EXPLANATION Stonegate Renaissance LLC is the owner of several parcels located north of Main Street and east of Meadow Lane. The site is currently the home of the Stonegate Apartment complex. The common address of the real estate is 429 Third Avenue NW, Carmel, IN. The subject Real Estate is presently zoned R-4 (Residential). The subject Real Estate is outlined in pink on the Aerial photograph shown under Tab 2 of this brochure. The nature of this request is to permit an off premise sign in the median of Meadow Lane which directs the general public to the Stonegate apartments. Under Tab 2 of this brochure, the second page shows the location of the off premise sign, marked with a blue X, in relation to the Stonegate Apartments, outlined in pink. Tab 4 of this brochure identifies the location of on premise signs that are marked in red. The off premise sign which is the subject of this request is (i) located within the median and right of way of Meadow Lane, and (ii) has existed in this location for many years. The off premise sign existed as a prior, legal non-conforming use for several years prior to being replaced. Within the last six months, petitioner engaged the services of a sign company to replace all existing wood signs with an updated, newer and more attractive sign. During the process of updating the signs, the City of Carmel contacted the petitioner and indicated that, with the replacement of the off premise sign, the off premise sign had lost its status as a prior, legal non-conforming use and, further, that a variance was necessary in order to permit the new sign. Prior to replacement of the off premise sign, there were actually two (2) off premise signs located within the median and right of way of Meadow Lane. Photographs of the old signs are shown under Tab 5 of this brochure. As illustrated by the photographs, the prior signs were made of wood. Instead of replacing both prior legal non-conforming signs, the petitioner instead replaced only one of those signs. Photographs of the proposed replacement sign are contained under Tab 6 of this brochure. As illustrated by the photographs, the replacement sign is made of wrought iron and metal, and is no larger than the sign which it replaced. The replacement sign contained under Tab 6 was removed by the petitioner pending the completion of this variance process. The location of the off premise sign is very important to the petitioner as the Stonegate Apartments are set far back off of Main Street and not easy to locate.
