Petitioner seeks Use Variance approval to construct a communications tower. The site is
located at 750 East 106th Street (just east and north of the intersection of 106th Street and
College Avenue). The site is zoned B-2/business.

Petitioner is appealing the decision of the Director of the Department of Community
Services. The Department has determined that the proposed tower is neither a permitted
