MEMBERS PRESENT:
Mayor James Brainard, Council President Kevin Kirby, Council Members Rick Sharp, Joe Griffiths, Fred
Glaser, Ron Carter, Mark Rattermatm, Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Lois
Fine.
Councilor Brian Mayo was absent.
CLAIMS:
Councilor Griffiths made a motion to approve the claims in the amount of $2,514,062.41 and
$1,862,579.37. Councilor Glaser seconded. Council President Kirby called for the question. Claims
were approved 6-0.
OLD BUSINESS
Council President Kirby announced the Second Reading of Ordinance No. C-263-A; An Ordinance
Amending Ordinance No. C-263, An Ordinance of the Common Council of the City of Cam~el, Indiana,
Annexing Certain Territory to the City of Carmel, Indiana, Placing the Same Within the Corporate
Boundaries Thereof and Making the Same a Part of the City of Carmel (SW Clay Township). Councilor
Sharp made a motion to amend Ordinance No. C-263-A to remove the ,4 and add As Amended under the
ordinance number and reference VERSION A for the correct ordinance. Councilor Carter seconded.
Council President Kirby called for the question. The motion to amend and refer to VERSION A was
approved. There was no Council discusslon. Council President Kirby called for the question.
Ordinance C-263, As Aruended was adopted 6-0.
NEW BUSINESS
Council President Kirby announced the First Reading of Ordinance D-1781-05; An Interlocal
Agreement Between the Town of Westfield, Indiana and the City of Carmel, Indiana (AMLI - 146th
Street in Washington Township). Councilor Sharp moved to introduce this item into business. Councilor
Glaser seconded. Councilor Sharp presented this item to Council and referred to Nick Kile, Attorney,
Barnes & Thornburg, 11 S. Meridian Street, Indianapolis, 1N 46024 for clarification of the pending legal
appeal. Councilor Sharp made a motion to suspend the rules and vote on this item this morning.
Councilor Glaser seconded. There was no Council discussion. Council President Kirby called for the
question. The motion was approved 6-0. There was no Council discussion. Council President Kirby
called for the question. Ordinance D-1781-05 was adopted 6-0.
Council President Kirby informed Council that the annexation legal bills would be paid from the 2005
Council budget until the funds are used. At that point the bills for annexations will be paid from the
legal department budget.
Clerk-Treasurer Diana Cordray discussed the monthly fee for the broadband cards for Council's laptops.
Councilor Sharp stated that Council does not have the money in their 2006 budget for this monthly fee but
a transfer will cover the fees for next year.
Clerk-Treasurer Diana Cordray discussed when the new Council President is elected. Diana suggested
that Council amend the ordinance to elect the new Council President at Council's last meeting of the year.
Councilors Sharp and Griffiths will co-sponsor this ordinance.
Mayor Brainard announced that the county has approved the Thompson TIF which will allow for road
improvements and construction on Illinois from 114th to Oakridge, adding a round-a-bout at 4th & 3rd
Avenues, and the construction on Main Street.
Council President Kirby wanted clarification from Mayor Brainard regarding whether the Redevelopment
Commission is managing the construction of Illinois Street or if it is being managed directly through the
City. Mayor Brainard said the Redevelopment Commission is not managing the construction of Illinois
Street. The Mayor said the construction is being managed through the City.
Council President Kirby and Mayor Brainard discussed right-of-way purchases by the Redevelopment
Commission and the City.

Mayor Brainard adjourned the meeting following execution of documents at 8:45 a.m.
