The applicant seeks the following development standards variance approval: 3. Docket No. PZ-2022-00028 V UDO Section 2.06 Minimum 20-ft side/rear setback required, 16.5-ft requested. The site is located at 14458 Smickle Lane (Cherry Tree Grove Subdivision Lot 12) and is zoned S2/Residence. Filed by Kara DeLong of KD Landscaping Inc. on behalf of Aaron & Helen Bernie, owners. General Info & Analysis: The Petitioner seeks approval for an elevated deck addition to the rear of the house. This lot is a corner lot with two street frontages. The elevated deck will sit around 4-ft off the ground. The rear yard building setbacks for the neighborhood are 20-ft, and the Petitioner requests a deck setback of 16-ft from the west property line. The deck will not encroach into the existing 15-ft wide drainage/utility/sewer easement that runs along the west property line (rear yard). The Homeowners Association (HOA) approval has been granted. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2022-00028 V, and with adoption of the findings of fact submitted by the Petitioner.
