Dear Lawrence and Melanie:
Weare writing in response to your correspondence dated March 15, 2006 regarding the
remediation work performed on your home. Below you will find an explanation of our position
as-to-each-item_ofconcern.
(I) Leak in garage: A new leak in your garage would fall under the coverage provided
by the remediation warranty you received through the Class Action Settlement
Agreement. We will be happy to follow-up and explore this area to determine if in
fact there is a leak.
(2) Large basement window: The concerns you have with this window were evaluated
and addressed by Dave Howard and John DeWeese of Cain Companies on
Wednesday, March 15,2006 and Thursday, March 16,2006. In addition, John
DeWeese was out to your house on Friday, March 17,2006, to verify all the work
performed on this window.
(3) Sliding door: We will follow-up and check to see if the sliding door continues to
work properly.
(4) City o.fCarmel Inspection: We are in compliance with all the requirements of the
City of Carmel. The City of Carmel has performed the necessary inspections and
signed off on each. The City of Carmel does not need to provide us with a final sign
off in order for our remediation work to be considered complete.
(5) Other cosmetic items: John DeWeese is aware ofthe remaining cosmetic items and
will follow-up to address them.
We hope this response adequately addresses your concerns. As we expressed to you in the
beginning of this process, we require your assistance in allowing us access to your home to
perform any work. Since we have had difficulty in scheduling work on your home, we reiterate
the importance of mutual cooperation in order to address the issues you may have and complete
any outstanding cosmetic items.
