They have a Conditional Secondary Plat on record with the County, which requires that they come in for Final Secondary Plats as each Block develops. In the case of the Carmel Science & Technology Park, we've always required that each Lot dedicate right-of-way in accordance with the Thoroughfare Plan in effect at the time of the Final Secondary, rather than the Plan in effect in 1980(?). An example of this would be the MISO project on Block 7, Lot 1, of the Science & Tech Park, which dedicated additional right-of way for South Guilford Road, West Carmel Drive, and City Center Drive (a street whcih wasn't even a glimmer in the City's eye when the Park came through for Primary and Conditional Secondary, but does appear on our current Thoroughfare Plan). Right now, we're having The Village of WestClay expand the rights-of-way for streets on their periphery as the Secondary Plats come through rather that have to condemn the land at a future date. I am of the opinion that a Primary Plat does not freeze a property in time. If a project is not pursued for Secondary Plat in a timely fashion, then the developer needs to address conditions as they exist when they do come through. I see nothing special with respect to Mayflower Park that would exempt them. He suggested that there may be a way to work out a compromise whereby we can be assured that there will be room to build a widened 96th Street, and they can be assured they don't have to change an approved plat(at the secondary stage)to dedicate all the ground called for by the Thoroughfare Plan amendment. I told him to put his suggestion in writing and send it to Laurence,with a copy to me,and we would consider it. I think that we may be better off not to try to enforce against them a requirement that they dedicate ground at the secondary plat stage,when they have already have an approved primary plat. This is particularly so if we change our Thoroughfare Plan between their primary plat and secondary plat submissions. Let's see exactly how his letter reads when it comes over(probably by fax later today). Then we can visit about this issue again on Thursday morning. In regard to the Little Farms, Lot 41 (116-00 PP Amend) issue, the reason for the request of a 20' half right of way is that by State Law, no right of way for a public street may be platted with less that a 20' half. Therefore, the Highway Department suggests that the petitioner request that the right of way for Combs Street be vacated. As long as there are no issues with utilites in this area, the Highway Department would be in support of the vacation. The Mayflower Park Subdivision plat must contain the certificate that was issued in the review letter. A statement to the fact that the Streets shall be open for public use, but never dedicated to the public would be fine, but the certificate must remain. As a part of the replat of Mayflower are you also requesting the additional right of way along 96th Street? First is the replat of Little Farms, Lot 41 (116-00 PP Amend). Weihe Engineering informs us that they have reached agreement with the Highway Department regarding the rights-of-way for East 104th Street and Combs Street. The concern DOCS has with the 20-foot wide half versus a 15-foot half is limited to Combs Street. With a 20-foot half, Lot 41a (the easternmost) drops below the minimum 10,000-square-foot minimum for the R-1/residence district. Our Department's suggestion is this: Maintain the 15-foot half for Combs Street, while increasing the half right-of-way for East 104th Street to 20 feet. We view this as practical because we never expect this stub to connect through to Bristol Road in the College Meadows Subdivision. In fact, it is highly likely our Department would have no objection should anyone ever petition for this stub to be vacated. Please respond with your thoughts on this issue. Second is the question of Marwood Trails, Lot 12. The plat recorded in 1965 for the Marwood Trails Subdivision shows a 1-foot-wide spite strip between Marwood Drive and the property currently under consideration for Primary Plat approval as Bonbar Place Subdivision (129-00 PP). Our file for this subdivision includes a requirement that this 50-square-foot piece of ground be dedicated. We have a signed and notarized copy of the document (dated August 13, 1965) accomplishing this, but we are presently unaware whether this was recorded (it was the petitioner's responsibility), or if your Department is even aware of the dedication (or the need for it, for that matter). The issue was brought to DOCS attention yesterday afternoon by a property owner in Marwood Trails Subdivision who is interested in keeping Bonbar Place from deriving it second point of access via the Marwood Drive stub. Finally, there is the question of the Certificate of Dedication included on I the Secondary Plat for eleven lots ( : Mayflower Park Subdivision. That was included at the request of DOCS. We realize that the County will not accept these streets into its inventory, and we have no objection to that. The dedication is included for purposes of our Zoning Ordinance. The Carmel/Clay Zoning Ordinance prohibits us from issuing ILPs for properties that do not have adequate frontage on a publicly dedicated street. It makes no requirement that the street then be accepted.
