MEMBERS PRESENT:
Mayor James Brainard, Council President Kevin Kirby, Council Members Rick Sharp, Brian Mayo, Joe
Griffiths, Fred Glaser, Ron Carter, Mark Rattermann, Clerk-Treasurer Diana Cordray and Deputy-Clerk
Treasurer Lois Fine.
Pastor Paul Swartz, King of Glory Lutheran Church, Pronounced the Invocation.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Mayo made a motion to approve the Minutes of the August 1, 2005 Regular Meeting.
Councilor Sharp seconded. Council President Kirby called for the question. The Minutes were approved
6-0 (Councilor Glaser abstained).
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
Matt Idlilam, 1443 Orchard Park N. Drive, Indianapolis, IN, 46280. Mr. Milam discussed a newspaper
article (Urban Design Initiative section) regarding the City mapping its future.
COUNCIL~ MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
There were none.
ACTION ON MAYORAL VETOES:
Them were none.
CLAIMS:
Councilor Mayo made a motion to approve the claims in the amount of $2,672,398.84. Councilor
Griffiths seconded. Council President Kirby called for the ;questions. Claims were approved 7-0.

COMMITTEE REPORTS:
Councilor Glaser reported that the Finance, Administration and Rules Committee met this evening and
discussed Ordinance D-1769-05, Ordinance D-1770-05 and Ordinance D-1771-05. All three ordinances
were sent to the full Council with a favorable recommendation. Council President Kirby requested
Councilor Glaser to schedule a special finance committee meeting to discuss expected revenue.
Councilor Sharp reported that the Land Use, Annexation and Economic Development Committee had not
met.
Councilor Carter reported that the Parks, Recreation and Arts Committee had not met.
Councilor Mayo reported that the Utilities, Transportation and Public Safety Committee met and
discussed Ordinance D- 1761-05 and Ordinance D- 1753-05.
OLD BUSINESS
Third Reading of Ordinance D-1761-05; An Ordinance of the Common Council of the City of Carmel,
Indiana, Amending Carmel City Code Chapter 8, Article 6, Section 8- 58(a) Regarding Vehicle Weight
Limitations (Carey Road). Councilor Mayo reported to Council that this item was sent to the full Council
with a 3-0 favorable recommendation. Councilor Mayo referred to Councilor Griffiths for a presentation.
Councilor Griffiths made a motion to add under Section 2 (b) This section shall not apply to those
vehicles and under those circumstances as are set forth in code Section 8-56, as the same may be
amended from time to time. Councilor Sharp seconded. Council President Kirby called for the

Council President Kirby announced the First Reading of Ordinance D-1768-05; An Ordinance of the
Common Council of the City of Carmel, Indiana, Establishing the Appropriations and Tax Rates for the
2006 Budget ($64,488,019). Councilor Mayo moved to introduce this item into business. Councilor
Rattermann seconded. Council President Kirby presented this item to Council. Council President Kirby
opened the Public Hearing at 6:16 p.m. Seeing no one who wished to speak, Council President Kirby
closed thc Public Hearing at 6:17 p.m. There was brief Council discussion. Councilor Sharp made a
motion to suspend the rules to not send this item to conuuittee and to send the item to the full Council on
September 6, 2005. Councilor Mayo seconded. Council President Kirby called for thc question. The
motion to suspend the rules to not send this item to committee and to send the item to the full Council on
September 6, 2005 was approved 7-0.

presentation to Council. Also in attendance was the petitioner, Dr. Lynn Burford, 10293 N. Meridian
Street and Debbie Shumate, Harding Dahm Grubb and Ellis, real estate broker for Dr. Burford. Council
President Kirby opened thc Public Hearing at 6:29 p.m. Seeing no one who wished to speak, Council
President Kirby closed the Public Hearing at 6:30 p.m. There was brief Council discussion. Council
President Kirby referred Ordinance Z-480-05 to the Land Use, Annexation and Economic Development
Committee for further review and consideration.
NEW BUSINESS

Common Council of the City of Carmel, Indiana, In Support of the Park Board Lease-Purchase of Real

business. Councilor Sharp seconded. Councilor Sharp referred to Mark Westermeier, Park's Department
Director, for a presentation. There was brief Council discussion. Councilor Rattermann made a motion
to suspend the rules and vote on this item this evening. Councilor Griffiths seconded. Council President
Kirby called for the question. The motion to suspend the rules and vote this evening passed 7-0. Council
President Kirby called for the question. Ordinance D-1766-05 was adopted 7-0.
