COMMON'COUNCIL MEETING
MINUTES
MONDAY, NOVEMBER 7, 2005 - 6:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEMBERS PRESENT:
Council President Kevin Kirby, Council Members Rick Sharp, Brian Mayo, Joe Griffiths, Fred Glaser,
Ron Carter, Mark Rattermann, Clerk-Treasurer Diana Cordray and Deputy Clerk-Treasurer Lois Fine.
Mayor James Brainard was absent.
Rabbi Bienstock, pronounced the Invocation.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Mayo made a motion to approve the Minutes of the October 17, 2005 Regular Meeting.
Councilor Glaser seconded. Council President Kirby called for the question. The Minutes were approved
7-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
Margaret Davidson, 767 Grace Court, Carmel, IN. spoke in favor of: Ordinance D-1778-05 (Non
Smoking).
COUNCIL~ MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
There were none.
ACTION ON MAYORAL VETOES:
There were none.
CLAIMS:
Councilor Mayo made a motion to approve the claims in the amount of $2,253,876.30. Councilor
Griffiths seconded. Council President Kirby called for the question. Claims were approved 7-0.
COMMITTEE REPORTS:
Councilor Glaser reported that the Finance, Administration and Rules Committee had not met.
Councilor Sharp reported that the Land Use, Annexation and Economic Development Committee had not
met. The next meeting scheduled for November I0, 2005 has been cancelled. A Special Meeting will be
noticed for Wednesday, November 16, 2005 at 4:30 p.m.
Councilor Carter reported that the Parks, Recreation and Arts Committee had not met.
Councilor Mayo reported that the Utilities, Transportation and Public Safety Committee had not met. The
next meeting is Monday, November 14, 2005 at 5:00 p.m.

Council Presid'ent Kirby announced the First Reading of Ordinance D-1782-05; An Ordinance of the
Common Council of the City of Carmel, Indiana To Vacate A Segment of Right-Of-Way for River Road.
Councilor Mayo made a motion to introduce this item into'business. Councilor Glaser seconded.
Councilor Glaser presented this item to Council and referred to Beth Henkel, Attorney, Ice Miller, One
American Square, Box 82001, Indianapolis, 1N 46204 for a presentation. There was brief Council
discussion. Councilor Glaser referred to Mike Hollibaugh, Director, Department of Community Services,
for clarification. Council President Kirby opened the Public Hearing at 6:14 p.m. Seeing no one who
wished to speak, Council President Kirby closed the Public Hearing at 6:14:30 p.m. Beth Henkel referred
to Zeff Weiss, Attorney, Ice Miller, One American Square, Indianapolis, IN 46204 for clarification.
There was brief Council discussion. Council President Kirby referred Ordinance D-1782-05 to the
Utilities, Transportation and Public Safety Committee for further review and consideration.
Council President Kirby announced the First Reading of Ordinance Z-484-05; An Ordinance of the
Common Council of the City of Carmel, Indiana, Establishing the 116th Street Centre Planned Unit
Development District. Councilor Sharp made a motion to introduce this item into business. Councilor
Mayo seconded. Councilor Griffiths is under contract with the petitioner of'this project and requested to
be recused. Councilor Griffiths left the Chamber. Councilor Sharp presented this item to Council and
referred to ZeffWeiss, Attorney, Ice Miller, One American Square, Indianapolis, 1N 46204 for a
presentation. Also in attendance were Mark Zukerman and Glen Meinecke with Equicor Development,
Inc., 9011 N. Meridian Street, Suite 202, Indianapolis, IN 46260. There was brief Council discussion.
Councilor Carter referred to Mike Hollibaugh, Director, Department of Community Services, for
clarification. Council President Kirby opened the Public Hearing at 6:34 p.m. Seeing no one who wished
to speak, Council President Kirby closed the Public Hearing at 6:34:30 p.m. There was no Council
discussion. Council President Kirby referred Ordinance Z-484-05 to the Land Use, Annexation and
Economic Development Committee for further review and consideration. Councilor Griffiths returned to
the Chamber.
NEW BUSINESS
Council President Kirby announced the First Reading of Ordinance D-1757-05; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Ordinance D-1091, Sections 2-22 and 6-64
of the Carmel City Code to Change the Name of the Cannel Street Tree Committee to Carmel Urban
Forestry Committee. Councilor Mayo made a motion to introduce this item into business. Councilor
Glaser seconded. Councilor Carter presented this item to Council. Councilor Sharp {nade a motion to
suspend the roles and vote this evening. Councilor Carter seconded. Council President Kirby called for
the question. The motion was approved 7-0. There was no Council discussion. Council President Kirby
called for the question. Ordinance D-1757-05 was adopted 7-0.
Council President Kirby announced the First Reading of Ordinance D-1785-05; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 3, Article 1, Division II, Section
3-13(a) of the Carmel City Code (President Pro Tempore). Councilor Sharp made a motion to introduce
this item into business. Councilor Mayo seconded. Councilor Griffiths presented this item to Council.
There was no Council discussion. Councilor Sharp made a motion to suspend the rules and not send this
item to committee and vote this evening. Councilor Glaser seconded. Council President Kirby called for
the question. The motion was approved 7-0. There was no Council discussion. Council President Kirby
called for the question. Ordinance D-1785-05 was adopted 7-0.
First Reading of Ordinance D-1786-05; An Ordinance of the Common Council of the City of Carmel,
Indiana, Adding Chapter 8, Article 5, Section 8-49 to Carmel City Code (No Standing or Parking Areas).
Withdrawn by'Councilor Carter.
Council President Kirby announced Resolution CC-I 1-07-05-01; A Resolution of the Common Council
of the City of Carmel, Indiana, Approving a Transfer of Funds by the Carmel Fire Department
($13,200 - Diesel Fuel). Councilor Mayo made a motion to introduce this item into business. Councilor
Sharp seconded. Councilor Mayo presented this item to Council. There was no Council discussion.

of the City of Carmel, Indiana, Approving a Transfer of Funds by the Carmel Fire Department
($11,250 - Repair Parts). Councilor Mayo made a motion to introduce this item into business. Councilor
Sharp seconded. Councilor Mayo presented this item to Council. There was no Council discussion.

Council President Kirby announced Resolution CC-11-07-05-04.; A Resolution of the Common Council
of the City of Carmel, Indiana Establishing a Memorandum of Understanding Adopting The National
Incident Management System (NIMS). Councilor Mayo made a motion to introduce this item into
business. Councilor Glaser seconded. Councilor Mayo presented this item to Council and referred to
Chief Doug Callahan, Carmel Fire Department, for clarification. There was brief Council discussion.
Council President Kirby called for the question. Resolution CC-11-07-05-04 was adopted 7-0.
OTHER BUSINESS
Mike Hollibaugh, Director, Department of Community Services, wanted to keep the Council updated, as
with the NOAX agreement, the need to update the Comprehensive Plan. We (Department of Community
Services) have engaged a consultant, Ground Rules Inc., to assist in this project. The first public
meeting/work session with the Carmel Clay School Board will be held either at the Education Services
Building or Carmel High School on Monday, November 14, 2005 at 7:00 p.m.
ANNOUNCEMENTS
Clerk-Treasurer, Diana Cordray, informed Council that their first meeting in 2006, January 2"~, was a
legal holiday. Council should discuss holding their first meeting on Monday, January 9th. Council
President Kirby informed Clerk-Treasurer, Diana Cordray, that Council would hold their first meeting in
2006 on Monday, January 9th. The time of the meeting will be determined.
EXECUTION OF DOCUMENTS
Council President Kirby adjourned the meeting following execution of documents at 6:50 p.m.
