The following outlines our responses to the TAC comment letters regarding the DP/ADLS review of the
above-referenced project. The following identifies our response or action taken to address each
comment:

1. The Developer prefers to have a single pedestrian connection to the path on Smokey
Row Road as shown on the plan. The walk extending along the west side of the
entrance road will be located along the existing gravel drive into the property and will
meander through the existing large trees. Residents on the east side of the site can
access the walk at two designated ramps/cross walk areas.
2. We will provide a fence along the northern side of the property between the trail and
the rear of Building 11.
3. The Developer attempted to address this comment by making Buildings 15 and 16
front-loading, with green space in the middle instead of the alley. However, having
front-loaded units on Rosalind Place and Bard Lane results in driveways along these
main streets, which would disrupt the sidewalk and pedestrian circulation throughout
this area of the site. The front-loaded units also have rear porches which would
encroach into the middle green space and reduce its mitigating effect. As a result, the
Developer has decided to leave the orientation of Buildings 15 and 16 as shown on
the submitted plan in order to maintain the aesthetics and pedestrian-friendly
character of the project.

fill material that may be placed in the floodplain would be for the proposed multi-use
path along the north side of Smokey Row Road. We are awaiting direction from the
Carmel Engineer's Office on the details of this path and whether or not it is to be
constructed under this project. .

Drainage Report as submitted with the Development Plans.
24. A meeting is scheduled for January 10, 2006 with Gary Duncan to discuss the design

1. We have not shown an additional landscape buffer on the east side of the property
due to the existing natural buffer of mature trees and heavy vegetation adjacent to the
east side of the property. Although this existing vegetation is not located on our
property, it is within the easement area that will be dedicated to the City of Carmel for
the Cool Creek North Trail High School extension. We are confident that this existing
buffer will remain in place, due to the fact that we will be constructing this portion of
the trail at the same time as the Arden Townhomes, and our engineer is responsible
for the design of this portion of the trail and easement area.
Section 26.04.05 of the Carmel Ordinance states that "Existing vegetation may be
used to achieve project buffering if: (a) the vegetation located upon the subject parcel
is of a quality and state of health to achieve buffering, and, (b) the vegetation is
proposed to be preserved using accepted best management practices for tree
protection during construction."

6. Given the maintenance practices of today's landscape companies and the quality of
the Arden development, these crabapple trees will most likely be heavily sheared and
shaped. Our landscape architect has advised us that most landscape trees never
reach their full size in a landscape situation, and that the final sizes of these plantings
will be suitable for the locations shown on the plan. We would therefore like to leave
this species selection as is.

Dear Mr. Shinaver:
This letter is in response to your secondary plat application for Arden Townhomes. Comments
and concerns are as follow:
1. A connection is not provided for the townhomes on the east side of the project to
the proposed walkway on Smokey Row Road. Please add a connecting walkway.
2. There is no buffering or tree preservation shown on the north end of the project.
Please indicate if a fence or other buffering will be provided.
3. Twelve of the townhomes are shown to be surrounded by private streets and
alleys. Staff would prefer to see some mitigating green space for these units. This
may be accomplished by making the units front-loading, and providing green
space in the middle, rather than an alley.
Please wait to submit revised materials until after the Technical Advisory Committee (T AC) has
met on this application. The resubmitted materials should include edits addressing the above
comments along with any requirements that arise from the T AC meeting. Additional comments
may be made after the requested revisions have been submitted.

Dear Rich:
These are my TAC comments for Arden Townhomes PUD landscape and tree preservation plans:
1. It appears there is no landscape buffer on the east side of the property, the existing woods that are to be
preserved on the east side and the path to be installed is actually on Carmel High School's property. This
does not meet the required buffer yard ordinance (Section 26.04).
2. I do not recommend using Washington hawthorns near paths, sidewalks and roadways. Please choose an
alternative species such as tri-color beech, yellowwood, American smoke tree or hornbeam.
3. There are 44 Imperial honey locust trees in the allee along Arden Place. Normally, those numbers are not
allowed for species diversity reasons. I will allow this for design purposes, but the maintenance will
increase because those numbers of the same trees will attract pest species.
4. There are 33 maples trees on the plan. Please choose an alternative for either the Pacific Sunset maples
or the 'Green Mountain' variety such as Kentucky coffee tree, London plane tree, Ginkgo, or sugarberry
tree.
5. On the outside of the private alleyways and near the buildings built near preserved trees, the roots should
be cut with a sharp blade such as a trencher before the tree preservation fence is installed. This will allow
the roots of existing trees to regenerate. If the roots are disturbed, compacted, or mangled by earthmoving
equipment, they will be injured and probably die back to the trunk, resulting in the possibility of die back
and wind throw.
6. Crabapple species (Malus) 'Coral bust', 'Camelot', and 'David' are 10', 8', and 15' wide respectively. These
short wide growing trees seem to be the wrong shape for long term maintenance between driveways and
in narrow areas adjacent to sidewalks. Please choose an alternative taller narrow growing species, such
as single stem river birch, 'Ivory Silk' tree lilacs, tri-color beech, hornbeam or hop hornbeam.
Please reply to these comments in writing and by amended plans. Please contact me if there are any questions.

design engineer must certify all drawings submitted for final approval. This office will require a
minimum of five-sets (maximum of seven-sets) of approved drawings after all issues have been
resolved The drawings will be stamped approved and signed by both the City Engineer and Director
Carmel Utilities. The Developer/Owner will receive one-set which is to be maintained on the
construction site at all times. Carmel Utilities will receive two-sets. Our Construction Manager will
receive one-set and one-set will be maintained in the Department of Engineering. Ifmore than the
minimum of five-sets are requested to be approved, the additional sets (maximum total of two
additional) must be submitted with the five required sets.
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
easements and/or right of way will require Consent to Encroach approval.
6. Carmel Utilities does not subscnbe to "Holey Moley" and should be contacted directly for all water
and sanitary sewer main locations.

Maintenance Guarantees will be required.
Street CutlRight of Way Permit and Bonding Requirements
Any work in the dedicated right of way ofSmokey Row Road/136th Street will require a Right of Way
Permit. If the work in the right of way is not included in a Performance Bond, a separate License and
Permit Bond will be required. the bond amount will be detennined by the number of instances of
w:ork in the right of way @ $2,000.00 per instance. Open pavement cuts in dedicated streets require
approval by our Board of Public Works and Safety. Please contact our Right of Way Manager, Fred
Glaser, to arrange permitting and bonding.
10. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations
submitted to this office for review. We will share Crossroad's comments as they are received.

AVAILABILITY AND CONNECTION FEES
11. Availability (acreage) Fees must be paid after all other Engineering Department requirements
have been satisfied and prior to the start of construction activities. Availability Fees are based
upon total platted acreage or upon the total acreage as stated on a legal description of the property.
Current Availability (acreage) Fees are $l,01O.00/acre for water and $I,365.00/acre for sanitary
sewers.
Connection Fees - In order to calculate Connection Fees for this development, detailed usage
information is required. It appears that this is a townhome or condominium project. Please
provide this office with a detailed listing of buildings, units per building and bedrooms per unit.
Current Connection Fees are $1,310.00 per BOU for water and $795.00 per EDU for sanitary
sewer. I am enclosing Average User Factor Sheets for water and for sanitary sewers.

25. Thank you for indicating a 10-foot asphalt multi-use path along SmokeyRow Road. As we have
discussed, we will provide direction as to the final alignment of this path within the right-of-way.

These comments represent the Department of Engineering's initial review of the development plan/primary
plat of this project. We request that all responses to our comments be provided in writing. Failure to
provide written responses may result in the delay of the review process.
It is critical that our office be made aware of all modifications made on any plans being re-submitted,
particularly if any such changes are considered "new" or fall outside of our previous reviews. Please

The following are natural resource comments or concerns in regard to this project:
The Oakley and Fox terrace soils are well drained with sand and gravel 3'-4' below the surface. Stonnwater basins should
be constructed as dry ponds to prevent future failures of installed liners and large costs to the homeowners to fix a
problem. Exposed sands and gravels will need to be covered with adequate soil for good plant growth. The Sleeth loam
has seasonal high water table, high potential frost action, moderate permeability in the subsoil and rapid permeability in
the substratum. The Genesee and Shoals soils are flood plain soils and will remain largely undisturbed except for pond
#3. This pond will require a liner or the water level will fluctuate with the water table.
The development plan appropriately keeps most of the improvements out of the flood plain.
Pond #3 is not recommended. The pond will need to be lined to maintain a static permanent pool level. Liners can fail
and impose a significant financial burden on the homeowners. When flooding occurs the pond will also collect debris and
sediment from the flood waters. This will significantly shorten its useful life span and incur higher costs for maintenance.
I don't believe the future homeowners should be burdened with these future obligations that substantially exceed those of
similar developments.
A 30 feet wide riparian easement is recommended along Cool Creek.
The project will need to consider the new ordinances for post construction water quality.
Hard surface could be minimi7.ed by having only one street providing access to the townhomes. Many of these homes
have streets on the front and the back.

These are my TAC comments for Arden Townhomes PUD landscape and tree preservation plans:
1. It appears there is no landscape buffer on the east side of the property, the existing woods that are to be
preserved on the east side and the path to be installed is actually on Carmel High School's property. This
does not meet the required buffer yard ordinance (Section 26.04).
2. I do not recommend using Washington hawthorns near paths, sidewalks and roadways. Please choose an
alternative species such as tri-color beech, yellowwood, American smoke tree or hornbeam.
3. There are 44 Imperial honey locust trees in the allee along Arden Place. Normally, those numbers are not
allowed for species diversity reasons. I will allow this for design purposes, but the maintenance will
increase because those numbers of the same trees will attract pest species.
4. There are 33 maples trees on the plan. Please choose an alternative for either the Pacific Sunset maples
or the 'Green Mountain' variety such as Kentucky coffee tree, London plane tree, Ginkgo, or sugarberry
tree.
5. On the outside of the private alleyways and near the buildings built near preserved trees, the roots should
be cut with a sharp blade such as a trencher before the tree preservation fence is installed. This will allow
the roots of existing trees to regenerate. If the roots are disturbed, compacted, or mangled by earthmoving
equipment, they will be injured and probably die back to the trunk, resulting in the possibility of die back
and wind throw.
6. Crabapple species (Malus) 'Coralbust', 'Camelot', and 'David' are 10', 8', and 15' wide respectively. These
short wide growing trees seem to be the wrong shape for long term maintenance between driveways and
in narrow areas adjacent to sidewalks. Please choose an alternative taller narrow growing species, such
as single stem river birch, 'Ivory Silk' tree lilacs, tri-color beech, hornbeam or hop hornbeam.
Please reply to these comments in writing and by amended plans. Please contact me if there are any questions.

Dear Mr. Kelly:
We have reviewed the primary plat submitted to the Hamilton County Svrveyor's Office on
December 1, 2005 for this project and have the following comments:
1. The proposed project falls in the inCOIpOIated limits of the City ofCBID1el
2. The proposed project DOES fall in a Carmel Wellhead Proteetion Zone.
3. This proposed project does not fall in a regulated drain watershed.
4. Do to up-stream drainage problems on Little Cool Creek and Cool Creek being a
regulated drain upstream, the Hamllton County Surveyor's Office would ask that
a petition to make Cool Creek a regulated drain across this project be executed.
This would allow us to maintain the drain and keep the tlow moving though the
creek. We will grant reduction of the statutory regulated dmin easement and
support encroachments that are part of this proposed project.
5. Please coordinate the storm system design with both the Hamilton County
Surveyor's Office and the City of Carmel Engineering Department.
6. The Cool Creek Watershed Management PlBDt that was ajoint study done by
HCSO, City of Camtel, and the Town of Westfield, recommends against ANY

Joss of floodplain for Cool Creek. Will any floodplain volume be lost to this
development? If so, compensatory storage wUI be strongly recommended.
7. The Watershed Management Plan also recommends that any debris or flowline
abstraction need to be removed. HCSO would recommend that a general stream
cleanup be considered with this project. This cleanup should involve debris,
flowline obstructions, and any possible obstmction in the floodplain (dead/dying
trees and any deadfall on the ground).
8. The HCSa would also recommend that any major erosion area be looked at and
repaired. The management plan shows areas ofminor and major erosion just
downstream oftbis site and this area should be looked at also.
9. A copy of the approved IDNR Construetion in a Floodway Pennit should be
submitted to HCSO, O~ received.
10. Although the HamUton County Surveyor's Office has reviewed this primary plat
and issued a comment letter. this office will not be limited by the primary plat in
regards to the pond sizes or katicm. drainage easement widths, storm sewer
locations. lot layout. landscape layout, or any other drainage related i881le8.
1nsufticJeot iDfounation is presented to conduct a complete drainage review and
changes may be required during the construction pluming stage.

As you know, the Arden Rezone Pending under Docket Number 0505004Z and
Ordinance Number Z482-05 is currently before the Common Council for final review and
approval. In anticipation of a possible approval of the rezone, we are filing the enclosed
applications for ADLS, Development Plan, Plat Approval. If the rezone is approved, you can
obtain from the Clerk-Treasurer's Office the final and approved PUD ordinance which will
govern the development of this project.
The engineers will mail directly to the T AC agencies in your office, the plans required for
the tax submittal. Please be sure that this matter is placed on the T AC Agenda and provide me a
Nelson & Frankenberger U.
