DEPARTMENT REPORT

(V) Murphy Pool Variances.
The applicant seeks the following development standards variance approvals:
2. Docket No. PZ-2022-00049 V UDO Section 5.02.C.7 Pool/decking setback must be 3-ft
from any easement; 0-ft setback requested.
3. Docket No. PZ-2022-00050 V UDO Section 2.06 Maximum 35% lot cover allowed, 41%
requested. The site is located at 4958 Saint Charles Pl. (Kingswood Subdivision Lot 47) and is zoned
S2/Residence. Filed by Jessica Murphy, owner.
General Info & Analysis:
The Petitioner seeks approval to install an in-ground swimming pool. Variances are needed for pool location
and for lot coverage. Please see the Petitioner’s info packet for more detail on the variance request.
Pool Setback Variance:
A 20-ft wide drainage easement runs along the rear property line. Accessory structures, such as swimming
pools, are required to be located at least 3-feet away from any easements. The Petitioner requests approval for
the pool and its decking to be located 0-ft from the easement, abutting it. Also, the pool pump/equipment will be
located close to the house, around 10’11” away from the side property line. The pool pump will also be a quiet
model. In general, the Engineering Dept. does not have any issues with the proposed pool location.
Lot Cover Variance:
The maximum allowed lot cover percent is 35%. The Petitioner requests 41%. Things that contribute toward lot
cover are pavement and concrete areas, building footprints, and other impervious surfaces. The Petitioner
continues to work with the Carmel Engineering Dept. on addressing remaining engineering review comments
and concerns.
The Petitioner addressed all planning/zoning review comments. The Planning Dept. supports these variance
requests, with the condition listed below in the Recommendation.
Findings of Fact:

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of Docket Nos. PZ-2022-00049
V to -00050 V, with the Condition of the Petitioner addressing all remaining Engineering Dept. comments and
requirements, and with adoption of the findings of fact submitted by the Petitioner.
