 2022 (V) Newkirk Front Setback Variance. The applicant seeks the following development standards variance approval for a building addition: 1. Docket No. PZ-2022-00007 V UDO Section 2.06 Minimum 35-ft front yard building setback required, 34-ft requested. The site is located at 111 Bennett Rd. (Village of Mt. Carmel Subdivision Lot 49) and is zoned S2/Residence. Filed by Jeffery & Sandra Newkirk, owners. General Info & Analysis: The Petitioner seeks approval for a 24’ x 40’ building addition to the front of the house, as well as driveway modifications. The lot has a platted 50-ft front yard building setback, and the zoning ordinance allows for a minimum 35-ft front yard building setback. The variance request is to encroach 1-ft into the 35-ft setback, so that a 34-ft setback from the front lot line (which is also the street right of way) is achieved. Please see the Petitioner’s info packet for more detail on the variance request. Surrounding existing houses in the neighborhood have 45- to 50-ft front yard building setbacks. Building permit B-2021-01650 is currently in review, and that is how the need for the variance was identified. Also, the new (2nd) driveway entrance off the street will need to be approved by the Board of Public Works. The Petitioner should have a letter requesting the new entrance, as well an exhibit, submitted to Caleb Warner (cwarner@carmel.in.gov) in the Carmel Engineering Dept. office. Once he has received it, he will place it on the next available BPW agenda for the Carmel Board of Public Works and Safety. The Planning Dept. supports the variance request. Findings of Fact: Please refer to the Petitioner’s Findings of Facts included in their info packet. Recommendation: The Dept. of Community Services (DOCS) recommends Positive consideration of Docket No. PZ-2022-00007 V with the condition of BPW for the 2nd driveway curb but, and with adoption of the findings of fact submitted by the Petitioner.
