MEMBERS PRESENT:
Mayor .lames Brainard, Council President Kevin Kirby, Council Members Rick Sharp, Brian Mayo, .loe
Gri£fiths, Ron Carter, Mark Rattermann, Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Lois
Fine.
Councilor Fred Glaser was absent.
Carmel Police Chaplain, George Davis, pronounced the Invocation.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Carter made a motion to approve the Minutes of the July 11, 2005 Special Meeting. Councilor
Griffiths seconded. Council President Kirby called for the question. The Minutes were approved 6-0.

Griffiths seconded. Council President Kirby called for the question. The Minutes were approved 6-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:

ACTION ON MAYORAL VETOES:

CLAIMS:
Councilor Mayo made a motion to approve the claims in the amount of $5,041,387.50. Councilor
Griffiths seconded. Council President Kirby called for the question. Claims were approved 6-0.
COMMITTEE REPORTS:
Councilor Sharp reported that the Finance, Administration and Rules Committee had not met.
Councilor Sharp reported that the Land Use, Annexation and Economic Development Committee had not
met. The meeting scheduled for Thursday, August 11,2005 may be cancelled.
Councilor Carter reported that the Parks, Recreation and Arts Committee had not met. The meeting
scheduled for Tuesday, August 9, 2005 may be cancelled.
Councilor Mayo reported that the Utilities, Transportation and Public Safety Committee had not met.
OLD BUSINESS
Second Reading of Ordinance D-1753-05; An Ordinance of the Common Council of the City of Carmel,
Indiana, Amending and Restating Chapter 4, Article 1, Division III, Section 4-26, of the Carmel City
Code (Door-To-Door Vendors). Councilor Griffiths reported that he had received amendments this
evening and made a motion to Table this item. Councilor Sharp seconded.
Second Reading of Ordinance D-1756-05~ AS AMENDED; An Ordinance of the Common Council of
the City of Carmel, Indiana, Creating and Adopting Chapter 8, Article 4, Section 8~39 of the Carmel City
Code (Speed Humps). Councilor Sharp referred to Mike McBride, Director, Engineering Department, for
clarification of a speed hump study in this area. Councilor Sharp made a motion to approve D-1756-05,
As Amended. Them was brief Council discussion. Council President Kirby stated that a second was not
needed. Council President Kirby caIIed for the question. Ordinance D-1756-05, As Amended was
adopted 5-1 (Council President Kirby opposed).
Second Reading of Ordinance D~1761-05; An Ordinance of the Common Council of the City of Carmel,
Indiana, Amending Carmel City Code Chapter 8, Article 6, Section 8-58(a) Regarding Vehicle Weight
Limitations (Carey Road). Councilor Mayo requested that this ordinance remain in committee.
Second Reading of Ordinance D-1762-05; An Ordinance of the City of Carmel, Indiana, Amending
City Code Section 8-21(a), Changing the Speed Limit to 30 Miles Per Hour on Certain City Streets.
Councilor Sharp stated that with the approval of the chairman of the Utilities, Transportation and Public
Safety Committee, Council is ready to move for~vard on the speed change ordinances this evening.
Councilor Mayo agreed with Councilor Sharp's statement. There was brief Council discussion.
Councilor Rattermann referred to Mike McBride, Director, Engineering Department, for clarification.
Council President Kirby called for the question. Ordinance D-1762-05was adopted 6-0.

Indiana, Amending Carmel City Code Chapter 8, Article 3, Section 8-22(a), Changing the Speed Limit to
40 Miles Per Hour on Certain City Streets. There was no Council discussion. Council President Kirby
called for the question. Ordinance D-1763-05 was adopted 6-0.
Second Reading of Ordinance D-1764-05; An Ordinance of the Common Council of the City of Carmel,
Indiana, Amending Carmel City Code to Add a New Section 8-23 Establishing Thirty-Five Mile Per Hour

Indiana, Adding Section 8-24 to Carmel City Code Section 8, Article 3, Establishing Forty-Five Mile Per
Hour Speed Limit on Certain City Streets. There was no Council discussion. Council President Kirby
called for the question. Ordinance D-1765-05 was adopted 6-0.

NEW BUSINESS
Council President Kirby announced the First Reading of Ordinance D-176%05; An Ordinance of the
Common Council of the City of Carmel, Indiana, Establishing A Code of Ethics for City Government.
Councilor Rattermann moved to introduce this item into business. This ordinance died for lack of a
Second.
Council President Kirby announced the First Reading of Ordinance D-1769-05; An Ordinance of the
Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional
Appropriation of Funds to the Department of Law Budget From the General Fund Operating Balance

seconded. Councilor Carter presented this item to Council. There was no Council discussion. Council

Council President Kirby announced First Reading of Ordinance D-1770-05; An Ordinance of the
Common Council of the City of Camml Authorizing the Use of Tax Increment and the Issuance of Bonds
Pursuant to Indiana Code 36-7-14-3.5 ($6,500,000.00 Hamilton County Redevelopment Commission's
2005 Bonds, $18,800,000:00 Hamilton County Redevelopment Commission's 2006 Bonds). Councilor
Sharp moved to introduce this item into business. Councilor Griffiths seconded. Council President Kirby
referred to Mike Howard, Howard & Associates, 694 Logan Street, Noblesville, Indiana 46060, for a
presentation to Council. Also present were Loren Matthes, H.J. Umbaugh (prepared the financial analysis
for this project) and Christine Altman, County Commissioner. There was brief Council discussion.
Council President Kirby referred Ordinance D-1770-05 to the Finance, Administration and Rules
Committee for further review and consideration.
Council President Kirby announced the First Reading of Ordinance D-1771-05; An Ordinance of the
Common Council of the City of Carmel, Indiana Pledging COlT Revenues to Bonds 'of the Hamilton
County Redevelopment District (COIT). Councilor Carter moved to introduce this item into business.
Councilor Griffiths seconded. Councilor Carter referred to Mike Howard, Howard & Associates, 694
Logan Street, Noblesville, Indiana 46060, for presentation to Council. There was brief Council
discussion. Mike Howard referred to Christine Altman for clarification. Council President Kirby referred
Ordinance D-1771-05 to the Finance, Administration and Rules Committee for further review and
consideration.
Council President Kirby announced Resolution CC-08-01-05-01; A Resolution of the Common Council
of the City of CarmeI, Indiana Designating 11555 North Meridian Street as an Economic Revitalization
Area (Dealer Services Corporation). Councilor Mayo moved to introduce this item into business.
Councilor Sharp seconded. Councilor Carter presented this item to Council and stated that in some

respects it is a ministerial function that the City has to be involved in because the State is concerned in
offering economic incentives. Councilor Sharp made a motion to Table this item until the next meeting
on August 15, 2005. Councilor Carter seconded. Council President Kirby called for the question. The
motion to Table until the next meeting on August 15, 2005 was approved 6-0.
OTHER BUSINESS
First Reading of Ordinance No. C-262~ An Ordinance of the Common Couticil of the City of Carmel,
Indiana, Annexing Certain Territory to the City of Cannel, Indiana, Placing the same within the Corporate
Boundaries thereof and making the same a part of the City of Carmel (Annexation of Washington
Township); Sponsor: Councilor Rattermann. FIRST INTRODUCED 6/21/04. Councilor Sharp made a
motion to Table this item. Councilor Carter seconded. There was brief Council discussion. Councilor
Rattermann stated the ordinance was mute because it didn't meet the deadline. He stated there had not
been a Public Hearing and Council had not done anything further. Councilor Rattemmnn said it would be
smart on Council's part just to remove it, because they have not had a Public Hearing and they haven't
done what they're supposed to anyway. Councilor Carter sthted the City is involved in litigation in
Washington Township, some of which was started by the Town of Westfield, some of which had been
commenced by Carmel. He recommended that Council not withdraw this ordinm~ce. Councilor Sharp
stated Council does have a valid annexation ordinance, and Council has met the requirements of the lst
reading. The City of Carmel will have to re-notice everybody anyway. Councilor Sharp stated the
Council had a valid and well-written ordinance, and that he would like to see how the situation in
Westfield shakes out. Council President Kirby called for the question. The motion to Table this
ordinance was approved 6-0.
ANNOUNCEMENTS
Mayor Brainard informed Council that the U.S. Congress had sent a Transportation Bill to the President
for signature. Carmel requested funds for the Old Meridian road project in the amounts of $900,000 and
$225,000. The Bill should be signed within the next few days.
