The applicant seeks the following development standards variance:
Docket No. 05120023 V ZO Chapter 26.02.19.D platted building setback line
The site is located at 1846 E 110th St. and is zoned S-2/Residence.

General Info:
The petitioner IS seeking
variance approval to allow a
change in the building setback
line. Currently, the platted
building setback line is 75-ft and
the petitioner would like to
move the building setback line
to 50-ft.
Analysis:
The variance request is for a
reduction of 25 feet of front
yard building setback. Several
other lots in this neighborhood
have requested the same
variance in the past, and have
been approved. There is a trend
ell. of razing homes and rebuilding
them slightly closer to the road, which is then slightly further from the golf course (adjacent to their
back yards).
Findings of Fact: reduced building setback line
1.) The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because:
The variance request is for 25 feet of front yard. All other lot and area requirements will be
met.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:

3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:
the overall building setback from the golf course may be "too close for comfort", due to the
possibility of golf balls hitting the home, which may negatively affect the quality of life for the
property owners.
Recommendation:
The department recommends positive consideration of Docket Nos. 05120023 V.
