OF COMMUNITY SERVICES August 14, 1997 Department Report To: Plan Commission Members From: Department of Community Services re: projects scheduled to be heard on August 19, 1997 H. Public Hearings: lh. U.S. 31 Overlay Zone Ordinance Amendment (60-97 O.A.) The City Council has directed the Plan Commission to offer a recommendation on a zoning ordinance amendment that would change two sections of the U.S. 31 Overlay Zone Ordinance. One proposed change in the ordinance would allow the Plan Commission to disapprove a Development Plan within the corridor and would add the "Comprehensive Plan" as one of the eighteen criteria the Plan Commission considers when reviewing a Development Plan. The other proposed change would not allow more than 15% of the square footage of a building to be used for retail uses. The Department recommends approval. The Commission will need to suspend the rules of procedure in order to take action. 2h. Penn Mark Plaza Parking Lot Reconfiguration (35-97 D.P.AmendJADLS Amend.) The petitioner seeks approval to allow the reconfiguration of the existing parking lot. The Department recommends approval pending resolution of all Technical Advisory Committee issues. The Commission will need to suspend the rules of procedure in order to take action. 3h. Mayflower Complex (57-97 D.P.) Petitioner seeks approval to construct 99th Street within the existing commercial and industrial park. The Department recommends approval with the condition that the other curb cut along Michigan Road be closed and the property to the south of 99th Street gain its access from the new street. Saddle Creek Development, Sections 5-11 (12-97 P.P. Amend) The petitioner seeks approval to change the approved plat (residential open space plan) by adding 61 lots. The Department recommends approval pending resolution of all Department and Technical Advisory Committee concerns regarding the newly submitted plans. 2i. Eagle Ridge Subdivision (27-97 P.P.) The petitioner seeks approval of a primary plat application to subdivide 153 acres into 279 lots. This project was filed under the S-1/residence development standards in place prior to the passage of the S-1 ordinance amendment by the City Council on April 21, 1997. The Department recommends approval. Issues relating to the traffic impact of the project have been raised, however these are not legitimate reasons to deny this primary plat application. The traffic studies submitted can be used by the appropriate agencies to determine what infrastructure improvements should be made by the developer to alleviate these impacts. The plan as proposed meets all applicable Zoning and Subdivision Regulations and should be approved. 3i. Hyde Park Subdivision (29-97 P.P.) The petitioner seeks approval to plat 59 lots on 40 acres of land. The Department is currently working with the petitioner on the extent of the landscape, the tree preservation plan, and the resolution of other Technical Advisory Committee issues. The Department recommends approval pending resolution of the details of the landscape plan and the location of the construction entrance. 4i. Old Towne Village (43-97 P.PJS.P.) The petitioner seeks approval to plat 3 lots on .58 acres. The Department recommends approval. Si. REI Investments Office Complex (56-97 ADLS) The petitioner seeks approval to construct an 18,000 square-foot office building and a 120,000 square-foot office building on 10 acres within the existing Meridian at 465 Complex. The Department is currently working with the petitioner to resolve issues relating to the location of the curb cuts, the extent of the lighting plan, and other Technical Advisory Committee issues. The Department recommends approval pending resolution of these issues. Page 3 of 3 J. New Business: 1j. Custom Floors of Cannel (59-97 ADLS) The petitioner seeks approval to construct a 16,000 square-foot floor covering store on 1.67 acres. The Department is currently working with the petitioner on the extent of the landscape plan and the location of the proposed curb cuts and recommends this project proceed to the Special Study Committee on September 2nd for further review. 2j. Hamilton Crossing Building #2 - Firestone Sign (61-97 ADLS Amend.) The petitioner seeks approval to install a sign on Hamilton Crossing, Building #2. The Department recommends approval. 3j. Linc Systems Sign (62-97 ADIS Amend.) The petitioner seeks approval to install a sign on the Linc Systems Building. A ground sign was previously approved by the Commission for this petitioner. The Department recommends approval.
