This letter serves as an introduction memo for our requested fence variance project(Docket#PZ-
2022-00068 V) scheduled for a public hearing on May 23,2022 at 5:30PM.
Our home,located at 66 Woodland Drive,is a corner lot and as a result is considered to have (2)
two front yards:western yard adjacent to Woodland Drive and northern yard adjacent to 116th
Street. The current building code UDO Section 5.09.B only allows a maximum fence height of 3.5
feet. We are requesting a fence height variance to allow us to build a fence 6 feet in height.
Our fence-building plan is to build a 6-foot tall wood privacy fence to enclose the northern front
yard and then extend the fence to enclose the eastern rear yard of our property with a black chain
link. A goal of this project is to build a fence that will create a visually appealing barrier from the
loud noise,traffic,and debris of 116th Street. More importantly,this fence will help keep our
children safe to play and enjoy our entire property as well as keep our new dog Walter contained,
safe and happy.
Additionally,we plan to create a buffer landscaped yard along the northern side of the fence that
will run parallel to 116th Street. This buffer landscaped yard will soften the overall appearance of
the fence and increase the overall beauty of our property. By increasing our property's beauty,we
will increase our property's value and this will in turn increase the beauty and value of the City of
Carmel.

Carmel UDO Section 5.09.B allows a maximum 3.5-foot tall fence in front yards (with at least 25%
visibility). Our home,located at 66 Woodland Drive,is a corner lot and as a result is considered to
have (2)two front yards: western yard adjacent to Woodland Drive and northern yard adjacent to
116th Street We are requesting a fence height variance to allow us to build a fence 6 feet in height
This fence would begin at the north/west corner of our home and essentially enclose the northern
front yard of our property which is directly adjacent to 116th Street

STATEMENT OF SUPPORT
We are requesting a fence height variance to allow us to build a 6-foot fence to enclose the northern front
yard of our property,which is directly adjacent to 116th Street. 116th Street is the main east/west
thoroughfare in the city of Carmel. Living along side this roadway brings with it a great deal of vehicular
traffic,noise,and debris that penetrate the northern yard of our property. We believe that our proposed
6-foot fence coupled with a buffer landscaped yard running along the northern side of the fence line will
provide for a soft and visually pleasing barrier from the traffic, noise,and debris of 116th Street This
fence will allow for our children,pets,and guests to safely enjoy our entire property.
In examining other similar corner lot property along 116th Street,we found (12) twelve corner lot
properties between Keystone Parkway to Gray Road with front yard fences and walls in excess of 3.5-feet
The following is a list of these property addresses,including a description of their front yard fence or
wall:

Lastly,we spoke to the previous owner of 66 Woodland Drive,Kimberlin Hurson,who advised us that this
property previously had a 6-foot tall white painted fence along the northern yard adjacent to 116th Street,.
Mrs.Hurson informed us that when the city of Carmel purchased a portion of 66 Woodland Drive in order
to widen 116th and install a sidewalk. It was at that time that the fence was taken down by contractors
hired by the city and never replaced.

Bufferyard Design Standards or the table above are staled in terms of minimum width and number of plants required per 100 linear foot increment.
A bufferyard will be created to soften the appearance of
the 6 foot tall wooden fence along 116th Street.
The bufferyard will consist of a 5-ft wide in area, and for
every 100 lineal feet of fence use 4 shade/evergreen trees,
or 10 shrubs, or 10 ornamental grasses.
The bufferyard will be located area (5 to 10 feet) south of
the 116th Street sidewalk and run along the northside of
fence line which will be set 10 feet south of the 116th
Street sidewalk.
The bufferyard plan is to use at least 10 Morning Light
(Miscanthus) ornamental grasses (or similar grasses — see
photo below) and at least 20 lillies (transplanted from our
rear yard) will be planted for every 100 lineal feet of fence
line. Additional landscaping will be added overtime to
more fully fill in the buffer yard space.

1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
This variance request is to allow for a 6 foot fence to be built in what is considered a two front yard corner
lot property at the intersection of Woodland Drive / 116th Street (66 Woodland Drive). The fence will
improve the visual appeal and overall value of the property as well as improve the value of adjacent
properties. Further it will improve the safety of my children, pets, and guests who will enjoy our yard and
be protected from the noise and traffic of 116th Street.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The building of this fence will improve my property's value and beauty, which will in turn improve the
value of the adjacent properties. The most physically closest adjacent property (located 1907 E. 116th
Street) already has existing panel fencing along our shared property line. Also included in this fence-
building plan is a buffer yard landscaping which will include mulch, ornamental grasses, and lilies.
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in
the use of the property because:
116th Street is the major east/west thoroughfare in the city of Carmel. Living along side this roadway
brings with it a great deal of vehicular traffic, noise, and debris that penetrates the northern yard of our
property. As a result, we do not feel safe allowing our children to freely use the northern yard of our
property which also happens to be the largest open grass area. A 6-foot fence will allow for our family to
have a physical barrier from the vehicles, noise, and debris so that we could keep our children, pets, and
guest safe and happy using and enjoying our entire property.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket
No. is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
