Public Hearings:
lb. Ison Fence (V-23-97)
The petitioner seeks a variance to increase the allowable height of a fence from 6 feet to
3 feet.
The Department recommends approval as submitted.
2h., Sh. Sprint Spectrum (UV-28-97, A-31-97)
The Department recommends this project be tabled pending the Plan Commission's
recommendation and City Council's determination on the regulation of wireless facilities.
3h., 6h. Sprint Spectrum (UV-29-97, A-32-97)
The Department recommends this project be tabled pending the Plan Commission's
recommendation and City Council's determination on the regulation of wireless facilities.
4h., 7h. Cellular One Tower (UV-30-97, A-33-97)
The Department recommends this project be tabled ?ending the Plan Commission's
recommendation and City Council's aeterm nation on the regulation of wireless facilities.

8h. Finance Center Federal Credit Union (UV-34-97)
The petitioner seeks use variance approval to construct a bank facility on 2 acres of land.
The Department recommends approval of the project as submitted pending resolution of
the Technical Advisory Committee's issues.
9h-, 10h. McCord Porch Variances (V-36-97, V-37-97)
The petitioner seeks approval of two variances to allow the construction of a porch to
encroach into the required front yard and rear yard setback area.
The Department recommends approval as submitted.
11h., 12h., 13h. Days Inn Variances (V-38-97, V-39-97, V-40-97)
The petitioner seeks approval of three developmental standards variances:
1. To reduce the required minimum lot size from 3 to 2 acres. (This item may be
withdrawn pending the petitioner showing compliance with the Overlay Zone
requirements.)
2. To reduce the required side yard setback from 120 to 75 feet (measured from
hotel structure to the existing house to the north).
3. To reduce the required side yard landscape yard from 30 feet to 10 feet.
The Department recommends approval as submitted.
14h. Little Friends Day Cane Center (SU-41-97)
The petitioner seeks special use approval to continue operating a day care center at 64
Winona Drive within the Newark Village Subdivision.
The Department recommends approval pending resolution of all Technical Advisory
Committee issues.
15h. Modisett Variance (V-42-97)
The petitioner seeks approval of a variance to reduce the required front yard setback
from 40 feet to 36 feet. The Board would need to suspend the rules of procedure for this item
because of improper public notice.
The Department recommends denial of the variance. The proposed house could be built
within the required setback without any practical difficulty.

L Old Business:
li., 2i., 3i, 4i. First Baptist Church of Cannel (SU-24-97, V-25-97, V-26-97, V-27-97)
The petitioner seeks special use approval to construct an addition to the existing church.
Also, the petitioner seeks three variances:
1. to increase the allowable height of the church from 25 to 27.3 feet. (This item has been
withdrawn.)
2. to allow parking to encroach within the required greenbelt area by 15 feet.
3. to allow a decrease in the greenbelt area from the required 30 feet to 15 feet.
The petitioner has also appeared before the Plan Commission and is awaiting a review of
their ADLS application on June 3-rd by the Special Study Committee.
The Department has received revised plans that indicate the multi-purpose building has
been moved to the south and that the height of the building has been reduced to under 25 feet.
The Department recommends approval of the special use application and the two variances
dealing with the ,reenbelt and the parking encroachment, pending resolution of the landscape
plan.,
