Dear Mr. Shinaver:
At the meeting held on Monday, April 24, 2017, the Carmel Advisory Board of Zoning Appeals took the following action
regarding the Development Standards Variance (V) filed by you for the property located at 645 W. Carmel Drive:
APPROVED with COMMITMENTS. Docket No. 17030007 V: Development Standards Variance for Wall sign to face
street for tenant without street frontage requested, was Approved with the following Condition: that Recorded
Commitments must be filed with the Carmel Department of Community Services within 30 days. (See attached unsigned
commitments.)
Please be advised that per Section 30.05.05: Time Limit of the Zoning Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must have been
received and approval granted by this Department. The expiration date of the approval is April 24, 2020.
Please include a copy of this letter with any permit application.

COMMITMENT CONCERNING THE USE
AND DEVELOPMENT OF REAL ESTATE IN CONNECTION WITH THE GRANT OF A
VARIANCE REQUEST
Atapco Carmel, Inc., ("Atapco"), as the Owner of real estate identified in Docket Number
17030007V pertaining to the Lakeside Green building makes the following commitments (collectively,
the "Commitment") to the City of Carmel, Board of Zoning Appeals (the "BZA") related to a parcel
of real estate which is identified by the Hamilton County, Indiana's Auditor's Office as Tax Parcel
Number 16-09-36-00-02-005.000, which real estate is legally described in what is attached hereto and
incorporated herein by reference as Exhibit A (hereafter, collectively, the "Real Estate").
Section 1. Cross Reference and Defined Terms. This Commitment pertains to the Real Estate
and is made in connection with the approval by the BZA pertaining to Docket No. 17030007V.
Any capitalized term not defined herein shall have the meaning as set forth in the City of Carmel's
Zoning Ordinance.
A. "Lakeside Green Building": The building on the Real Estate that is approximately
62,000 square feet in area and adjacent to Guilford Road and Carmel Drive.
Section 2. Commitment. Atapco, and its successors, assigns, grantees and successors in title to
the Real Estate, makes the following commitments concerning the Real Estate:
A. A maximum of one (1) Wall Identification Sign per tenant, per frontage, shall be
permitted on the Lakeside Green Building.
B. A Maximum of two (2) Wall Identification Signs shall be permitted per street
frontage (a maximum of 2 signs facing Guilford Road and 2 signs facing Carmel
Drive) on the Lakeside Green Building.
C. A maximum of one (1) Ground Sign shall be permitted on the Real Estate.
Section 3. Effective Date and Installation. The effective date of the Commitment set forth in
Section 2 shall be upon the approval of the BZA of Docket No. 17030007V.
Section 4. Binding on Successors and Modifications. This Commitment shall be binding
upon each successor, assignee and grantee acquiring an interest in the Real Estate during such
successor's, assign's and grantee's ownership of any portion of the Real Estate. This Commitment
shall remain binding unless modified or terminated by the BZA after a public hearing wherein
notice is provided by the rules of the BZA. The provisions of this Section 4 notwithstanding, the
Commitment shall terminate as to any part or parts of the Real Estate hereafter reclassified
(rezoned) on the City's Official Zone Map via a rezone request other than a rezone request that is
initiated by the City of Carmel and not by the owner or owners of the Real Estate.
Section 5. Recording. The undersigned shall record this Commitment with the Recorder of
Hamilton County, Indiana.
Section 6. Enforcement. This Commitment may be enforced by the BZA.

The purpose of this Letter of Authorization is to notify the City of Carmel the type
of building signage to be installed on the exterior of the Atapco buildings located at
645 West Carmel Drive and 650 West Carmel Drive in Cannel, Indiana.
The exterior building mounted sign(s) to be:
• Front Face -lit illumination
• Channel letters
• Mounted on a raceway
o Painted to match the building
We wish to avoid the individual pin -mounted letters for future building signs in order
to reduce the number of penetrations into the exterior of the 645 West Carmel Drive
building located in Carmel, Indiana.
