Explanation of Variance ReQuests

1. The Apvlicant is seeking a variance from Chapter 23C.12(B). This Chapter establishes
the maximum height requirements for pole lights in the US 421 Michigan Road Overlay.
This Chapter provides that pole lights shall not exceed 24 feet in height. The Applicant is
requesting permission to construct parking lot pole lights that will be 33 feet in height.
The Gateway Pavilion is within both the City of Carmel's zoning jurisdiction and the
Town of Zionsville's zoning jurisdiction. All of the proposed parking lot pole lights to be
situated within the Town of Zionsville's jurisdiction will be 33 feet in height. For
consistency and continuity of the overall Gateway Pavilion development, the Applicant is
seeking to vary Carmel's pole light height requirement :from 24 feet to 33 feet so that all
parking lot pole lights will be a consistent and uniform size.
.f.. The Applicant is seeking a variance :from Chapter 23C.12(C). This Chapter requires that
site lighting shall not cause illumination beyond any non-residential tract or parcel line or
road right of way line in excess of 0.3 footcandle of light. The Gateway Pavilion Project
is located within both the City of Carmel's zoning jurisdiction and the Town of
Zionsville's zoning jurisdiction. The standards for similar site lighting in the Town of
Zionsville require 1.0 footcandle of light in the right of way. For consistency and
continuity of the overall Gateway Pavilion development, the Applicant is seeking a
variance :from the City of Carmel's footcandle lighting requirement to that of Zionsville' s
footcandle lighting requirement of 1.0 footcandle.
.2.. The Applicant is seeking a variance :from Chapter 25.07.02-11. This Chapter pertains to
Center Identification Ground Signs within a Multi Tenant Building Complex. The
Applicant is requesting a variance :from the height, IOcaUSIi, lalldscllpiftg and square.
footage size requirements for the Center Identification Ground Sign for the Gateway
Pavilion project pursuant to the associated plans and drawings that have been filed with
this Application.
~. The Aoolicant is seeking a variance :from Chapter 25.07.01-04 (i). This Chapter
prohibits locating signs within right of ways. The Applicant is proposing to construct the
Center Identification Ground Sign for the Gateway Pavilion in the right of way based on

for a more uniform and consistent lighting scheme for the Gateway Pavilion and there are
only a few parking lot pole lights that are located within the City of Carmel's zoning
jurisdiction. Providing consistency in the height of the parking lot pole lights in the
overall Gateway Pavilion will not be injurious to the public health, safety, morals, and
general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because a majority of the Gateway Pavilion is
located within the Town of Zionsville' s zoning jurisdiction and the parking lot pole lights
located on that portion of the site are permitted to be 33 feet in height. The Applicant is
requesting permission for the few parking lot pole lights located within the City of
Carmel's zoning jurisdiction to be consistent in height to the parking lot pole lights
located within the Town of Zionsville's jurisdiction. Providing for such consistency in
the height of the parking lot pole lights should not have an adverse impact on the value of
the adjacent properties.
3. The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because the parking lot pole lights for the
Gateway Pavilion would not be a uniform and consistent height.
DECISION

OWNER'S CONSENT AND JOINDER IN PETITIONS
The undersigned, being the owner of the real estate described in what is attached hereto
and incorporated herein by reference as Exhibit "A" (the "Real Estate") hereby authorize and
directs Heritage RDG, LLC, a Delaware limited liability company ("Heritage"), along with its
employees, engineers, land planners, attorneys, and appointed agents, as follows:
1. To file, for and on behalf of the undersigned, any and all applications and petitions
necessary to obtain all approvals c;leemed necessary by Heritage with respect to the Real
Estate including, without limitation, (i) primary plat approval per the terms of the Zoning
Ordinance for the City of Carmel (hereafter "Plat Application"), and (ii) any development
standards variances pursuant to the Zoning Ordinance for the City of Carmel deemed
necessary by Heritage to further develop the Real Estate per the terms of the Plat
Application (collectively the "Approvals"); and
2. To represent the undersigned in connection with the Approvals, before the City of Carmel
Plan Commission and Board of Zoning Appeals, and to file, for and on behalf of the
undersigned, all applications and petitions deemed necessary by Heritage to obtain the
Approvals.
3. The undersigned, being duly sworn, depose and say that they are the owners of the Real
Estate and that the foregoing signatures, statements, and answers herein contained and the
information herewith submitted are in all respects true and correct to the best of the
undersigned's knowledge and belief.
Further to this Owner's Consent and Joinder in Petitions, the undersigned acknowledge
that this Owner's Consent and Joinder in Petitions shall constitute the execution by the
undersigned of all such Petitions flied by Heritage, now or in the future, in furtherance of the
Approvals.
