Explanation of Development Standards Variance
The applicant, Buckingham Properties Inc. (hereafter "Buckingham"), is the contract
purchaser of a parcel of real estate that is approximately 12.72 acres and is located west of and
adjacent to the Carmel High School Football Stadium and north of and adjacent to Smokey Row
Road/136th Street.
Buckingham previously obtained unanimous rezone approval for the site and the site is
currently zoned as the Arden Townhome PUD District Ordinance No. Z-482-05. Buckingham is
also currently seeking ADLS/DP approval so that it can develop a townhome project on the site.
Buckingham anticipates receiving its ADLS/DP approval from the Carmel Plan Commission on
February 21st.
The approved text of the Arden PUD Ordinance provides in Section 8.4 - Perimeter
Planting/Buffer Yard that "The number of perimeter plantings and the number of buffer yard
plantings shall be in accordance with Section 26.04 Perimeter Buffering Requirements of the
Zoning Ordinance." However, it has always been the intent of Buckingham to utilize on the
eastern portion of its site an off-site tree buffer area that exists on the adjacent School property as
its perimeter buffer yard area.
The existing off-site tree buffer area on the School property shall serve as an effective
screen and buffer between the two (2) properties. Further, pursuant to the discussions between
representatives of Buckingham and representatives of the School Board, it is Buckingham's
understanding that the School Board has no intent of clearing or removing the mature tree buffer
area that exits on the School Property. Consequently, in lieu of creating another buffer yard area
on the Arden T ownhome site, Buckingham desires to utilize the off-site tree buffer area on the
School property because it will provide for a more effective and appropriate screen between the
two (2) properties.
We look forward to presenting this matter to the BZA Hearing Officer at its February 27,
2006 meeting.
