We are looking to replace the existing patio on the north side of the property (concrete) with a deck and a porch cover in the same area. The deck will be 330 sq.ft. where the existing back patio door to the house is, and it will be covered by a wood structure with polycarbonate roofing supported by the home and concrete footings that will be shared with the deck. There will be a small ground level paver area to the east of the deck. The current side yard setback for the S2 zoned property according to the Carmel Unified Development Ordinance section 2.06 is 10', and the request is to reduce the required setback of the side yard lot to 0' so that the deck and structure may be built in this area. Thank you for your consideration, Curtis Teter, Homeowner Statement of Variance: (short paragraph explaining what you are asking for): Requesting a variance to the UDO Section 2.06 District Development Standards for setbacks to reduce the required side yard setback of an S2 lot from 10' to 0' on the north side of the property to allow the existing patio to be replaced with a deck(330sq.ft.), paver area(230 sq.ft.),and a wooden patio cover with polycarbonate roofing over the deck area. The deck, pavers, and roofing will remain inside of the property line.There is an existing fence on the property line between our home and the lot to the north which allows both homes privacy from each other while the area is being used. The total lot coverage with the addition is 32.8%which adheres to the maximum of 35% lot coverage for an S2 property as outlined in UDO Section 2.06. Statement of Support: short paragraph explaining reasons supporting the request, including analysis and comparison of what is allowed vs.what is proposed) This variance should be supported because it will allow the homeowner to have extra space to enjoy the outdoors with friends,family, and neighbors while staying out of the elements. The north side of the property is the ideal place to add the deck because there is already an existing patio in this area. Other sides of the home would not be able to accommodate the deck, patio, or pergola because it would require significant modifications to the existing structure to move the back patio door to a different area and cause issues with the layout in the interior of the home. Having it on the side of the house also offers additional privacy from the Monon trail which is located behind the property to the west. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: This deck, patio, and patio cover will be attached to the existing house with an engineered product(skylift)and concrete footings to ensure that it is structurally sound. It will be built to IBC codes and any local codes that it will be required to adhere to. I have confirmed with the building inspector that this will meet the fire code requirements and not pose risk with the spacing to the adjacent household. It will be used by the homeowner for personal enjoyment of the outdoors and allow them to use the space in the elements. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: Several other houses in the neighborhood have existing covered patio and deck structures where they can enjoy the outdoors. This will add value to the home and the surrounding homes. The structure will not impede on the property line and will be in an area where there is a fence already to offer the neighbors privacy when enjoying their outdoor space on their property. The project will be built from materials that are easily maintained and remains aesthetically pleasing. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: The north side of the property is the ideal place to add the deck because there is already an existing patio in this area. Other sides of the home would not be able to accommodate the deck, patio, or pergola because it would require significant modifications to the existing structure to move the back patio door to a different area and cause issues with the layout in the interior of the home. Without this modification the patio cover would only be able to be 5'from the home and would be of little use to the homeowner. The variance would allow it to be of an appropriate size. Having it on the side of the house also offers additional privacy from the Monon trail which is located behind the property to the west.
