You were next on my list to call. I hope that we can resolve some of these construction and tree preservation issues with Mr. Roehling in Brighton Woods. You are correct in some of the facts of the situation: the subdivision was platted some time ago (under the precursor to the current ordinance), but significant tree preservation areas are on the plat (50' on the rear of most lots on the west side). Mr, Roehling had certain tree preservation commitments in the covenants and restrictions, and then in May of 2004, he sent the Department a commitment letter as part of the resolution of his then current problems with tree preservation. His letter agreed to keep building materials and large equipment out of the 50-foot rear easement as he built on plats with tree preservation easements, Also agreed was to put up a tree preservation fence except for a small opening and to allow only workers with hand tools to affect the preservation easement Now on lot 26 there is no fence, but there is 10-12' of soil piled around mature trees in the tree preservation easement The soil and the resulting compaction of the yard will begin to kill the trees, and efforts to remove the soil with heavy equipment will injure the root systems of those trees further Hence the stop work order because Mr. Roehling did not live up to the commitments he made in 2004. I have included a picture of the site. I am free for about an hour tomorrow morning at 11 :00 and on Friday after 1 :30pm. Let me know which works for your schedule. We will implement the following policies: I) All lumber, roofing, brick, window well timbers, etc. will be staged from the rear. corner of the homes (outside the preservation area). No teladines will be allowed in the SO foot easement or the placement of skids or bunks of material. Materials will be hand carried or wheel barreled to the rear work areas of the home. 2) Carpenters and other trades will be allowed to set up work benches, scaffolds and cut tables in the SO foot easement, however they will be requested to keep work areas in the future patio area or away from the drip lines of trees when ever possible. 3) Your department will be contacted prior to the clearing of any future lots along the preservation area. We will meet on. site to determine which trees should be preserved and which trees should be removed using the Brighton Woods Coyenant Restrictions as our guide. 4) Once the trees are cleared we.will place a plastic fence at the rear comers of the home with only a 5 foot opening for foot traffic. In addition we will pl~ce a plastic fence in the rear yard at 15 foot maximum "Patio" line to keep foot traffic out of the majority of the rear y.jrd. The Owners of these Lots hereby accept the following conditions: The rear yards of all lots that abut Nortbwood Hills shall contain a fifty-foot deep tree preservation area ("Preservation Area"). Owners of these Lots may clear underbrush and thin dead trees, but may not remove hardwood trees that are four inches (4 It) or larger in diameter from the preservation area unless they are unsound, diseased or the root system would be so severely damaged fro the construction of the residence that the tree would be unlikely to survive.. No home foundation may extend into this area except that decks, window wells, patios and open-air porches may extend a maximum of fifteen feet (15') into the Preservation Area. 6. Roadwavs. (a) Maintenance. Declarant shall maintain each Roadway in good condition satisfactory for the purpose for which it was constructed until the Roadway has been accepted a$ a public roadway. (b) Landscaoine. Construction of Residences. (a) Land Use.
