The applicant seeks the following development standards variance approvals: 5. Docket No. PZ-2022-00062 V UDO Section 5.02.B.3 Maximum 24’ x 30’ accessory structure allowed, 28’ x 42’ detached garage requested. 6. Docket No. PZ-2022-00063 V UDO Section 2.04 Maximum 18-ft accessory structure height allowed, 20-ft detached garage requested. The site is located at 13145 West Rd. and is zoned S1/Residence. Filed by Glenn Hoge, owner. General Info & Analysis: The Petitioner seeks approval to build a detached garage with workshop area on a 1.3 acre parcel of land. BZA variance approvals are needed for the proposed footprint size, as well as for the height. Please see the Petitioner’s info packet for more detail on the variance request. Garage Size Variance: The maximum allowed detached garage size is 24’ x 30’ (720 sq. ft.), and the requested size is 28’ x 42’ (1,176 sq ft). That is a variance of 456 sq. ft. Garage Height Variance: The maximum allowed detached structure height is 18-ft, and 20 feet is requested. This is a variance of 2 feet. The proposed detached garage will be located approximately 243 feet back from West Rd., 60 feet from the rear/east property line, and 5 feet from the side/south property line. (We have correspondence on file that the neighbor to the south has no objections). A stone driveway will be extended to connect the structure to the existing stone drive. The Petitioner has also agreed to complying with the Transportation Plan, as required by UDO section 1.07. The future plan for West Rd. is a 90-ft wide street right of way (or a 45-ft half). As part of this BZA variance approval, the Petitioner commits to dedicating a 45-ft half street right of way to the City if/when they ask for it. The Petitioner addressed all planning/zoning review comments. And, the Planning Dept. supports the variance requests, with the condition listed in the Recommendation below. Findings of Fact: Please refer to the Petitioner’s Findings of Facts included in their info packet. Recommendation: The Dept. of Community Services (DOCS) recommends positive consideration of Docket Nos. PZ-2022-00062 V and PZ-2022-00063 V with the condition that the Petitioner/Landowner dedicates a 45-ft half street right of way to the City if/when they ask for it, and with adoption of the findings of fact submitted by the Petitioner.
