2. A Consent to Encroach, which was recorded on November 5~ 2001; and
An original Commitments Concerning the Use and Development of Real Estate.
Please note that the Commitments Concerning the Use and Development ofRJal Estate were
not recorded. Actually, I would prefer not to record the commitments so as to not !unnecessarily
clutter the title work with these commitments. Further, once the commitments have been satisfied~
they are no longer an issue. In other words~ these are not continuing commitments. I For example,
the commitments discuss the obligation of the petitioner to dedicate right of way. Due to the
recording on November 5, 2001, the right of way had been dedicated. Further, the pole signs will
soon be removed. In any event~ please contact me should you have any questions. I'

Dear Scott,
This letter is in response to your letter to Charlie Frankenburger dated October 23,2001, concerning the landscaping to take
place at Dan Young Chevrolet and the phone conversation the three of us had on November 2, 2001.

Attached are two revised drawings for the landscape areas in question. The paver section detail was revised for you back in
June 2001 and I apologize if you did not receive that revision. It now has an eight foot width to the land~cape area.

The North West Corner Landscape has been revised because permission was not granted to Dan Young Chevrolet to use the
property to the North of Dan Young Chevrolet. All the plant material that was originally agreed upon was shifted to the South
and redesigned to some extent. Dan Young Chevrolet removed a portion of their parking lot to allow the New North West
Corner Landscape to be installed.
The front entry drive corridor has been revised to allow better connection with the existing stop light on 96th street. Because
of this revision, it changed the shape of the parking lot islands in that area from what was originally designed. The attached
drawing (Sheet L-2A) shows how the landscape was revised. The basic feel of the original design was maintained, and I
added more material because the island areas increased in size. I

We will go back on the trees we have already installed at Dan Young and remove the ropes and part of tlie burlap from the
root balls to help encourage water consumption by the plant per our conversation. We will also do this on any other tree that
we install from this point on.

we can discuss them.

Dear Charles:
I received revised landscape plans for this project October 17, 2001. My comments are
as follows: I
I
1. The paver section detail (sheet L-3) on the October 17th plans has changed from the
details submitted on June 15th of this year. The latest plans show a narrowihg of the
I
planting strip (to 5 feet in width) along the east edge of the paver sections. \fhis is
not acceptable. The planting strips must be at least 8 feet in width as sho~ on the
June 15th detail. A width of 10 feet would be preferable. Given that there are only
three paver sections to be built along Keystone Avenue, and trees with a cblumnar
growth pattern are being installed, this does not seem like an unreasonable tequest.
2. The planting strips in the paver sections need to have the soil prepared so 4t the
plant material (shade trees) to be installed has a reasonable chance of establishment
and mature growth. This might require additional planting media be install~d. If you
would like information on the latest Architectural Graphic Standards, or inf6rmation
on constructed soils that would allow compaction under the pavers while re~aining
pore space for roots, water, and air, please contact me. This would also be a good
idea for any new parking lot islands with trees. '
3. On sheet L-3, the North West Comer Landscape plans shows many plants (f3 trees)
located on property not owned or controlled by Dan Young Chevrolet. Proof must be
shown that Dan Young has permission and agreement to install and maintain
landscaping in this area. If that can not be done, then an alternative planting plan
needs to shown that does not utilize the neighboring property, but still provi~es for
the plant materials to be installed on property owned and maintained by the Dan
Young lot.

D. Young Chevrolet, LLC ("Dan Young") and Young Realty Co., L.P.
make the following commitments ("Commitments") to the Plan Commission for the 1
Indiana, and Clay Township, Indiana (the "Commission"):
1. Description of Real Estate. The real estate is legally described on Exhibit A (the "Real
Estate").
2. Docket Number. 46-0I-ADLS.
3. Commitments Concerning Pole Signs. Within forty-five days after the occurrence of all of
the following events, all pole signs will be removed from the real estate:
(a) I ADLS approval under Docket No.46-0 I-ADLS and the issuance of a building permit
in connection therewith; and
(b) /The approval by the Board of Zoning Appeals (the "BZA") of sign variance requests
under Docket Nos. V-77-0l, V-78-0l, V-79-0l, V-80-0I, V-8I-OI, V-82-0I, V-83-
01, V-84-0I, V-85-0I, V-86-0I, V-87-0I, V-88-0l, and V-89-0I; and
(c) The installation of anyone sign in accordance with the approval of any docket
number specified in 3(c) above.
4. / Commitment Concernina Dedication. The existing Thoroughfare Plan calls for a 75 foot 1/2
right-of-way width for 96th Street. Concurrent with the issuance of a building permit and the
commencement of construction in accordance with ADLS approval under Docket No.
46-0I-ADLS, Dan Young and Young Realty will cause to be dedicated that part of the Real
Estate necessary to widen the existing north one-half of 96th Street, along the Real Estate, to
the one-half (1/2) right-of-way width of seventy-five (75) feet specified in the Thoroughfare
Plan. This area to be dedicated is illustrated by cross-hatc4ing on Exhibit "B".

auto dealership. The site is located northeast of East 96th Street and Keystone Avenue. The
site is zoned B-3/business and is located partially within the SR 431/Keystone Avenue
Overlay Zone.

The Special Studies Committee forwards this item back to the full Plan Commission with a
favorable recommendation by a vote of 6-0.
The applicant has committed to the removal of the two pole signs along Keystone Avenue as part
of their request. The commitment would be subject to all necessary approvals to construct the
development as proposed. The Department has requested that the applicant provide this in
writing and expects to deliver it to the Plan Commission at the meeting. In addition the applicant
has made alterations to the front fayade of the main building. The Special Studies Committee
has reviewed the changes and the applicant has indicated that they will have elevations for
review by the Plan Commission at the meeting.
In addition to Plan Commission approval of the ADLS application, the applicant will be seeking
Special Use Amendment and Variance approval from the Board of Zoning Appeals.
The Department recommends that the Plan Commission approve the ADLS petition
subject to the commitment to remove the two pole signs.

4. Docket No. 46-01 ADLS; Dan Young Chevrolet
Petitioner seeks Architectural Design, Lighting, Landscaping & Signage approval for an
auto dealership. The site is located northeast of East 96th Street and Keystone Avenue.
The site is zoned B-3/business and is located partially within the SR 431/Keystone
Avenue Overlay Zone.
Filed by Charles D. Frankenberger of Nelson & Frankenberger for D. Young Chevrolet,
LLC.
The applicant is requesting approval to renovate the Dan Young Chevrolet site north and east of
SR 431 and 96th Street. Please refer to the applicant's informational booklet distributed with the
June Plan Commission packet for a complete illustration ofthe proposed changes.
The Department is not in agreement with the applicant regarding their proposed signage for this
property. The renovation of the site, which includes changing the number and location of signs
on the property, requires that the site meet the signage requirements. The property is only
permitted by right one 40-square-foot, eight-foot-tall sign. This is due to the fact that the
property is zoned B-3 and requires special use approval.
Specifically, the Department will not support the retention of the two existing ground signs that
are approximately located along the Keystone side of the property. The applicant has proposed
signs located on the main building that are closer in conformance with Ordinance requirements.
These proposed building signs appear to serve the same purpose as the existing ground signs (see
exhibit in informational packet).
Concerns raised at the June 19th Plan Commission meeting included the existing flagpole, the
west elevation of the building, and the landscaping along Keystone Avenue.
Ultimately, any deviation from the permitted level of signage will be at the decision of the Board
of Zoning Appeals as to the number and size and location of signs that will be permitted on the
site.
The Department recommends that this petition, as proposed, be forwarded back to the full
Plan Commission with an unfavorable recommendation.
