The applIcant seeks to rezone 30 parcels from RIlResidence, Bl/Business, B2/Business,
B3/Business and Il/Industrial to RIlResidence within the Carmel Drive - Range Line Rd
Overlay, B l/Business within the Carmel Drive - Range Line Rd Overlay, B2/Business
within the Carmel Drive - Range Line Rd Overlay, B3/Business within the Carmel Drive
- Range Line Rd Overlay and Il/Industrial within the Carmel Drive - Range Line Rd
Overlay in order to expand the boundaries of the Carmel Drive - Range Line Rd Overlay
Zone.
The area is located along Range Line Road from 136th Street to US 31.
Filed by the City of Carmel Department of Community Services.
Staff seeks to expand the Carmel Drive - Range Line Road overlay to include 30 additional
parcels. The purpose of this ordinance is to expand the boundary of the Carmel Drive - Range
Line Road Overlay Zone north of Old Town to include parcels along Range Line Road from US
31 to just south of 136th Street. The draft zoning map amendment ordinance includes parcel
numbers and a location map of the proposed expanded boundary. Please refer to the draft
ordinance included with the agenda mailing, and also to the revised map included with this
mailing.
The public hearing for this item was held at the January 17th Plan Commission meeting. There
was one person that spoke in opposition.
The Plan Commission requested additional information on how this amendment would affect
current owners in terms of expansions, maintenance, and new construction. This amendment
only increases the overlay boundary to include additional parcels, and as such it will be regulated
by the same text from the current Range Line Road / Carmel Drive Overlay Zone (Chapter 23F).
Maintenance and upkeep of properties is permitted with the provision that such maintenance and
upkeep adheres to existing approved DP/ ADLS plans. Structures that are destroyed through an
act of nature or accident can be rebuilt as they were previously approved.
Proposed expansions that exceed 50% or changes to elevations would require DP Amendment
and ADLS review respectively. Such expansions or changes would be required to meet the
applicable overlay ordinance sections. New construction and site redevelopment would be
required to meet the entirety of the ordinance.
The Department recommends that the Subdivision Committee forward this item back to
the full Plan Commission with a positive recommendation after all comments and concerns
are fully addressed.
