Please accept the following as written confirmation of Plan Amendment as represented to the Special
Study Committee last Tuesday: .
1. The spruce trees to be planted adjacent to Keystone Way and North of the Keystone Way
entrance shall not be less than fifteen (IS) feet in height.
2. Two (2) to three (3) additional trees shall be planted at the southwest corner of the restaurant.
3. Alternative funures featuring down lighting and shielding will be used in lieu of the wall pak.

COMMITMENTS CONCERNING THE
USE AND DEVELOPMENT OF REAL ESTATE
The\D1dersigned, (hereinafter "Chmer"), the Lessee of the following described real estate located
in Hamilton CO\D1ty, Indiana (hereinafter "Real Estate''), makes the following Commitment Concerning
the Use and Development of Real Estate to the Carmel Plan Commission (hereinafter "Commission'')
and the City of Carmel.
1. Descriotion of Real Estate. See Exhibit "A" hereto. ("Real Estate'').
2. Docket No. 33-01 ADLS
3. Statement of Commitments.
A Chmer commits that the garden to be located on the roof of the Carrabba's
Italian Grill, shall consist solely of live plant material plU'Suant to the plan on
file with ~e Department of Community Services and shall at all times be
maintained in accordance with good horticultural practices.
4. Binding on successors and Assiens. This commitment is binding on the Owner of the
Real Estate, each subsequent Owner of the Real Estate and each other person acquiring
an interest in the Real Estate, unless modified or terminated by the Commission. This
commitment maybe modified or terminated only by a decision of the Commission made
at a public hearing after notice as provided by the rules of the Commission .
5. Effective Date. This commitment shall be effective upon the approval by the
Commission of the application filed \D1der Docket Nmnber 33-01 ADLS
6. Recordin2. The \D1dersigned hereby authorizes the Director of the Department of
Community Services or the Secretary of the Commission to record this commitment in
the Office of the Recorder of Hamilton CO\D1ty, Indiana, following the effective date.
7. Enforcement. These commitments may be enforced by the Commission
