The applicant seeks approval to amend hours of operation:
Docket No. 05120009 CA commitment amendment The site is located at 9755 Randall Dr. and is
zoned B-3/Business. Filed by P. Adam Davis of Davis & Sarbinoff, LLP.
General Info:
The petitioner is
seeking commitment
amendment approval
to change the recorded
commitments to
permit businesses to
be open prior to 7 am
and past 7 pm for the
purposes of providing
emergency and/or
emergency veterinary
services for the urgent
care of patients.
Currently, the hours
of operation are
restricted from 7 am to 7 pm. This item is before the Board because the commitments specifically
state that a public hearing will be held in front of the BZA if the commitments are ever modified
or terminated.
Analysis:
The commitment amendment will address the provision for a business to accept patients before 7 am
and after 7 pm, ifthere is an emergency medical and/or emergency veterinary service that must be
provided. This is an important aspect of the medical business, to be able to cater to patients who have
emergencies at times other than regular office hours. Since emergencies are rare, it is assumed that
additional traffic to the site will be at a minimum. It is also assumed that most emergency traffic will
access the site from 96th street and not through the Briar Lane Estates neighborhood to the north.
Recommendation:
The department recommends positive consideration of Docket No. 05120009 CA.
