S. 31 , but all other signs must have approval of Plan Commission and the Board of Zoning Appeals, our recommendation was that Plan Commission does need to make the decision (which is a part of the official minutes and attached to the Master Copy) . Mrs. Badger moved to suspend the rules and act on this tonight. Mr. Potasnik seconded. The motion carried. Mr. Kevin Miller presented the sign package per plans on file with the Carmel Department of Community Development. Mrs. Badger moved that Docket No. 85-88 ADLS be approved for the tenant R. E. Max Real Estate as presented. Mr. Boone seconded. Approved 10-0. The motion carried. 3h. Commission to consider Docket No. 86-88 ADLS an Architectural Design , Lighting, Landscaping and Signage Plan Application for the remodeling of Carmel Walk Shopping Center located at 1305-1329 South Range Line Road , Carmel . Site is zoned B-8. Petitioner proposes to upgrade facade of building , amend the sign package, add landscaping , parking areas and curbs. Filed by Mark Olnick for Mark Fineberg/Landmark Investments, Inc. Mr. E. Davis Coots, 255 E. Carmel Drive, made presentation. The Site plan and elevations were shown which are on file with the Carmel Department of Community Development. Sign Package was presented. Sign will be cranberry in color , not to exceed 2 ' in height , with silver edge on letters. Building will be painted gray and cranberry. Mr. Potasnik questioned if there were individual signs on the facia of the building. Mr. Coots stated there are individual signs. This item will go to the Industrial and Commercial Committee on September 6, 1988 at City Meeting Hall . 4h. Commission to consider Docket No. 87-88 ADLS, an Architectural Design , Lighting , Landscaping and Signage Plan application for a new 47,250 square foot (phase one 31 ,250 sq. ft. , phase two 16,000 sq. ft. ) one story office building for Firestone Building Products Inc. this building is to be located in the Meridian Technology Center complex at the intersection of Congressional Blvd. and 117th Street , Carmel , Indiana. This site is zoned B-6. Filed by Mr. Kevin Miller for Technology Center Associated Ltd. Mr. Michael C. Browning , General Partner. Mr. Kevin Miller presented the following information , a copy of which is on file with the Carmel Department of Community Development. Site Plan was shown. Elevation and Landscape Plans were shown. Mr. Boone questioned what will racing stripe be made out of? Mr. Miller stated it would be a 1 ' tall band made of drivet material and painted. Mrs. Badger questioned if it will be illuminated in any way, and is there CARMEL FLAN COMMISSION MINUTES -- AUGUST 16, 1988 Page / a parapet on building that will hide mechanical equipment. Mr. Miller stated the stripe is not illuminated and there will be a parapet on the building. This item will go to the Industrial and Commercial Committee meeting on September 6, 1988 at the 7: .30 P. M. at the City Meeting Hall . 5h. Commission to consider the recommendation of the Subdivision Committee which request that the Carmel /Clay Flan Commission at tonight 's meeting enact a moratorium to not consider future cluster housing subdivisions for a period of 120 days or until a new ordinance is enacted dealing with "Cluster Housing/Zero Lot Line/Small Lot Subdivisions" whichever is less. Recommended by the Carmel /Clay Plan Commission/Subdivision Committee. Mr. Albright of the Subdivision Committee stated they have been working on upgrading the existing ordinance on Cluster Housing. Mr. Albright moved that we enact a moratorium to not consider future Cluster Housing subdivisions for a period of 120 days or until a new ordinance is enacted whichever is less. Mrs. Lamb seconded. Mr. Kiphart read staff recommendations (which is a part of the official minutes and attached to the Master Copy) . Mr. Johnson questioned whether we have the authority to have a moratorium? Mr. Byers stated that he needs to do some research on this. First thought is that the Flan Commission does not have the authority to declare a moratorium on zoning or land use regulations that our remedy is to change the ordinance through the normal process of an Advisory Flan Commission and refer to • the common council . Until he gives it his personal review his advise was not to act on this tonight . Mr. Byers feels that the proper solution is to change the ordinance and make it deal with what our intent is and what the thoughts of the community would be after proper public hearing. Mr. F'otasnik: questioned that if we voted on this tonight would there need to be a final action by the City Council . Mr. Byers stated that technically zoning ordinances are changed by Council . To act on something without having valid research done, in his opinion , would be unwise. Mr. Johnson feels that the Flan Commission does not have the authority to act on this matter that the alternate solution that Mr. Kiphart presented is also a deviation from the rules and the procedures that are already enacted and in place. It was Mr. Johnson ' s opinion to rescind the existing Cluster Housing as permitted ordinance and work on a new ordinance. Mr. F'otasnik: questioned the second part of staff ' s recommendation , can we enforce the purpose and intent of the existing ordinance? Mr. Byers stated that it is probably what we ought to do anyway. We need to review the ordinance and the project if the project meets the requirements and the intent and purpose of the ordinance The project is put on the Plan Commission Agenda. Mr. Johnson questioned of the Cluster Ordinance, what if the submitted project does not meet the purpose and intent? Mr. Albright stated whether or not it meets the purpose and intent is somewhat subjective and all we have been reviewing for compliance with numbers in the ordinance as opposed to the original purpose and intent. Mr. Albright is not sure why we are dealing with this as a zoning matter , seems we are talking about approval of a subdivision matter and subdivisions do
