At the time sidewalks are installed on the properties adjoining this property by other parties, the Applicant will install a sidewalk system the full width of the property. Said sidewalk system would allow connection of a sidewalk in the area. 2. If the City of Cannel elects to annex Applicant's property,the Applicant, their heirs, successors and assigns will not object to such annexation. 3. The Applicant will install and maintain landscaping,pursuant to its landscape plan dated January 31, 1997 as revised July 25, 1997. 4. The Applicant shall locate and maintain the required 20 ft.wide parking area, at a location subject to the approval of the Director of the City of Carmel Department of Community Services. 5. Applicant commits that the tower structure shall be design d it 0irally engineered and erected to a height not more than 80 feet so that it can accommodate wire ess telecommunications service providers or public safety agencies. Such additional wireless communications providers shall be responsible for the financial costs associated with increasing the height of the tower and seeking all necessary governmental approvals to accommodate their collocation. 7. The Applicant will offer to any wireless telecommunications service provider that seeks to collocate its equipment on the tower a commercially reasonable lease or license term so as to accomplish the purpose of minimizing the number of towers that may be erected in the Cannel-Clay community and agrees to submit any disputes regarding the commercial reasonableness of such terms to binding arbitration. 8. The Applicant will notify the Director within 30 days after any oral or written communication from another wireless telecommunications service provider inquiring concerning the collocation on the tower by providing the Director with the name and address of the provider making such inquiry. 9. The Applicant understands that the representations made in the Commitment Nos. 1, 2, 3, 4, 5,6, 7 and 8 above will survive the ownership of the property. The Applicant will make the requirements of 1 through 8 above an integral part of any agreement to sell the property. Binding on Heirs,Successors and Assigns. These commitments are binding on the owner of the real estate,each subsequent owner of the real estate,and each person acquiring an interest in the real estate,unless modified or terminated by the governmental authority authorized to make such modification. Recording. The undersigned agrees to record these commitments in the Office of the Recorder of Hamilton County,Indiana,upon execution and granting approval of the project. Enforcement. These commitments may be enforced by the Department of Community Services and/or the City of Cannel,Indiana, the Carmel/Clay Board of Zoning Appeals,as well and any other wireless telecommunications service provider that desires to collocate. Those changes include: 1. 15-foot setback from 106th Street. 2. All proposed accessory buildings are to be placed at least 5 ft. from lot lines. 3. The arbor vitae are designated as at least 5 ft. in height. 4. The dash lines have been designated as lot lines. 5. A copy of a memorandum from Dickson Hughes Group indicating collocation possibilities within a 1-1/2 mile radius of the proposed site. 6. Cellular One will construct the monopole to 80 ft. However, as indicated by the enclosed elevation drawings, the monopole will be engineered to allow for stacking of additional height up to 140 ft. for collocation of three additional wireless telecommunications providers as set forth in the site plan. Cellular One will invest between $500,000-$750,000 in the construction of this Cellular site, including a rather advanced landscape plan with a larger than usual compound area. Given this amount of investment, Cellular One does not believe it would be reasonable to subject this proposal to administrative or Board of Zoning Appeals approval at a later date as you suggested on the telephone. As with any other project, I believe the zoning ordinance and the approval of the petition by the BZA take into account developments in this industry and the surrounding community, making future approvals unnecessary. Because of the possibility of the Department of Highways wanting dedication of additional right- of-way, we feel it made more sense to leave the parking area at its present location in front of the property, which allows the site to be set back as far as possible, increasing the area for collocation possibilities and will result in less disturbance of the site should the dedication become necessary. In response to the proposal it is the determination of this department that a communications tower of this kind is neither a permitted use or special use in the B-1/business zoning classification, as defined in Section 12.1 of the Carmel/Clay Zoning Ordinance. Even though our department is not inclined to approve your proposal administratively,the remedies offered through the Board of Zoning Appeals process are still available for your pursuit.
