Exolanation for Soecial Studies Committee Meetine: March 30. 2006
The applicants, Bay Development Corporation and Drees Premier Homes, Inc., appeared
before the Plan Commission on February 21 st and the Special Studies Committee on March 7th to
review a Rezone request and ADLSlDevelopment Plan request. The property is currently zoned
R2 and the petitioners desire to rezone the Real Estate to a plan Unit Development District to be
known as the "Village Green Townhomes" which will consist of approximately forty eight (48)
townhome Units.
In the original February 21 st Plan Commission Brochures, the petitioners included aerial
photographs of the Real Estate, a Site Plan, a Landscape Plan, and Building Elevations, as well
as other information and documentation. As a result of discussions at the February 21 st Plan
Commission Meeting and March 7th Special Studies Committee Meeting, further revisions to the
project to the project have occurred. In addition, the petitioners are currently working with the
Department of Community Services regarding the rear elevations of the homes that face the
Monon Trail. The following information reflects changes to the project or additional information
in order to explain the request:
Exhibit 2 - Revised Color Site Plan - The original proposal included fifty (50) total townhome
Units and the revised total includes forty eight (48) townhome Units.
Exhibit 3 - Revised Black and White Site Plan with landscaping - This Site Plan depicts the
location of the townhome Units in conjunction with the associated perimeter and interior
landscaping.
Exhibit 4 - Interior Pictures of Townhomes - This is a photograph of the interior layout of a
typical Drees Premier Townhome Unit.
Exhibit 5 - Letter from Jud Scott - Jud Scott, a Registered Arborist, of Vine and Branch, Inc.,
was part of this Development team prior to filing the zoning applications. Jud's company is well
known and well respected in the City of Carmel. Jud has reviewed and analyzed the site and
previously submitted a Woodland Analysis report for this project. The letter behind Tab 6 sets
forth additional thoughts from Jud regarding the benefits of this project.
Exhibit 7 - Aerial DhotograDh depicting site and existing tree cover - This is a photograph from
the Woodland Analysis prepared by Jud Scott, a Registered Arborist with Vine and Branch, Inc.
This aerial photograph depicts the amount of existing tree cover on the western portion of the
site. Per the proposed Primary Plat and PUD Ordinance, the petitioners would be creating a Tree
Conservation Area on the western portion of the site as it relates to the existing trees on that
portion of the property.
We look forward to appearing before the Special Studies Committee on March 30th to
further review this project.

CAUSE MUD TRACKS, Atf111NG, CLUMPING OF GRASS, ETC. All BlADES MUST BE KEPT
SHARP TO AVOID DAMAGING THE GR.6SS AND MAKING IT MORE SUSCEPl1BLE TO DISEASE.

To the Members of the Plan Commission,
I am sorry that I am not able to attend the committee meeting on the 30th of
March. I have a commitment to attend the Board of Directors meeting for the
American Society of Consulting Arborists (ASCA) in Rockville Maryland.
In lieu of my testimony before the Commission 1 would like to offer some
explanation as to services which my company is performing for the developers of
the Village Green site. We were originally retained to perform a Woodland
Analysis of the property by Mr. Bruce Sklare of Bay Development Corporation in
November of 2005. At the very first contact Mr. Sklare informed me that he
thought "I would be interested in this project because it would entail preserving
a large section of woodlands".
Since our initial contact we have spent numerous hours analyzing the trees on
the site. We are currently analyzing many of the mature trees because we have
advised the development team for Drees Homes that some of them are
structurally unsound and in fact present a potential for hazard to future
homeowners and to the general public along both the Monon and Smokey Row
Road.
We also have a contract with Drees Homes to perform tree preservation
measures (before, during and after construction) that will protect the over four
acres of woodlands that are to be left in tact. This tree preservation will be an on
going process and will result in the retention of a large tract of trees that lies on
the western section of the property adjacent to Cool Creek and partially along
Smokey Row Road.
We have also discussed with Mr. Pete Hils, Division President and Mr. John
Talbot, Land Acquisition Manager for Drees Homes, the possibility of making the
whole project a Designated Wildlife Habitat with the National Wildlife Federation.
We are currently assessing this program and are excited that Drees Homes is

encouraging this direction. We have made contact with the Indiana Wildlife
Federation and are looking into opportunities.
I hope that you will forgive my absence from this meeting and understand that
my opinion is that the intentions of the Developer are in keeping with tree
preservation, Best Management Practices that Vine & Branch has used to win six
national awards for Tree Preservation during Construction. Drees Homes
intentions are also backed up by their signed commitment to my company to
perform these tree preservation procedures.
Finally I have worked with both Bay Development and Drees Homes on other
sensitive sites such as Village Green and have found that both companies fulfilled
their commitments to tree preservation before, during and after development.
