On September 4, 2001, I presented to the Special Study Committee as part of the plans for
Macaroni Grill (Merchants Pointe, Lot 4), the ground signs previously approved for O'Charley's and
Longhorn Steakhouse. The ground sign presented for Longhorn Steakhouse on September 4, 2001,
included a black background and was informally endorsed by the Committee. Since the ground sign
originally approved contained a white background, you now have on file an amended ADLS Application,
(Signage only), for the Longhorn Steakhouse ground sign. A copy of the sign, as presented on
September 4, is attached. I am requesting your assistance in placing this matter on the agenda for the
Special Study Committee for November 6, 2001. I am providing each member of the Special Study
Committee with a copy of this letter, as well as the attached sign drawing. Should you have any

Longhorn Steakhouse, that they are desirous of proceeding with the ground sign as presented to the
Special Study Committee indirectly earlier this month. I would appreciate this matter being placed on the
October 2,2001, Special Study Committee for final consideration iEat all possible. Sinoe the Committee
has already seen the drawing, I did not feel it necessary that we provide a mailing to them. Your

For the permit records ofLonghom Steakhouse. please be ~dvised that the Cannel Plan Commission
Meeting on the 1911\ day ofJune. 2001 unanimously approved the ADLS application ofLonghom tiled with
the Plan Conunission under Docket Number 41-01 ADLS subject to the plans on file with the Department of
Community Services as last amended (plans) and the amendments to the Plans as set forth in the attached
correspondence dated June 11,2001. The approval was further subject to the commitment of the Linder
Company to install a sidewalk between lots two (2) and three (3) providing pedestrian access to Merchant's
Pointe from the sidewalk to be constructed adjacent and parallel to East 116. Street, as contained in the
attached correspondence dated 6/14/01. Jeny, I appreciate the opponunity to have worked with you

Committee last Tuesday;
1. The wall signs shall contain white illuminated letters and the wall sign to be located on the north
elevation shall be mounted flush with the facia of the building.
2. The Steer Head logo shall not be part ofthc sign.
3. The neon accent of the roof line shall be eliminated.
4. The lev-el and intensity of sign illumination shall be suitable and subject to the review and approval of
the Department of Community Services.

We offer the following comments regarding the plans submitted for these lots:
GENERAL INFORMATION AND COMMENTS
I. Each individual lot in the Merchants' Pointe Development will be required to obtain Board of Public
Works and Safety approval of Water and Sanitary Sewer Availability based upon the type of
establishment planned for their 101. Any submission to the Board require.'iprior jinal apprm'lIl by the
Carmel-Clay Plan Commission amI/or the Board of Zoning Appeals amI completion ofpf(~iect
review by the Technical Advisory Committee. All written requests to be placed on the Board's
agenda must include the date (or ilate!>) of approml of the appropriate governing bm{r and include
docket numbers if applicable.
2, Commercial Curb Cuts in Merchant"s Pointe were approved by the Board of Public Works and Safety
on March 18.2001.
3. I ",ant to reiterate the standard requirements to initiate the building permit process. No indi\'idual
building sewer permit. which is a requirement for a building permit. will be issued until:
. The sanitary sewers have been constructed and acceptable air/mandrel tests completed.
. Water mains h;l\'e been constructed, pressure tested, chlorinated and satisfactory I" and 2"" day
test results obtained.
. Base and binder completed on interior streets.
. Storm drainage installed.
. Minimum of (5) Sets of approved construction drawings have been provided,
. Recorded Secondary Plat
. Payment of Water and Sanitary Sewer Connection Fees. The De\'eloper has paid the Availability
(acreage) Fees for the Merchant's Pointe development.
4. This department has approved the overall "master plan" for Merch;l11ts' Pointe. As indi\'iduallots and
construction plans are submitted for approval. the individual plans will be compared to the "master
plan" to determine if they conform to the plan. We will require justification for de\'iations from the
"master plan".
5. T.AC Review/Drawings submilled for approval:
We requestlhat all connllents and comment letters generated by this office be answered in \\Titing alld
bc accompanied by a drawing renecting requested revisions. Any additional rcvisions of substantive
nature made to the plans but not requested by this oflice shall be called to our attention. Filial

The drawings wiII be approved and signed by the City Engineer and by the Director, Cannel Utilities.
The Developer/Owner will receive one-set which must be maintained on the construction site until
work is complete. Carmel Utilities will receive two-sets. Out Public Works Inspector will receive
one-set and the final set will be retained in the Department of Engineering.
6. Please be advised that any installation of signs, walls, irrigation systems, street lights, etc. within
dedicated easements will require a Consent to Encroach Agreement between the Owner and the City of
Carmel. The agreement requires Board approval. Similarly, installations within dedicated right of
way wiII be reviewed and will also require Board approval.
7. Carmel Utilities will provide a separate review of water and sanitary sewer issues for each lot.
LOT #2/0'CHARLEY'S
8. Water and Sanitary Sewer Connection Fees
Based upon the planned seating capacity of 295, as indicated on Sheet C-l Site Plan, the following
Water and Sanitary Sewer Connection Fee calculations would apply to this development:
295 seats @ 0.1 EPUs per seat = 29.5 EDUs
Water - 29.5 EDUs @ $I,31O.00/EDU (Water Connection Fee) = $38,645.00
Sanitary Sewer - 29.5 EDUs @ $795.00/EDU (Sanitary Sewer Connection Fee) $23.453.00
Total Connection Fees - S62,098.00
These fee calculations are based upon the Restaurant classification from the Equivalent User
Contribution Multiplier (Water) and Average User Factors (Sanitary Sewer) tables in our Utility
Ordinance. Any deviation from our Ordinance wiII require recommendation from the Director Cannel
Utilities to the Board of Public Works and Safety for approval. Deviation from our Ordinance will
require tIle submission of a minimum of one-year of actual water usage recapped by month and total
gallons per month. The submission must include the location of the facility, the size and seating
capacity.
9. What area is to be irrigated? Will the irrigatic;m system be included with this construction for just this
facility or will the system be included with the overall site irrigation system?
10. Why are separate plans provided by Weihe Engineers and by Design and Engineering, P.C.? There
appear to be differences between the two sets of plans, particularly in regard to the sanitary sewer
inverts. We do not have the time to compare the two sets of plans to detennine the deviations and
accuracy of one set versus the other. Who will submit the plans for approval by this office? We will
review only one set of construction plans submitted for this development. We reserve the right to
review and to submit additional comments on this project when this issue has been resolved.
LOT #3/LONGHORN STEAK HOUSE
11. Water and Sanitary Sewer Connection Fees
We do not see the seating capacity of this restaurant indicated on the plans. As stated above, our
Water and Sanitary Sewer Connection Fees for restaurants are based upon seating capacity of the
facility. The Connection Fee information outlined in Item #8. for the O'Charlcy's facility will apply to
the Longhorn Steak House facility also.
12. Please clarify the irrigation system plans for this facility as outlined in Item #9.
13. There appear to be separate plans provided for this development also. One set by Weihe Engineers and
one set by WD Partners. As stated in Item #10, this office wiII review only one set of construction
plans submitted for this development and we reserve the right to review and to submit additional
comments when this issue has been resolved.
14. Under Utility Contacts on the title sheet, please change the sanitaI)' sewer and water contact from the
Engineering Department to Cannel Utilities.

One item which is not on the agenda (and has not been on any recent TAC meeting agenda as far as I know): the US
Tennis Association office building project near Five Seasons Country Club. I read about this project in the Carmel
Topics, but we have never seen plans and have never been contacted by the developer about sewer service
requirements for the project. Please have the developer send us plans or contact us. Building permits should NOT be
issued without the District's connection permit.

We have received plans and the District's consulting engineers have completed a preliminary review. Dedication of the
existing sewers will be a condition of CTRWD permit connection approval. The developer has been in contact with the
District on this issue but the dedication process is not complete. Building permits should NOT be issued without the
District's connection permit.
For your information, the Merchants' Pointe projects will be served by Carmel Utilities as the District ceded this area to
Carmel in 2000 and it is now their's to serve.

Design Narrative for Merchants Square
The project has been developed to reflect the design established for Merchants'
Square, yet with an air of prestige. As the project will represent high-end
restaurants, retail and office professionals, the overall image of the project will
reflect a prestigious development catering to these businesses.
This narrative describes how the designers & architects are achieving this image:
[J Site lighting: Blue crook lights like those used at Merchants' Square for all
lighting along the new boulevard that runs through the middle of the project
creates a design link with what is across the street. Building mounted decorative
lighting is on all buildings. Directional, in-scale parking lot lighting - adequately
and aesthetically providing security on the site.
[J Shrubs, small trees, areas for seasonal flowering plants, grass and ground cover
will be used in the landscaping around the building foundations, along roadways
and in parking areas. The landscape design acts as an extension of the re-
designed Woodland golf course. A wide variety of tree species will be used that
complement existing trees.
[J The exterior & interior design of the office and retail buildings on Lots 5, 6 & 7
will be of high quality materials - brick, cast stone and exterior plaster. The
design of these buildings will portray a modern feel that is still reflective of
historical architectural design elements. The resultant design will then be
transitional- looking to the future with the respect due of our past. Concrete
sidewalks and street curbs will be constructed.
[J The franchise restaurants/stores that will be constructed on Lots 1, 2, 3 and 4
have their own unique but complimentary design. A great deal of thought and
review of architectural design has been conducted by our consulting architect
and designer to integrate a diversity of architectural style and materials.
Concessions have been made by the restaurant owners with the materials and
design of their prototypical restaurant to keep the prestigious and respectable
look. The result is the creation of layers on the architectural palate for the site,
rather than making a bland homogeneous look.
With the first two restaurants, it is proposed that the O'Charley's restaurant on
Lot 2 be of a different, but coordinating brick to what is being used on Lots 5, 6
& 7. The LongHorn Steakhouse on Lot 3 is proposed to be of a stacked stone,
with a full range of colors from a dark redlbrown to light sand/tan tones. The
natural quality and color tones in both the O'Charley's brick and LongHorn
stone are nicely balanced and complemented by the buildings setting to the south
of Lots 2 & 3 - those three buildings having the same brick and architectural
style. In other words, the buildings on Lots 5, 6 & 7 form a backdrop of design
and building materials to the individualized architecture of the buildings on Lots
2 & 3. Colors of finishes on Lots 2 & 3 are complementary to all the buildings.
We feel that the diversity of materials adds to the unique and prestigious look of
the site - an interesting blend of materials with complementary colors and
architectural styles.
