The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The request for the variance is on private property. The request will not result in the encroachment of any easement or infringe on any adjoining property line. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The request for the variance is on private property. The request will not result in the encroachment of any easement or infringe on any adjoining property line. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: Without being granted a variance for the 3-ft additional buffer to the existing easement, we will have very limited deck space/ walkway around our pool which results in a safety hazard. We are not asking to encroach any easement, only to build up to the easement line in order to have additional walkway space. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket Nos.
