Dear Scott:
I would like to take this opportunity to comment on your letter to Brant Kercheval dated
April 9, 2001 so that perhaps we can address some of your comments prior to our scheduled
meeting this Wednesday. My response to your ten (10) comments are as follows:
1 . The revised landscape plans, which we already filed, show the required plant
material.
2. At this point, we do not know what the final road design will be for this
intersection. Once that is determined, we will amend the landscape plan to meet
the required 30-foot minimum width. The PUD Ordinance allows the Director to
approve such minor changes to the plan.
3. 'We are preparing the required plan and hope to have it completed for our
Wednesday meeting. Please note that there is not a tree preservation
requirement in the PUD Ordinance. Also, please note that the existing trees
along Spring Mill and 96th Street in the Office Area are not located in the required
30-foot greenbelt area, they are located within the new rights-of-way and are thus
not subject to this requirement.
4. We have provided a landscape schedule on the revised landscape plan
enclosed. Please note that neither the Commission's Buffer Yard Guidelines nor
the U.S. 31 Overlay requirements have any bearing on what we are required to
do. The PUD Ordinance controls this site. The 5/3/15 requirement is only a
requirement for the required planting strips, not for the required greenbelts.
5. The Tree and Foundation Greenspace Exhibits enclosed with this letter show:
a. There are 24 trees per parking acre;
b. 25.79% of the total area is landscaped; and,

c. We exceed the foundation planting requirement for each building. We
have also included a foundation planting calculation for the parking
plazas, even though not required to do so.
6. We will show this on the revised plan on Wednesday.
7. We have shown these on the revised landscape plan enclosed.
8. We have had success with these species at the existing Parkwood development
and plan to continue this landscape theme at Parkwood West.
9. As part of the Contractor's Scope of Work, the supplementation of soils within the
backfill of all plant materials will be a part of the Parkwood West landscape
contract. The Scope will include mixing pulverized topsoil, fertilizer, and existing
tilled soil into the backfill of all plant materials installed at the Parkwood West
project.
The interior planting area requirements in the PUD Ordinance (9 feet wide for
canopy trees) applies only to a "planting area and planting median," not a plaza
area. In the plaza areas, we plan to use 5' x 5' tree grates.
100 The PUD Ordinance does not require an oft-site reforestation project. It has
been made perfectly clear from day one of this zoning process that it will be
"difficult to preserve existing trees on the interior of the site."
I look forward to resolving any other remaining landscape issues on Wednesday.

RE: Parkwood Crossing West Landscape Plan Review
Dear Brant:
Since I had not received a set of plans, Laurence Lillig forwarded a set to me for ADLS
review after the March 21,2001, TAC meeting, and my comments are as follows:
1. A greenbelt/planting strip is required adjacent to the INDOT right-of-way
along the north side of this property. It is my understanding that this planting
strip has been reduced to 10 feet because additional land was required by
INDOT for increased ROW. This area must still be planted with 3 shade
trees, 5 ornamental or evergreen trees, and 15 shrubs per 100 linear feet.
There are no plantings shown in this area on the landscape plans. Please
revise the plans to show the required plant material.
2. The plans show an approximately 100-foot section ofthe required greenbelt
along 96th Street Gust east of the roundabout approach) that does not meet the
required 30-foot minimum width.
3. The PUD Ordinance requires that all existing 9" DBH trees located in
greenbelts and planting strips be delineated by size, location, and description.
Contrary to your letter of October 31, 2000, there does appear to be trees
located in the greenbelt along Spring Mill Road and along 96th Street. There
is a tree preservation requirement for these trees. Please submit the required
delineation report for all existing trees found in greenbelts and planting strips
including those adjacent to the out-lot areas. Your letter of October 18,2000,
indicated that a woodland evaluation and tree preservation plan was being
produced. Those reports should also be submitted to this department. The
existing trees on site do have a highly positive value for the development and
the surrounding neighbors.

4. Also included in your letter of October 18, 2000, was the statement, "The
staffs concern with including a landscape planting schedule as part of the
submission for PUD was determined to not be needed at this stage, but will be
in place for ADLS. Required plantings within greenbelts was acknowledged
by the. staff and will be addressed in the planting schedule as it is produced
and it will combine native tree species and evergreens." The current plant
schedule is not complete. The amount of plant material in the greenbelts does
not meet the Commission's Bufferyard Guidelines or the U.S. 31 Overlay
requirements. For instance, the Bufferyard Guidelines require 5 shade trees,
5 ornamentals, and 27 shrubs (or 9 evergreens) to be planted per 100 linear
feet. The Overlay requires a lesser amount, 5 shade trees, 3 ornamentals, and
15 shrubs (or 3 evergreens), which for greenbelt along 96th Street in front of
the Office area would require 57.5 shade trees, 34.5 ornamental trees, and
34.5 evergreens, totaling 126.5 trees. The current plans show 75 evergreens,
10 shade trees, and 7 ornamentals in this area for a total of92 trees or 34.5
trees short of the lesser requirement. Enough trees need to be added to at least
meet the least requirement for greenbelts/buffering.
5. Please show numerically and by plan that these requirements have been met:
A. There are 18 trees per acre of parking area.
B. 15% of the total area is landscaped
C. The required square footage of foundation plantings has been met.
6. The plant schedule needs to include numbers of species.
7. Planting Notes: number 14 needs to include a phrase that indicates that all
stakes and guy wires must be removed within one year. Number 6 needs to
change the year of the reference edition to 1996.
8. Species selection: Austrian Pines are not recommended for planting in this
geographic area due to soil stresses and subsequent insect and disease
pressure. An alternative evergreen species (other than Pine) should be chosen.
Red Maples are weak, shallow rooting trees subject to a number of problems
including bark injury, canker, and poor branching habit. They will be subject
to poor health and vigor ifused in stressed situations such as planting boxes.
A better alternative should be chosen for trees in the plaza area.
9. As suggested before, I would highly recommend using constructed or
engineered soils in the plaza areas. They will compact to building
requirements so that paving materials maybe laid over them, yet retain enough
pore space for tree root growth and vigor. These soils also appear at the same
time to reduce pavement and curb conflicts, and reduce the buckling of
hardscape features by root heave. Plans currently show Red Maples planted

in colored concrete in the plaza area. If these trees are to be installed in
planting structures, details of the structures and planting details must be
included on the plans and submitted to this office for review. Planting boxes
or structures must comply with the minimum widths required for interior
planting areas (i.e., 9 feet by 9 feet minimum required for shade trees).
1 O. Your letter of October 18, 2000, also states, "... the proposed layout of the
site, given all the other constraints, will make it difficult to preserve existing
trees on the interior ofthe site, most of which are located in the out-lot area."
The woodland on the out-lot appears to be approximately 4-5 acres which will
be removed during grading of the site. Since this large area of trees will be
completely removed, and can not be replaced on site, an off-site reforestation
project would seem to be appropriate to mediate this permanent loss of
woodlands in Clay Township. I can provide recommendations for
reforestation depending the amount of woodlands affected. The Carmel Clay
Parks and Recreation Department has worked with several developers to
provide opportunities for such projects.

I think Blair filed an amended petition to correct the square footage and parking numbers. Can we get a Docket Number
now???
Also, The plans are being amended to correct the other items we talked about. Note that the trees shown in the colored
concrete are to be in grated tree wells and a foot-note will be added to reflect this. The sidewalk ramp system is shown on
sheet C201 and indicated by note "v". Did you decide that the "peninsulas" on the parking perimeter are not "islands", thus
we are O.K. there? One last thing. Regarding the screening of mechanical equipment, we think it was never intended that
"utilities" to serve the development would be included in the definition of mechanical equipment - which is not defined in
the ordinance. If you take the position that electrical transformers need to be screened by this standard, then what
prevents someone from saying that the fire hydrants also need to be screened? I don't think we want to go there. It seems
to me that landscaping around the pads makes the most sense and the "mechanical equipment" should be the cooling
towers or whatever they call them and whatever else they normally put up in the penthouse to run the building. If they for
some reason put any of that on the ground, the ordinance requires that they screen it there the same as they have to on
top of the building. This makes the most sense. Right? Let me know what you think.

adopted a declaratory resolution for the creation of an economic development area for all
of Parkwood Crossing_ Since that time various actions required by the Redevelopment
Statute have occurred. Most recently. on March 14, 2001, the Commission acted to adopt
a confinnatory resolution confinning the declaratory resolution of January 10, 2001. As
provided in the Redevelopment SWUte, we will be appealing said action of the
Commission within the 10 day statutory appeal period.
Al IC 36-7.14-17(b) the Redevelopment Statute provides that Carmel is barred
from taking virtually any action on matters concerning Parkwood Crossing Wltil the final
resolution of the Commission action is achieved. It has nonetheless come 10 our attemion
that various Cannel staff members may have received and/or acted upon various
Parkwood Crossing matters during the past months and weeks. Possibly most
significantly, we understand that an ADLS meeting is scheduled for tomorrow moming,
Wednesday, March 21, 20011 concerning a Parkwood West proposal. We believe that
such actions are illegal and have occurred in violation of the Slanllory stay.

Duke-Weeks has made a submission to DOCS for the ADLS approval for Parkwood
West. The submission was reponedly first made in mid-February and supplemented in
early March. As you know, the ADLS review regards the architectural. landscaping and
general aesthetic review of a project.. We have been advised by DOCS staff that the
process for the ADLS approval is as foHows:
1. Staff review of submitted plans before and at a scheduled Technical Advisory
Committee ("T AC"). At the T AC meeting the staff provide the applicant with
their comments on the aesthetic design features of the submission.
2. With knowledge of the T AC comments, the submission is placed on the Plan
Commission agenda (as a non-public hearing item) and is presented to the same.
Currently, the Parkwood West submission (apparently made first in mid-February and
then supplemented in early March) is scheduled for its T AC meeting on March 21 at
9:30am. The project is then planned to go to the Plan Commission in April.
The City's receipt and review of the ADLS submission is improper and must be barred.
Indeed, the City should be informed that they have been under a stay from taking
vinually ANY action on submissions for any of all of Parkwood Crossing (not just
Parkwood West) due to IC 37-7-14-17(b). In relevant part, said section reads as follows:
The unit's plan commission, board of zoning appeal, works board, parks board
and building commissioner, and any other departments, agencies, or officers of
the unit having to do with unit planning, variances from zoning ordinances, land
use, or the issuance of building permits. . . . [s)hall take notice of the pendency of
the [Redevelopment Commission] hearing and. until the [Redevelopment]
Commission confirms, modifies and confinns. rescinds the [declaratory]
resolution, or the confirmation of the [ declaratory] resolution is set aside on
appeal, may not;
(J) authorize any construction on propeny or sewers in the area described
in the [declaratory] resolution. . . .

(2) take any action regarding the zoning or rezoning of property, or the
opening, closing, or improvement of streets, alleys or boulevards in the
area described in the [declaratory] resolution.
This statute provides that the City cannot issue any permits for sewer work or take any
action to even review submissions which regard the zoning (or rezoning) of property or
the improvement of any street. There may be room for disagreement as to the meaning of
the word "zoning" in the above provision. However, given that the word "rezoning" is
also used it is logical to interpret "zoning" to mean more than a rezoning petition. That
is, as used above, zoning likely refers to any land use matter (development plans,
variances, etc.). In any event, the ADLS submission and review does regard the zoning
aesthetics and street aesthetics of the site and that, therefore, DOSC and BOPW (among
other entities) are barred from taking any action on the submission. We would further
submit that this stay ("may not take any action") includes the inability to receive the
submission, keep the submission, review the submission, publish notice of the T AC
meeting for the submission, etc.
The remaining question concerns the time during which the stay is effective. In our
litigation against the City COU.DCi! we have argued that this statute should be interpreted
to mean that the stay has been in effect since the declaratory resolution was passed on
January 10,2001. We anticipate. however, that our opponents will argue that the stay did
not begin until the notice of hearing was published. Even jf one accepts such a limited
interpretation, the stay has been in effect since at least February 6. 2001. To be
conservative. the remainder oflhis document assumes, arguendo, the latter interpretation.
As you know, there were two hearings noticed for the CRC hearing. The bearing
originaJly scheduled for 2/16/01 was noticed on or before 2/6/01. The second CRe
hearing was noticed on or before 3/04/01. Unquestionably, the stay was in effect as of
2/06/0 I - DOCS and City staff were prohibited from doing virtually anything with the
ADLS submission (or any Parkwood Crossing submission) beginning on said date. The
only possible issue then is whether this stay expired when the hearing was not held. We
would submit that there is nothing in the statute to suggest that the hearing postponement
or cancellation rescinded the stay. To the contrary, the statute says that the stay lasts until
the resolution is finally acted upon. Thus, we believe it is correct to say that virtually
anything DOCS or other City staff have done on any Parkwood Crossing submission
since 2/06/0 I has been done illegally and must be voided. If one were to somehow
determine that the cancellation did rescind the stay (a position we would strongly
disagree with). the stay would at least have come back into effect on 3/04/01. Under such
an approach, only the City's actions since 3/4/01 could be considered illegal and void.
The final issue regarding the stay is its termination. Clearly. the statute provides that the
stay is to endure "until the confirmatory resolution is set aside on appeal", This means
that the stay will be in effect until the intended litigation is completely resolved. Under
another provision of the same statute we are required to file our litigation within 10 days
ofthe passage of the confirmatory resolution by the CRC (which happened on 3/14/01).

lawsuit is filed? The statute doesn't give an express answer to this question. However,
we believe that the reasonable interpretation of the statute requires that the stay be
effective during the 10 day appeal period and that it would expire at the end of the 10
days if no litigation was filed. A contrary interpretation would allow projects to start and
stop and potentially waste valuable staff' resources.

specific construction sequence is' also needed. Please quantify the size of your

structure.

Brookstone Park of Carmel, Section 2
The plans are being reviewed by the District's consulting engineers, Samuel L. Moore & Associates, and will be submitted

reviewing the plans, the Highway Department has the following comments:
1. In accoRlance with the Hamilton County Thoroughfare Plan, additional right of way is required at
the intersection of 96'" street and Springmill Road. On Springmlll Road, the right of way from
the from the intersection to a point 500' to the north is a 65' half. From that point to the northern
property line the right of way is 50'. I have Included a Dedication of Right of Way form for your
use. Please fill out the form and return it to my attention.
2. Additional right of way may be required at the Intersection of 96th street and Sprlngmill Road to
accommodate the needed road improvements. Please contact the City of Cannel concerning
those requirements.
3. 96'" Street is under the jurisdiction of The City of Carmel, therefore, this Department feels that all

Please find enclosed information relating to an amended ADLS Application for
Parkwood West, building A, Band C. This application should replace the previously
submitted application for this project. This application is more refined and includes
minor deviations from the earlier submittal. There has also been some decisions made
since the original submittal that better define the developable acreage of this property.
This application also considers that matter. The substantial differences between the
application are as follows:
1 . Parking Counts revised to reflect site changes.
2. Site acreage changes to reflect net developable acreage available for this
development.
3. Site and architectural changes to better reflect final design. Refer to
documents submitted with amended application.
