IN 46032 .RE: Carrabba's Italian Grill Dear Ion: You and I talked briefly last week about Carrabba's, and the revision of their plans to reduce the size of the trash collection area in order to meet the front yard set back tom Keystone Way. When I received the call from Laurence, I immediately requested that Carrabba's obaoge their plans in order that they could immediately obtain a building permit. They have now determined that they would like to have the trash area as approved by the Plan Commission. The trash collection area is not roofed, and simply represents a wall extension from the building enclosing the dumpsters. Based on our conversation, I was wondering ifin fact this would be considered a structure and not permitted in the front yard. I would appreciate your thoughts on this before Carrabba's incurs the cost, time, etc. to obtain or to request the variance. I would appreciate your caI~ and thanks for your help. We apologize for the delay in our response. Item numbers used correspond to our original comment letter and your response letter. BONDING REQUIREMENTS Item #10 - We still require a Certified Engineer's Estimate for 100% of the cost oflabor and materials for the installation of the required sidewalk in dedicated right of way. A Performance Guarantee is required in the amount of the Engineer's Estimate. There does not appear to be work in the right of way that would require a permit and bond. PROJECT COMMENTS Item #13 - Identify Keystone Way East on survey sheet. Item #14 - Board approval is not necessary for the crosswalks. However, the crosswalks must be approved by this office based upon the following criteria: . If stop bars are existing, crosswalks (not "access aisle") shall be located 4-feet beyond stop bar and according to standard crosswalk markings per Indiana Manual on Uniform Traffic Control Devices (MUTCD). . Sidewalk/handicap ramps should be installed at crosswalk locations. . If there are no stop bars, they must be installed at the time of crosswalks, again, according to MUTCD. . In regard to crosswalks, are the lines at the intersection on the survey and all remaining sheets intended to indicate stop bars? We still do not see right of way lines identified or dimensioned. Does tllis drawing reflect the correct right of way resulting from the recent vacation and dedication of right of way associated with Merchant's Square? Label right of way and all easements on Site Plan (C2). Item #15 - . Please show curb line elevations at curb cuts to verify cross-slopes, and tllat drainage will be captured into inlets, not out and into streets. . Last piece of storm pipe (15") goes across adjacent property. Who owns tllis? Does an easement exist or is it needed? . Please show existing structures and manllOles at existing structure 27. In response to a question raised at the Plan Commission meeting, please find enclosed a Commitment Concerning Use And Development Of Real Estate which has been forwarded to Carrabba's for signature. A representative ofCarrabba's will be bringing a signed copy of the Commitment to the Special Study Committee on June 5, 2001. The commitment confirms that all plant material to be installed in the roof garden will be live plant material. In addition, as briefly mentioned at the Plan Commission meeting Gary Linder as the owner of Merchant's Square is not selling the site to Carrabba's, but is in fact leasing the real estate to Carrabba's on which they will construct the restaurant. As a result under the lease agreement, Mr. Linder maintains substantial control over the property and should the building be abandoned or left vacant, the recapture provisions of the lease provide Mr. Gary Linder with the opportunity to resume possession of the property for re-letting and maintenance purposes. As you are aware, this means that we are leasing the ground and the tenant will build their building at their cost. Secondly I the ground cannot be used liS collateral for their loan for the building. Thank you for letting me know that the _ additional material I requested is on the way. It would also be nice to have a cross section detail of the planting media/soil that shows how it is constructed. My comments on the revised plans are as follows: 1. The tree preservation detail on page C1 is good. But the installation of the fence on the plan appears to be only 2% feet from the base of the trees to be preserved along the north property perimeter. That is certainly not to their 'dripline' as the detail suggests, and not enough room to prevent potentially lethal damage to those tree root systems. With the construction of the building about 15 feet away, and the installation of a 6" sewer lateral and the fire/siamese water lines between the two, more intensive measures will have to be taken to effectively preserve those trees. A written tree preservation plan should be submitted that includes details to taken that are adequate to preserve those trees. 2. I would be glad to meet you onsite to inspect the site and trees for preservation efforts. I would suggest the utilities along that side of that building be laid in the same trench, and be as close to the building as possible. The trees should be root pruned before construction begins to ensure regrowth of the root systems is possible. Root pruning needs to be done with a sharp cutting instrument so roots can regenerate. It needs to be done with adequate clearance so as not to affect the vegetative heath or structure of the trees. . Page 1 u u u o ... .. 3. Due to the unusual nature of the rooftop garden, there is still additional information needed to adequately review this project. This includes landscape plans for the garden to include species, size, number, and position of all plant material, and the number, size, and position of all drainage, irrigation, and electrical structures. Details on the method and structUres used for anchoring plants and equipment, soil media specifications, and maintenance plans for plant material and mechanical structures arealso needed. Total weight estimations also need to be addressed. 2. Greenbelt/buffering plantings need to be planted on the entire length of the Keystone Avenue frontage. 3. A tree preservation plan needs to be submitted for the protection/preservation of existing plant material on the site, arid adjacent to it. Some ofthe plant material is currently dead or dying. These plants will have to be replaced before the final site inspection. If plants are going to be moved and stored temporarily, a plan must be submitted to this office that details their care and maintenance during and after construction. Species recommendations: Pinus nigra (Austrian Pine) is not recommended for planting in this area due to disease and insect pressures. An alternative evergreen species should be selected. 'Profusion' and 'Indian Summer' are not recommended species due to disease susceptibility in this area Gleditsia tricanthos (Honey Locust) is the only shade tree shown on the plans. Please choose an alternative species for at least four trees. 5. The planting notes need to indicate that all stakes and guy wires need to be removed from all trees within one year. ARTICLE IX Common Areas and Tenant's Property Section 9.01. Common Areas. The "Common Area" is that part of the Shopping Center outside of Ten ant's Maintenance Improvements designated by Landlord from time to time for the common use of all tenants and owners, including among other facilities, parking areas, drive lanes, sidewalks, landscaping, curbs, private streets and other areas and improvements provided by Landlord for the common use of all tenants and owners, all of which shall be subject to Landlord's sole management and control and shall be operated and maintained by Landlord in a manner consistent with other similarly situated shopping centers in the Indianapolis. Indiana area. In addition to the Demised Premises, during the term of this Lease, Tenant shall have a non-exclusive right and easement to use in common with others authorized or-designated by Landlord all Common Areas, subject however to the terms and conditions hereof and to reasonable rules and regulations for the use thereofprescribed by Landlord from time to time. Landlord further grants to Tenant a non-exclusive right and easement over that portion of the Shopping Center as may be required by Tenant to construct, renovate and improve the Demised Premises. Landlord reserves the right to modify and change the Common Area from time to time; provided, however. Section 9.02. Maintenance. A. Landlord shall operate, repair and maintain or cause to be operated, repaired and maintained all Common Areas of the Shopping Center, including the Common Areas on the Land. Landlord shall keep and continuously maintain all Common Areas of the Shopping Center (including the Common Areas on the Land) in a fust-class state of repair similar to comparable shopping centers in the Indianapolis, Indiana area (the "Common Area Maintenance"). Landlord's obligations hereunder with regard to Common Area Maintenance $hall include, but not be limited to: maintenance, repair and replacement required to clean, preserve and maintain the Common Area; lighting facilities serving the Common Area; policing and traffic direction; security protection; ice and snow removal; removal of trash. rubbish and debris; public liability, workers' compensation, property damage and hazard insurance. All parking areas shall be restriped and completely resurfaced as required. All Common Area Maintenance performed on the Land and Development Area shall be done in a manner to minimize interference with Tenallt's business operations and to the extent commercially reasonable during times when Tenant is not open for business.
