I received information from Jon Dobosiewicz, that in connection with the curb cut
request of Meridian Hotel Partners, LLC, you are requesting simultaneously the dedication of the
Pennsylvania Street right-of-way. In order to accommodate this, Meridian Hotel Partners has
accelerated the closing date and will be purchasing the Real Estate from Beverly Enterprises on
Monday, November 5, 2001. I enclose herewith a copy of the Dedication of Right-of-Way,
which will be executed and delivered to your office on Monday, November 5, 2001, following
the closing. Obviously, Meridian Hotel Partners cannot dedicate to the City Right-of-Way that
which they do not own. Therefore, it was necessary to close on the Real Estate prior to
dedicating the Right-of-Way. Although, there is on file with the Department of Community
Services, a Commitment to Dedicate Right-of-Way, as well as reserve Right-of-Way for
acquisition by the State of Indiana. If you should have any questions, please call. Thank you!

This evaluation is intended to assess the level of compliance with 327 lAC 15-5 (Rule 5). It is also intended to identifY areas where
additional measures may be required to control erosion and sedimentation. All practices recommended in this report should be
evaluated as to their feasibility by a qualified individual with structural practices designed by a qualified engineer.
All erosion and sediment control measures shall meet the design criteria, standards, and specifications outlined in the "Indiana
Handbook for Erosion Control in Developing Areas" or similar guidance documents.

Place greater emphasis on erosion and sediment control on building sites; contractors,
subcontractors, material vendors, and others should be made aware of erosion and sediment control
requirements. Appropriate perimeter sediment controls (e.g. silt fence) and stable construction
entrances shall be utilized on all sites. Sediment tracked into the street shall be removed (do not
flush with water) at the end of each work day.
X Other Requirements:
1. The perimeter of the site needs to be secured for the winter. Disturbed areas need to be seeded and mulched. A
crimper or other practice should be used to secure the straw from blowing. Any area being actively disturbed
should be protected with silt fence. A perimeter of grass or mulch would take the place of a silt fence on this site.

On October 16, 2001, the Carmel Plan Commission unanimously approved the
DIPI ADLS Application for the Hilton Garden Inn, pursuant to the plans on file with the
Department of Community Services (under Docket Number 97-01 DP/ADLS), as last amended.
Please be aware that the wall sign to be located on the South facia of the hotel although
permitted (as to number of signs), requires a developmental standards variance from the Carmel
Sign Ordinance, because it does not front on a public street. Bob was made aware of this prior to
the meeting.
Please notify me of the closing date so that I may proceed with the recordation of the
commitment: and presentation to the City of the Dedication of Right-of-Way for Pennsylvania
Street (Area "C" Real Estate).
Tim, I wish you and Bob much success, and thank you for the opportunity to have been a
part of the approval process for what will be an outstanding addition to Carmel. I thought the
October 18, article in the Metro Section of the Indianapolis Star was great. Thank you!

Dear Jon,
Thank you for your help during our approval process for the Hilton Garden
Inn. A few issues were raised at the Special Studies Committee that I wanted
you to be aware of. There was a request made for soft lighting to be
provided on the west side of the building. We always intended to provide
lighting on the building. Our architect is the same person that designed the
Hampton Inn in Carmel. We will provide the requested lighting. It will be
very similar to what is used at the Hampton Inn. We also agreed to provide a
fountain in the holding pond. That fountain will be illuminated during the
evening hours.
Finally, I wanted to make sure that the landscaping plan that I dropped off to
you yesterday afternoon was forwarded to the appropriate person in your
office for approval. Jim Nelson mentioned his name. I believe his name is
Scott. Would you please advise me of the status of the landscaping plan? We
want to have all our ducks in a row before going back to the Planning
Commission.

2. Please identify the opposing drives on Pennsylvania (residential, Summer Trace, etc.). Are the drives
one way entrance and exit drives?
3. Per Mike McBride's comments at the September 19th T.A.C. meeting, eliminate the round-a-bout
notation at the intersection of Pennsylvania and 131 st. The request to accommodate the existing
sidewalk within dedicated right of way was adequately addressed at T.A. C.
4. There are two notations (@)at the entrance that are not included in the Legend. Please identify.
5. There is a 6" water line notation in the area ofthe proposed INDOT right of way. What does this refer
to?

6. Believe the invert elevation for end section 417 is incorrect. The elevation is indicated as 865.08 on
the plan and 868.08 on the Storm Structure Schedule.

7. It appears that the existing sanitary sewer lateral terminates under the pavement section of
Pennsylvania Street. Is tIlis a correct assumption? If so, tIlis will require Board of Public Works and
Safety approval. We request that all alternative solutions be explored to elinlinate any open pavement
cuts on Pennsylvania Street.
ADDITIONAL ISSUES
8. Regarding the detention pond, please provide details on tile drawings including cross sections, pond
depth, etc. Will there be bollards or other protection along tile U. S. 31 right of way adjacent to this
pond?
9. Have you received INDOT approval to discharge storm water into the U.S.31 right of way?
This office, in our previous review, requested a follow-up letter addressing our comments and concerns.
While we received revised drawings, to my knowledge, a follow-up letter was not received. We again
request tImt follow-up letters be provided addressing our comments.

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service area for the September
19 TAC meeting. Please feel free to copy and distribute this email or attach it to your meeting minutes.
Village of West Clay, Section 6501-B (Secondary Plat)
The District has received the plat and has no comments at this time since construction plans would still need to be
reviewed by the District's consulting engineers. Once that review is complete, the plans will be ready to be submitted by
the District to IDEM for State approval.
CH Land ADLS (Development Plan)
The District has reviewed the plans for this project and notes that the developer is proposing a 6" lateral sewer tie-in
directly to an existing manhole. District specifications will need to be followed for such a connection and building permits
should NOT be issued unless the District has issued its connection permit.
College Hills PUD Text Amendment
The District has no comments relative to the text of the proposed PUD ordinance. We have previously provided
comments on a number of construction related issues including sewer capacity in the area, capping of individual private
wells, and proper abandonment of individual private septic systems which will be effected by this project.
Hilton Garden Inn (Revised Development Plan)
It is unclear if this property will require sewer service from the District or not. From the location description (southeast
corner of Meridian and West Main Street) it is more likely within the service area for Carmel Utilities. However, please
have the applicant provide plans for the District to review so that we can make a definitive determination.

General Information
1. The project site is located witllin current City of Cannel Corporate Limits.

. Sanitary Sewer Availability (Connection).
. Commercial Curb Cut. Please provide an exhibit that shows the location of the curb cut(s) and
accel/decellanes if applicable; appropriate dimensions including drive width, overall widtll at tlle
street, accel/decel dimensions, radii, etc. and location of existing opposing curb cuts. The
proposed drive should be aligned, left turn lane to left turn lane, Witll an opposing drive whenever

4. Sanitary Sewer Connection Fees:
. Connection Fees are based upon the average user factor tables from Section 9-200 (sanitary) of
our Utility Ordinance. The Connection Fee is $795.00 per E.D.U. for sanitary sewers. The
Equivalent User Contribution Multiplier for Hotels is 0.50 E.D.U.s per Room. Please indicate the
number of rooms to be constructed with this facility. I am enclosing copies of our Average User
Factors for Sanitary Sewers and our current Fec Schedule. I have also highlighted the Average

Note: Any deviation from the Connection Fee calculations listed in our Ordinance will require
Carmel Utilities and Board of Public Works and Safety approvals. Such requests must be
accompanied by proof of a minimum of one years worth of actual water usage, recapped by
total gallons per month, and must include the name, location, size and/or number of rooms of
thefacility being utilized as a basefor calculation offees.
5. Availability (Acreage) Fees:
Please provide tins office with a legal description of the property including tile net acreage. The
Availability (Acreage) Fee is $1,365.00 per acre for sanitary sewers.
6. T.A.C. Review/Drawings submitted for approval:
We request tIlat all comments and comment letters generated by tIns office be answered in writing and
be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all issues llave been resolved. All Cannel Utility issues must also be resolved. The
design engineer must certify all drawings submitted for final approval. This office will require a
minimum offour-sets of approved drawings after all issues have been resolved. The drawings will be
stamped approved and signed by both the City Engineer and Director Carmel Utilities. The
Developer/Owner will receive one-set which is to be maintained on tile construction site at all times.
Carmel Utilities will receive one-set. Our Public Works Inspector will receive one-set and one-set will
be maintained in tile Department of Engineering. If more than four-sets are requested to be approved,
tile additional sets must be submitted WitIl tile four-sets.
7. Please be advised that any installation of signs, walls, irrigation systems, etc. witIlin dedicated right of
way or easements will require a Consent to Encroach Agreement between tile Owner/Developer and
tile City of Carmel. This agreement requires review and approval by our Law Department and Board
of Public Works and Safety approval.
8. Cannel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water
and sanitary sewer locates.
9. Carmel Utilities will provide a separate review of this project for sanitary sewer issues.
10. I am including copies of the following items with tins correspondence:

11. Upon initial review, it appears tlle following bonding requirements will apply to this project:
Performance Guarantees
. Multi-purpose PatIls (in right of way).
Please provide a detailed and certified Engineer's Estimate for 100% of the cost of labor and materials
for the above improvement. Post a Performance Guarantee in the amount of the Engineer's Estimate.
Performance Guarantees may be Irrevocable Letters of Credit, Performance Bonds or Official or
Cashier's Checks. A three-year Maintenance Guarantee will be required upon release of the
Performance Guarantee.
Street Cut/Right of W~lY Permit and Bonding Requirements
Any work in dedicated right of way will require a Street CutlRight of Way Permit and a License and
Permit Bond in the appropriate amount. The bond amount will be determined by the number of
instances of work in tile right of way (curb cut, stonn and/or sanitary, water, etc.) @ $2,000.00 per

PROJECT COMMENTS
12. This office will not approve drawings with the statement as it appears on Sheet CIOO regarding the
responsibility of the holder for verifying the plans are the most current version.
13. The size of the project may not warrant 2-curb cuts. Please provide justification for the removal of the
existing curb cut and for 2-curb cuts for this project.
14. We assume the sanitary lateral stub-out under Pennsylvania was installed previously. If so, please
identify on the plans as existing.
15. We are currently reviewing the drainage cales for the project. We reserve the right to provide
additional stonn drainage comments upon completion of this review.
16. On Sheet C102, it would be helpful if the opposing drives were identified (residential, Summer Trace,
etc.).
17. Pennsylvania Street is classified as a Secondary Arterial on the Thoroughfare Plan. Right of way
requirements are 90' total, 45' half. Please identify the section line for detennining the halfright of
way of Pennsylvania Street. A multi-purpose path is indicated on the Thoroughfare Plan. The path
should be constructed along the entire Pennsylvania Street perimeter of the property. 131 st Street is
classified as a Secondary Parkway on the Thoroughfare Plan. Right of way requirements are 120'
total, 60' half. Will the additional 131 sl Street right of way be dedicated to the City with this project?
A multi-purpose path is also indicated on the Thoroughfare Plan for 131 st Street.
18. The existing sidewalk on the West Side of Pennsylvania appears to be outside of the existing right of
way. Additional right of way may be required to satisfy the multi-purpose path requirements.
19. Does this plan accommodate future right of way requirements for the over/underpass at U.S. 31, as
shown by the City of Cannel's plans to INDOT? Tlus issue is critical and shall be required to be
coordinated with this office and with the Department of Community Services.
20. Has pennission been obtained from INDOT to drain into U.S. 31 right of way?
21. The right of way pavement section should match the Pennsylvania Street pavement section.
22. Please designate if the detention is to be dry detention or wet detention. If it is to be wet, detail the
pond depth and volume.
23. On Sheet ClOl, what is the sign that is designated as being removed?
TIle above comments are based upon the Engineering Department's initial review. Please provide our
office with a follow up letter and revised plans, indicating all revisions. Second and subsequent reviews
will focus only on revised items. It is critical that our office be made aware of all modifications made on

Thank you for sharing with us your plans for the hotel to be known as Hilton Garden Inn on the five-
acre parcel in the southeast comer of US 31 (Meridian Street) and Main Street (131" Street) in the City of
Carmel.
The Indiana Department of Transportation (INDO!) is always concerned about new residential or
commercial construction along highways within the National Highway System, especially given our
interest in exploring the merits of US 31 highway improvements to address long-term transportation
demand in this area.
The year 1997 US 31 Major Investment Study (MIS) recommended upgrading the corridor to freeway
status. This implies that access will be reserved to interchanges with select crossroads. The MIS shows a
simple grade separation and no direct access between Os 31 and Main Street, with a bridge along US 31
over Main Street. As well the MIS demonstrates in this area the provisional need for additional strip
right-ot-way along both west and east sides orus 31, to a limit measuring out approximately 250 feet
from the existing highway's centerline.
YOUf construction plans for the Hilton Garden Inn call for development within the right-of~way
footprint outlined 1n the MlS, includmg a 3Q-f'oot-wide "generJl easement" llnd O.:l4S-acre stonnwater
detention pond varying in width from 60 to 90 feet. The construction plans indicate that US 311s existing
balfright-of-w&y width is 1'45 feet.
Please bear in mind that INDOT is in the midst of an active environmental impact statement (EIS). In
order to qualify for federal funding for any expansion of US 31, the Department must study the corridor

develop and evaluate alternative improvement plans. One of the sites undergoing critical teView as part

RE: Hilton Garden Inn Landscape Plans (ADLS & DP)
Dear Jim:
This parcel falls within the U.S. 31 Highway Overlay Zone and is subject to its
requirements. My comments are as follows:
1. Adjacent to parking lots, the minimum width for planting strips adjacent to
residentially zoned properties is 15 feet. The plans only show 10 foot planting
strips. They must be increased to 15 feet where the property borders residential
zomng
2. Parking lot islands are to be planted with large maturing shade trees (Cimmeron
Ash is specified). The minimum width required for shade tree planting areas is 9
feet. Parking lot islands widths must be increased to this minimum.
3. All reasonable efforts must be taken to preserve existing trees within Greenbelts,
planting strips, and perimeter buffers. Existing trees that fall within these areas
must appear on the landscape plans, and written plans are to be provided that
details the steps to be taken for their preservation.
4. The number of trees and shrubs shown does not meet the minimum requirements
for planting strips and bufferyards found in Ordinance 23B.l 0.2. Please amend
the plan to include the minimum required amount of plant material.
5. Planting detail illustrations for trees and shrubs lack several details: the plant root
balls need to be untied and the top of the wrapping material removed, plant root
flares should be placed at or slightly higher than grade, and the minimum width of
the planting excavation needs to be at least 2 times the width of the root ball of
the plant material.
6. Landscape plans need to have individual trees and shrubs labeled by species.

7. On sheet 2 of the plans submitted by Hittle Landscaping, an alternative species
needs to be chosen to replace the 17 Red Sunset Maples. This species needs to be
limited because of over planting and certain undesirable plant characteristics. The
alternative should not be a Maple species. Native Oak (except Pin Oak), Ginko,
Linden, Beech, Coffeetree, or Tuliptree are all acceptable shade tree alternatives.
8. Because of intense disease pressure in Central Indiana (fireblight, scab, rust),
many crabapple (Malus) species are not recommended. Unless a referenced
disease rating for 'Tina' and 'Snow Magic' can be provided, please chose
alternative disease resistant cultivars from the attached Indiana Urban Forestry
Council's recommended list of Crab apples. An alternative also must be chosen
for 'Profusion'. It is not be used because of known weakness to disease.
These changes need to be made in writing and by amended plan. Please contact me

Dear Jim:
This letter is in response to the applications you filed for Hilton Garden Inn. The following comments need to be
addressed and/or plans/applications updated accordingly:
Development Plan
v?
1. The primary issue is the identification of the land required to be reserved for Pending State Highway
Improvements. Please show this area on the plan and illustrate setbacks (build-to line) accordingly.
2. The required right-of-way for 13151 Street is a 60' half. Only 40' has been shown on plans.
3. The setback for parking both along 131 SI Street and Pennsylvania Street is 15' per the planting strip
requirements (23B.1O.2.B.3) where adjacent to residential uses or zones. The area to the east of the site is
zoned and used residentially. The plans illustrate a 10' strip where 15' is required.
The site is zoned B-2. Please correct the application.
The site is not a minimum of 5 acres in area. Please provide an accurate legal description of the parcel.
Due to the lack of acreage for the US 31 Overlay requirements (minimum of 5 acres) a Developmental
Standards Variance will be necessary to reduce the minimum tract size.
6. The minimum building setback from the property to the south is 15' (Chapter 23.B.8.2.B of the Land Use
Regulations) not 45' as illustrated on the plans. Please revise this line on the plans and shift the building to
the south so that it will be set back to that line. This will increase the setback from 13151 Street and provide
additional space to meet the setback once the thoroughfare plan setbacks are shown.
7. The BSL on plans along Meridian and Pennsylvania should be changed to BTL (Build-to-line). Also, the
BTL along Pennsylvania Street is 20' not 45' as labeled.
8. The BSL along 131 sl Street is 15' not 45' as illustrated on the plans.
9. Revise plans to provide one curb cut.
10. Shift the detention area out of the area to be reserved for Pending State Highway Improvements.
11. Relocate dumpster accessory building away from Meridian Street side of site.
12. Provide for pedestrian and bicycle connections between building and street.

Village of West Clay Section 3001-A Block J--------- I have spoken with Keith lash on this. I had a question on where the
access point was to Block 5 and 6. For addressing purposes, I need to know what street these will be off of. He had
mentioned to me that there was going to be a private drive between blocks 5 and 6. I told him that I we don't address off of
private drives. I told him to talk to you and Laurence abouth this at the TAC meeting. Please let me know what you both
decided on this. Right now there is no way to address these two blocks of town homes the way they are. After looking at
the project none of the buildings have accessibility from the main streets. It looks to me like the front of the buildings are all
off of the"Private streets". From a Public Safety standpoint, I would prefer they submit four additional street names, so
those townhomes can be addressed. After looking at the drawings I see no way to get to those buildings unless you turn
off onto what they want to call"private streets" The only other altenative would be for them to put some type of address
block on the rear of the buildings that back up to the main streets in that area, with the span of addresses in the building
along with the street name on it as well.
For Example for block 2: 2255-2285 ( This is what the address block could look like on rear of
GLEBE STREET Building.)
Just let me know what your expertise in this situation would be...Hopefully you and Laurance could put your heads together
and give me an idea. Thanks
Hazel Dell Corner Lot 4----- This is going to be a small strip mall, I have talked to Cort(1 believe}
on this issue. Have them make sure the Physical address is on the building or on the Monument sign if they have one.
They have been advised to use Suite letters for tenants occupying the individual spaces.
East 96th St Auto Park----Tow Wood Volkswagen-----Make sure the address is physically on the building or Monument
sign for Public Safety reasons.
Thats all I can think of at this time. Sorry about not attending, but if you would please mention these, especially the Village
of West Clay issue....lt would be greatly appreciated.

I have reviewed the plans for this project and have the following comment.
1. This project is located within the watershed of the JR Collins Regulated Drain.
Therefore, an Outlet Request Permit is required for this project.
2. Please provide the drainage calculations for this project.
3. Approval to discharge and work within the US 31 right-of-way may require INDOT
approval.

I received a call from Jon Dobosiewicz on Friday from the Department of Conununity
Services who promptly responded to my request for a meeting regarding our plans and the
compatibility of those with the thoroughfare plan of the City of Carmel. I have set a meeting with
Jon and Mike Hollibaugh to discuss this on Thursday, July 19. 2001, at 11 :00 a.m. Because Mike
is not available today, the time and date of the meeting is tentative. I think it would be important
that each of you be present as well as a representative of Sclmeider Engineering. If you have any
questions, please call. I will confirm the date and time of the appointment, however, we will be
appearing at the T AC meeting on July 18, 2001.

LETTER OF APPROVAL
The undersigned has reviewed the proposed plans for
Hilton Garden Inn
and has approved the plans subject to the following:
1. A meeting will need to be arranged to discuss the location of the Fire Department Connection.
We would prefer to see the hook-up in the parking island located east of the handicapped
parking spaces.
2. We are requesting two (2) additional fire hydrants, one located in the parking island east of the
handicapped parking area and the second hydrant located at the south entrance drive of the
project.
3. We would ask that a Knox box be installed fire department emergency access. Also we are
requesting Knox Fire Department Connection cap's for the fire department connection to prevent
tampering with the connection. An application is available from our office for these items.
4. Since the building will be four stories, a standpipe system for the each stairwell will be required.
We ask that one of the stairwells be able to access the roof and that a standpipe outlet be
supplied for that roof access.
5. We are requesting a set of sprinkler plans with hydraulic calculations and plans for a kitchen
hood suppression system are supplied to our office once they become available.
Please respond to the above noted condition(s) in writing and submit to our office prior to the
scheduled Technical Advisory Meeting for this project.

Please find enclosed for filing with the Plan Commission, a Development Plan Application and ADLS
Application of Meridian Hotel Partners, LLC, requesting approval of a full service hotel to be known as Hilton
Garden Inn on the 5 acre parcel of real estate within the 31 over-lay zone at the southeast corner of U.S. 31
and Main Street. The parcel of real estate is within the City of Carmel. I am requesting that this matter be
placed on the July 18, 2001 agenda of the Technical Advisory Committee for review, and on the September
18, 2001 agenda of the Plan Commission for public hearing, unless the August 21 meeting is available to us.
Please advise. Copies of the Plans have been mailed to the members of the Technical Advisory Committee
listed below. Signage detail will be provided prior to July 5, 2001. Following your review, should you have
