It - 73 k;:f/!J; WHEREAS, the Common Council of the City of Carmel has authorized the making of extensions and additions to the existing waterworks system of said City for the purpose of providing an adequate volume of water at proper pressure to the inhabitants of the City and properly protecting the health, well-being, and property of said. City and its inhabitants; and WHEREAS, in order to procure the necessary funds to pay the cost of constructiol1 of said extensions and additions, it is necessary for the City to issue and sell waterworks revenue bonds payable solely out of the. revenues of said waterworks system; and WHEREAS, the Common Council now finds that the existing rates and charges for the use of and services rendered by the waterworks system of said City are insufficient to pay all the necessary expenses incident to the operation of said waterworks, including maintenance costs, operation charges, upkeep, repairs, depreciation, interest charges on obligations of the waterworks, to provide a sinking fund for the liquidation of indebtedness, to provide a debt service reserve for obligations of the waterworks, and to provide adequate funds to be used as working capital and funds to make extensions and replacements, to make payments in lieu of taxes, and to provide a reasonable return on the utility plant of the waterworks which the Common Council elects to provide, and that accordingly, such existing rates and charges do not produce income sufficient to maintain the waterworks property in a sound physical and financial condition to render adequate and efficient service, all as provided in IC 8-1.5-3-8, and that the existing rates and charges should be increased; and WHEREAS, the Indiana Utility Regulatory Commission issued its Order in Cause No. 39536 on April 21, 1993, approving new rates and charges, which new rates and charges represent a 27.94o/~ increase, applied across-the-board, and the Common Council now finds that Ordinance No. A-68 should be amended to adopt the new rates and charges as approved by the Indiana Utility Regulatory Commission; and NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA: Section I. Recurring Rates and Charges. The recurring, non-recurring and miscellaneous rates and charges set forth on Exhibit A, which is attached hereto and incorporated herein by reference, are hereby established for the use of and service rendered by the waterworks system of the City of Carmel. . Section 2. Tap Fees. Each user, at the time he is connected with the waterworks system by the Carmel Water Utility, shall pay a tapping fee. The minimum tapping fee shall be $50.00. The charge for any service tap for 3/4" or larger shall include the cost of labor according to current construction rates, materials, and equipment use according to current hourly rental rates, but in no case shall it be less than Fifty Dollars ($50.00). r! .-<::: r". . s.J ,~ ,EO, ~.."." ., ~,- . a Section 3. Collection or Deferred Pavment Charge: Attornev Fees and Other Collection Costs. (a) All payments for water and/or sewer service must be received in the office of the Carmel Utilities Department within fifteen (15) days from the billing date stated ~n the bill. Customers who are habitually late with their payments, more than three (3) times in any calendar year, may be required to make a One Hundred Dollar ($100.00) deposit, to be applied for all or part payment of a bill not paid by said customer, or have their water and/or sewer service discontinued. If the total amount of the deposit is not used, the remainder of the deposit will be refunded to the customer after their service has been discontinued. (b) Failure of a user to make timely payment shall subject the user to a late charge of 10% on the first Three Dollars ($3.00) and 3% on all amounts over Three Dollars ($3.00). (c) Submission of any delinquent account to any attorney for collection shall entitle the City of Carmel to recover reasonable attorney's fees, expenses incurred by the City in the collection process, and court costs, if any. (d) Delinquent accounts may be collected through Carmel City Court and the complaint filed by an attorney or a city appointed employee as allowed by statute. Section 4. Temporary Users. Water furnished to temporary users such as, but not limited to, contractors, circuses, carnivals, seasonal stands, and the like, shall be charged on the basis of the quantity rates as stated in Exhibit A attached hereto, as estimated by the designated utility employee appointed by the Carmel Utilities manager. Section 5. Disconnection for Non-Pavment (a) Water service shall be disconnected from those water customers of the Carmel City Utilities who fail to pay the accrued fees and late charges within sixty (60) days of billing. The service cannot be continued until all fees are paid, including a Twenty Dollars ($20.00) reconnect fee. The water service can only be reconnected by a Carmel Water Utility employee. Section 6. Returned Checks. If the City of Carmel receives a check for payment of a water and/or sewer bill, and said check is returned for insufficient funds, the City may assess a fe~ of Twenty Dollar ($20.00) in addition to all other applicable charges. and water service may be disconnected or new water service may be denied on other properties until the account is brought current Cash, cashier's check, or money order will be required to pay all such charges. Section 7. Hvdrant Meters. (a) No person shall use or collect Carmel Water Utility Water from any fire hydrant without a metering device approved by the Carmel Water Utility. (b) Hydrant meters may be installed on fire hydrants at the discretion of the Carmel Water Utility when conditions warrant. for the purpose of supply of water to any sites. Such installation shall be supervised by the Carmel Water Utility. Section 8. Service Charge and Installation Fee. There will be a service charge of Twenty Dollars ($20.00) for each new water and/or sewer account. There will be a one-time installation fee for each original water meter installed as follows: 5/8" by 3/4" .meters 1" meters 1 112" and 2" meters 3" meters 4" meters $15.00 $20.00 $25.00 $30.00 $40.00 Section 9. MISCELLANEOUS CHARGES. Rates for Jumoers: Service charge of Fifty Cents ($0.50) per day. Installation Charge for. Jumoers: The charge for installation of jumpers by Carmel Water Utility staff shall be Fifteen Dollars ($15.00). Regulations of Jumoers - Permission Reouired: (a) No person shall install ajumper or any other device in a service line for the purpose of obtaining unmetered water for any reason without express written permission of, and use of jumpers installed by the Carmel Water Utility. (b) No person shall use. or collect Carmel Water Utility water from any source without a metering device approved by the Carmel Water Utility. (c) A violation of this section shall be deemed an ordinance violation and any person violating this section shall be subject to a fine of not less than One Hundred Dollars ($100.00). Remote Register Charge: Additional charge for remote register Twenty Dollars and Fifty Cents ($20.50). Water Meter Pit Accessibility: Water meter pits must be in an accessible location to allow the reading or inspection of the water meter. No obstructions or conditions shall exist as to keep the water meter from being read, replaced, or otherwise maintained. Prohibited obstructions shall include, but not be limited to, shrubbery, flower beds, vehicles or other objects placed over the pit. The water meter pit, piping, and lid are owned by the property owner, who is responsible for their safe and proper condition according to City specifications. The water meter inside the pit or remote meter is owned and maintained by the City of Carmel. A violation of this section shall be deemed an ordinance violation and any person violating this section is subject to a fine of not less than One Hundred Dollars ($100.00) and/or service may be discontinued to the customer who fails to maintain the meter pit according to current City specifications. Water Meter Pit Insoection: Contractor calling for meter pit inspection when pit is not ready and more than one trip is requinid is subject to a Ten Dollar ($10.00) charge. Soecifications for Meter Pits: (a) Specifications for meter pits shall be set forth in standards maintained by the Carmel City Utilities. (b) The installer is to be responsible for assuring that the top of the meter pit lid is on a flush grade with the surrounding ground and also that all parts are rigidly installed and that the piping is free of leaks and meets all State and Carmel Water Utility specifications. (c) No alterations to meter pits shall be allowed without written permission from the Carmel Water Utilities. Section 10, Pavment in Lieu of Taxes, The Common Council hereby elects to receive payment in lieu of taxes from the waterworks.' Section 11, Reasonable Return, The Common Council hereby elects to earn a reasonable return on the waterworks plant Section 12, Repealer. All ordinances or parts of ordinances inconsistent with any provision of this ordinance are hereby repealed. Section 13.
